Sociology of Law & Political Sociology

This paper revisits the sociology of international commercial arbitration on the
basis of unexploited archives and data. This material casts new light on the
competition between “grand old men” and “young technocrats” in the 1980s
and 1990s, a theme that has structured the analysis of international commercial
arbitration since the pioneering work of Yves Dezalay and Bryant G. Garth
(Dealing in Virtue). In contrast, the data show that the crucial transformative
period actually took place between the 1950s and 1970s, when a relatively welldefined
group of individuals emerged as the leading arbitrators at the International
Chamber of Commerce. These individuals— the “secant marginals”—
succeeded in constructing a cooperative interface (rather than competition)
between otherwise separate legal systems and professions. In doing so, they created
the conditions necessary for the emergence of a new transