This chapter explored the intricate relationship between law, society, and sustainable development, emphasising their interdependence in achieving societal progress and stability. It argues that law is not merely a set of abstract rules but a social construct embedded within the cultural, economic, political, and institutional frameworks of any given society. Drawing from classical sociological theories and contemporary perspectives, the study illustrated how laws evolve through societal processes and how they serve as vital instruments of social control, justice, and institutional regulation. The discussion extended to the critical role of social institutions—such as the family, education, economy, religion, and government—as foundational pillars through which the law operates to fulfil its regulatory and developmental mandates. The chapter posits that sustainable development, with its economic, social, and environmental dimensions, cannot be realised in a lawless or unjust society. It contributes to scholarly discourse by situating law within a sociological context and demonstrating that effective legal frameworks and adherence to the rule of law are prerequisites for peace, equity, and sustainable development. The study recommended a more integrative and culturally responsive legal approach to social planning and policy implementation, and suggests further empirical research into how law adapts in response to evolving social norms and global development pressures.

With President Trump once again accusing major media outlets of being 'fake news,' now is a good time to revisit the concept. What is the true function of ‘fake news’ in societies today? In practice, the term can mean different things in different contexts. In our highly polarized political climate, sorting factual from false often seems less about sussing out truth than gaining political traction. While there are many legitimate researchers out there uncovering the dangers of misinformation and disinformation online, the concept of ‘fake news’ is something altogether different. Some scholars have argued that it is used as a discursive signifier - in other words, it is a linguistic weapon used to delegitimize political opponents. Moreover, as countries around the world are considering new legislation to combat the spread of online misinformation, there is a troubling growing trend in some places to use these very laws to silence or censor any opposition to or criticism of the government - what some are defining as a type of digital authoritarianism.

The problem with the structure of authority in Nigerian society is that it is often undermined by exclusion, mismanagement and elite manipulation, which transform its integrative potential into a source of conflict and instability. This paper examined the structure of authority in Nigerian society and its complex role as an instrument of integration, conflict generation and conflict management. Drawing on thematic-content analysis of secondary data including scholarly articles, government reports and historical records, the research explored how political, traditional, religious, security and economic authorities shape social cohesion and national stability. Findings revealed that while these authority structures are designed to promote unity through inclusive policies, cultural preservation, moral guidance, law enforcement and economic regulation, they also frequently become sources of tension. Electoral malpractice, ethnic bias, religious extremism, security force brutality and economic marginalisation, particularly in resource-rich regions like the Niger Delta, have all contributed to deep-seated grievances and unrest. Despite these challenges, each authority structure also possesses conflict resolution mechanisms, such as election tribunals, interfaith dialogues, traditional mediation, institutional reforms and development programmes aimed at restoring peace. The study argued that the effectiveness of authority in promoting integration or managing conflict depends on how fairly and transparently power is exercised. It further reveals that elite manipulation, exclusionary governance and weak institutional accountability often undermine the intended integrative functions of authority. This research contributes to existing scholarship by providing a holistic framework for understanding the ambivalent role of authority in Nigeria's socio-political landscape. It recommends systemic reforms, grassroots inclusion and inter-sectoral collaboration as necessary pathways toward transforming authority into a more effective tool for national cohesion and development. Future studies should explore comparative frameworks and community-level experiences to deepen insight into the dynamics of authority and conflict in diverse African settings.

The concept of the dual state has recently been revisited by various scholars to shed light on the operation of state mechanism in current autocratic regimes. From Fraenkel's perspective, the idea of dual state presumes a two-winged state mechanism, which is based on the coexistence of 'normative' and 'prerogative' states. Besides the classical model on the legal regime of the Third Reich, it seems that it has become an excellent tool for the sustainability of current autocratic and populist polities. This paper will draw attention to the similarities on the political and legal anatomies of current cases and the German case of the 1930s. In doing so, it will place an emphasis on the changing character of contemporary prerogative states which are more subtle and complex, and therefore could be more hazardous for democratic ideals than their historical counterparts.

The relationship between law and autocratization is usually discussed with reference to the judiciary and how a powerful executive can encroach on the domain of the judicial branch. In this article, I suggest that the legal profession also needs to be brought into the discussion on autocratic legalism. Taking Turkey as my case, I put forward two main arguments: first, that, in national contexts where the legal profession is perceived to be originally and organically tied to the state-the "ancien regime" that aspiring autocrats try to dismantle-autocratic legalism involves efforts to overtake not only the judiciary but also such legal professional institutions as bar associations and their umbrella organizations and, second, that legal autocratization is made possible not only through such conscious/targeted attacks but also through processes and policies that are intended for other goals. In Turkey, the neoliberalization of legal education through a populist discourse and the consequent massive increase in the lawyer population has created heterogeneity and multiple fault lines within the profession. Such dynamics have created not only apathy, particularly on the part of young(er) lawyers, but also a weakening of the profession as a whole, preparing the groundwork for the more intentional attacks of the autocratic government. The result, I argue, is "professional liquidation."

Abstract: The paper presents the symbolic dimension of the (re)production of Poland's Constitutional Tribunal, which is considered to be a model legal-political institution. Paying close attention to meaning, narrative, symbolic codes, and rituals, the authors object to a reductionist explanation, based on instrumental thinking and conscious and material interests, of the legal institutions of power. In accordance with neo-Durkheimian cultural sociology, the Tribunal is presented here as an institution created through binary symbolic codes (sacred/profane), and reproduced, in crisis situations, in performative acts constituting moments of ritual purification. The dominant narrative legitimizing the Tribunal counterpoises 'sacred' law with 'profane' politics in order to superimpose subsequent homological classifications (rational/irrational, pure/impure, universal/particular). The research presented  here  was conducted  by Dom -Research Group  on Anthropology  of Law and its objective  was to understand  the state of the art of legal anthropology in  Brazil. In a first phase,  the  focus  was  on  the  analysis  of  periodical  publications  that  used  the  keywords "anthropology  of law" or "legal anthropology"  in their  indexation.  From this  collection in  public  databases,  68  publications  were  selected,  according  to  the  methodological  description.  From these  publications,  we  analyzed  and  discussedI)  object  of the  works;  II)  authors'  training;  III) strategies  and  procedures  used;  IV)  theoretical  contribution;  V)  geographical  location  of  the publication  vehicle;  and VI) year of publication.  As results, the group found a great dispersion  in the  formation  of  the  authors,  with  most  people  with  a  Law  degree.  It  was  also  verified  an expansion  of  publications  from  2010  onwards,  as  well  as  the  identification  of  a  grouping  of periodical  texts  in  the  field  of methodology  and  epistemology.  Finally,  among  otherresults,  it was possible  to map  the main theoretical references  used, with  emphasis  on reference authors in the area.

Számomra ez úgy merült fel, hogy sok-sok kérdezés és tudásbányászat közben egyszer rákérdeztem egy saját tanulmányomra, megadva, hogy abban mely bevett és ismert szerzők elméletei alapján korrigáltam egy szintén neves szerző ismert művét. A ChatGPT4o1pro bár a válaszban bevallotta, hogy nem találta meg ezt a művemet, de alapul véve a korrigáláshoz általam jelzett elméletek fő állításait és az ezek alapján általam kritizált elméletet főbb vonásait vázolta, hogy feltehetően milyen állításokat tehettem én a sajnálatosan nem talált művemben. Bár válasza közel állt a ténylegesen általam végrehajtott korrekciókhoz, de néhány olyan állítást is tett, amiket én ugyan nem tettem, de amelyek az alapul vett és a kritizált elmélet viszonyában tényleg lehetségesek voltak. Ez tehát a ChatGPT originális állításainak lehetőségét vetette fel számomra, és azt, hogy módszertanilag célzott kérdésekkel egy-egy tárgyat érintő elméletek keresztezésére felhívással folyamatosan originális állításokat lehet a segítségével létrehozni. Ez az anyag ezt kísérelte meg néhány témakör vonatkozásában, és a válaszok alapján azt lehet megállapítani, hogy korlátozottan ugyan, mert sajt bevallása szerint is a tréningeztetésében felhasznált általános tudásból mindig merít a válaszaiban, de a ChatGPT képes originális állítások megfogalmazására.

The importation of law and the creation of Modern legal system in Iran, the subject of this research, is one of the most important events in contemporary history because based on the sociology of law approach, social norms, including law, arise from social solidarity, and the sanction of the normative rules of law provided by the Society to the State as the agent of collective conscience. The Purpose of this article is finding an answer to the question of what is the theoretical foundation of the independence of the legal system separated from society? The method of critical examination of Durkheim's sociology of law revealed the result and steps of the answer in this way that ignoring the gradually emerging of social control rules has led to the monopoly of legal norms into statutory law, which along with the monopoly of sanctions to the State, the basis of the validity of legal norms has been transferred from the Society to the State, and this legal system that relies on the State can be established by importing legal norms from Europe. The discussion about the impossibility to import the legal norms in order to connect law with society, will be a step in realizing Articles 5 & 9 of “General policy of Iranian law system”.

The authoritarian legality approach establishes a Dual-State in Pakistan by undermining normative processes of law and economic decision-making and empowering prerogative socio-legalist approaches in governing methodology about economics. The present research draws upon this history to inquire how the formation of the Special Investment Facilitation Council (SIFC) builds upon the legacy of using law as a wielding instrument to fuse authoritarian power in shaping and imposing economic decisions that are devoid of democratic political legitimacy and cross-societal parliamentary and civil representation, and founded on the elements of arbitrary power, executive authority, and coercive violence. These elements are the foundation for the ideas that structure the relationship between authoritarian legalism, arbitrary power, and economic decisions.

Studija koja je pred nama ispituje politička opažanja i lična politička iskustva studenata Pravnog fakulteta Univerziteta u Beogradu sa aspekta sociološko-pravne analize. Cilj ovog rada je da kombinacijom teorijskog i eksplorativno-empirijskog istraživanja ispita i objasni šta navodi studente da razmišljaju o politici, na koji način oni to čine i kako se to odražava na njihov politički život. U radu možemo uočiti pet celina. U uvodnom delu su izloženi ciljevi ovog rada i perspektiva za koju su se autori odlučili u posmatranju pomenutih fenomena. Drugi deo predstavlja kratak pregled metodologije empirijskog istraživanja.
Centralni deo rada posvećen je političkoj participaciji mladih (studenata prava) sa posebnim osvrtom na ulogu medija. Na samom kraju iznosimo zaključke o odlikama i širem društvenom značaju fenomena političke participacije dobijene primenom različitih metoda u multidisciplinarnom pristupu.

The article aims to examine the Right to active citizenship in urban planning policies in cities, from a critical perspective. We started from the notion of existing socio-spatial inequalities in order to recognize the illusion / insufficiency of the universal inclusion project. It was concluded that there is a need for instruments for the modal and progressive inclusion of socially excluded groups, taking into account their specificities, from the affirmation of the human right to participation in urban management.

Between 2019 and 2022, the Bolsonaro's government propagated a strong antienvironmental and anti-indigenous rhetoric that devalued how indigenous peoples live and occupy these territories. In this paper, we are interested in understanding the total repercussions of Bolsonaro's anti-environmentalism, focusing on the legal norm propositions involving indigenous peoples and indigenous lands. We argue that the Law is one crucial instrument to maintain or change social relations and by tracing normative changes, we can comprehend important aspects of power disputes in specific contexts. In this sense, we examine the production of legal norms by the federal government and by the National Congress that flexibilize, sometimes indirectly, the territorial rights of indigenous peoples and how this process is publicly defended by the contestation of indigenous history, culture, and rights.

Since colonial times, law and legality have had a complex relationship with the nature of state structure and the character of politics. This complex relationship was intrinsically dichotomous in scope and practice. As a postcolonial state, Pakistan inherited those traditions of law and legality within its sociolegal and sociopolitical frameworks. The present study seeks to underscore the preservation and continuance of the pernicious authoritarian legality in the Pakistani state’s methodical managing and controlling the politics through a dual approach and take cognizance of an intricate and fractious relation between constitutional fundamental rights and arbitrary expression of power by state structures. The research will apply a qualitative content analysis method to study three legislative tools of state control: The National Accountability Ordinance (NAO), the Maintenance Public Order Ordinance (MPO), and the Anti-Terrorism Act (ATA). It will apply the theoretical framework of the Dual-State model that was propounded by Ernst Fraenkel in seeking to answer the following research questions: How does the dual-state model capture the dichotomy of constitutional fundamental rights and arbitrary culture of power in the Pakistani state? How the twofold threats of disqualification and repression are codified in Pakistan’s authoritarian legality? How does the state deploy these twofold threats as state instruments in managing and controlling politics in the country? Given the imbalance in the trichotomy of power in the constitutional framework, the research on the Dual State embedded within the Pakistani state structure is pertinent to understanding the intricacies, nuances, and challenges of democratization and constitutionalism.

Exatamente por isso, é um ano de urgência do pensamento crítico, da reflexão informada, do debate franco de ideias. Nesse sentido, apresentamos o mais novo número da Revista Direito e Práxis (vol. 9, n.1, 2018-21° edição-jan-mar) com mais doze artigos inéditos, resenhas, traduções e um dossiê muito especial. Os editores convidados, professores Rodolfo Jacarandá e Marcio Secco, ambos da Universidade de Rondônia, organizaram uma primorosa seleção de trabalhos, discutindo "Questões Amazônicas" sob as mais diversas abordagens. Os artigos tratam de temas que abarcam conflitos agrários, direitos humanos, papel do sistema de justiça na região, além de pontos específicos no âmbito do sistema penal e da resistência socioambiental. A capa dessa edição, com sua força e expressividade, reflete a abordagem radical e crítica adotada pelos editores. O trabalho é uma imagem do artista de Rondônia, Joeser Álvarez, a quem também agradecemos a gentil concessão da imagem. Passando para a seção geral de artigos, destacamos trabalhos críticos e de referência nos temas da teoria do direito, teoria materialista do estado e do capitalismo, teoria constitutional e movimentos sociais. Resumo A história de um processo pode indicar transformações sociais, jurídicas, econômicas e políticas. O caso em análise representa uma reclamação trabalhista promovida por trabalhadores de uma mina de carvão que questionava o descumprimento da recém legislação social promulgada pelo governo provisório de Getúlio Vargas. No bojo deste dilema, muitas estratégias e ações foram utilizadas pelas partes em conflito, tanto para se adequar quanto resistir às regras constitucionais junto ao Conselho Nacional do Trabalho. Diante de incertezas e debilidades, com a microhistória identificam-se relações entre justiça, trabalhadores e empregados que se forjavam em novos “locais de direitos” naquele período.

O objetivo do presente artigo é analisar a percepção de estudantes que participaram dos projetos de reescrita de decisões judiciais em perspectivas feministas entre 2021 e 2022 sobre os impactos da experiência na formação jurídica. Elencamos os efeitos que estudantes de graduação e pós-graduação perceberam que foram produzidos pelo projeto em suas instituições de ensino e na sua formação como juristas. O estudo foi qualitativo e se valeu de um questionário em formato virtual para coleta dos dados. A revisão bibliográfica que informa o presente estudo, considerou a literatura que aborda a dimensão pedagógica dos projetos de reescrita feminista em vários países e os estudos que discutem os desafios da formação jurídica crítica no Brasil. Os resultados da análise confirmam o potencial das atividades de reescrita feminista em favorecer a formação crítica e interdisciplinar de estudantes de direito.

Partindo-se de um campo etnográfico dedicado à realidade da comunidade afro-equatoriana "La Chiquita", nomeadamente quanto à sua luta pelo território ancestral que é-lhe de direito face à desterritorialização promovida pelo avanço do monocultivo de palma azeiteira, propomos: (I) compreender a dimensão da «colonialidade» do Estado no interior deste conflito, incluindo-se o ethos disciplinar e institucional que interpreta a negritude; e (II) identificar e analisar as diversas formas de resistência desta comunidade em resposta a tal estrutura sociopolítica vertical, trazendo à tona as narrativas do seu contexto desde uma crítica centrada na epistemologia e na sociologia jurídica.

Modern constitutionalism - based on the ideas of unity, uniformity and homogeneity - has resulted in an immense waste of legal experience in the world. This chapter addresses the possibilities and limits of the concept of legal pluralism in expanding the recognized legal reality and the possibilities of political imagination. Based on the challenges and conceptual instruments of the ‘epistemologies of the South’, as proposed by Boaventura de Sousa Santos, it aims to critically discuss the extent to which theories and empirical studies of legal pluralism, as well as the different recognition policies, have contributed to decolonizing the Eurocentric legal canon. By adding categories to Sally Engle Merry's widely accepted typology, five approaches to legal pluralism are identified: classical legal pluralism, new legal pluralism, global legal pluralism, instrumental legal pluralism and intercultural legal pluralism. A sociology of absences is developed for each approach, in order to determine whether modern hierarchies are questioned or reproduced. The conclusion of the chapter discusses possibilities for constructing post-abyssal legal thinking through a sociology of emergences applied to the diversity of legal maps of the world.

A metodologia utilizada é a analítico-dedutiva com técnica de pesquisa teórico-bibliográfica, descrevendo aportes teóricos sobre a primeira guerra mundial e seus reflexos nos estados-nação, sobre a revolução russa e o totalitarismo, sobre a segunda guerra mundial e a guerra fria, sobre a chamada era de ouro e suas consequentes mudanças sociais e culturais, destacando a configuração dos estados-nação no final do século XX com a crise do socialismo real e democratização do estado europeu os cenários no fim do século, apontando, à guisa de conclusão, a orientação pela reorganização do Estado frente ao policentrismo na economia globalizada.

The Journal on Education in Emergencies (JEiE) publishes groundbreaking and outstanding scholarly and practitioner work on education in emergencies (EiE), defined broadly as quality learning opportunities for all ages in situations of crisis, including early childhood development, primary, secondary, non-formal, technical, vocation, higher and adult education.

Resumo Trata-se um estudo que visa a identificar a contribuição do movimento negro no processo de construção do direito quilombola no Brasil, com ênfase no período (préconstituinte). Para tanto é analisada a formação do Estado brasileiro e a inserção do negro no seu contexto social e político, após, estrutura-se as características do movimento negro, identificando seu repertório, estratégias e ações no pré-constituinte. Percebeu-se que o intenso papel do Movimento Negro Unificado (MNU) foi responsável pela inserção de direitos étnicos-quilombola no texto constitucional consolidado em 1988.

Existe um direito da antidiscriminação legislado que proteja as pessoas LGBTQIA+ no Brasil de hoje? Por meio de levantamentos normativos, especialmente legislativos, que atravessam todas as esferas da federação, bem como de pesquisa teórica interdisciplinar, o artigo demonstra que sim, que esse direito existe e que tem uma importante dimensão legislativa. A partir do desenho de um mapa da legislação, propõe-se a leitura de três dimensões: da exigibilidade, em diálogo com a reflexão contemporânea do caráter de direitos fundamentais dos direitos LGBTQIA+; da interdependência, dimensão dos direitos fundamentais explorada para reconectar a legislação da antidiscriminação LGBTQIA+ em múltiplas dimensões e como um corpo normativo; e, por fim, da progressividade social e vedação ao retrocesso, como direcionamento jurídico chave diante de potenciais ataques legislativos a esses direitos.

The COVID-19 pandemic is an emergency of an exceptional scale, with major impacts on education globally and with significant new challenges for education in existing humanitarian contexts. This Viewpoint reflects on the immediate challenges of continuing education in humanitarian contexts and on the experience of the Inter-agency Network for Education in Emergencies (INEE) as a network supporting collective action of Education in Emergencies (EiE) practitioners globally. It also looks forward at INEE's plans to support quality distance education and issues to consider on the reopening of schools. It concludes with reflections on the needs and risks for EiE longer term.

This paper examines the impacts of the plagues in dramatic literature and performance art beginning with ancient Greek Theatre and ending in Contemporary Theatre. It addresses the traditional application of the metaphorical employment of the plagues and a shift towards the pronunciation of the space in Contemporary Theatre. This research exposes the existential concerns that threaten humanity, such as fascism, marginalization, and the catastrophic consequences of climate change. To clarify the main argument, the classical and modern texts, along with the opinions of legendary theater theoreticians, directors, and artists, are examined. These sources range from Sophocles' Oedipus the King, Daniel Defoe's A Journal of the Plague Year, Albert Camus' The Plague, and Ann Bogart, to Robert Wilson. These existential concerns, along with possible artistic responses to the current problems of climate change and COVID-19, inspired them to start a discussion through more ecologically concerned theater practices..

Resumo O presente artigo tem o intuito de realizar análise da sub-representação política de mulheres negras no legislativo federal brasileiro sob a ótica da colonialidade. Para tanto, realiza um estudo sobre as marcas da violência sistêmica perpetradas pelo colonizador europeu. Para demonstrar como essas violências se edificam na dominação europeia na América Latina, é fundamental vislumbrar o problema a partir de uma perspectiva feminista negra sul-americana a fim de desvelar e compreender como esta estrutura falida silencia e inviabiliza que mulheres ocupem espaços de poder e decisão.

Law was evolved to regulate conducts and facilitate desired changes in targeted facets of human endeavor. In societies where democracy has been adopted, election constitutes the main instrument of leadership selection. The significance of election has placed it at the center of all democratic activities. Its conduct, however, becomes meaningless and may result into human discomfort and misfortune of unconceivable scale where the rules of engagement are violated or completely discarded. While the literature indicates that election attracts global attention by the day, its administration in many of the global south, including Nigeria, has produced outcomes that require genuine reassessments of the underpinning legal precepts. Between 2019 and 2022, the Bolsonaro’s government propagated a strong anti-environmental and anti-indigenous rhetoric that devalued how indigenous peoples live and occupy these territories. In this paper, we are interested in understanding the total repercussions of Bolsonaro’s anti-environmentalism, focusing on the legal norm propositions involving indigenous peoples and indigenous lands. We argue that the Law is one crucial instrument to maintain or change social relations and by tracing normative changes, we can comprehend important aspects of power disputes in specific contexts. In this sense, we examine the production of legal norms by the federal government and by the National Congress that flexibilize, sometimes indirectly, the territorial rights of indigenous peoples and how this process is publicly defended by the contestation of indigenous history, culture, and rights.
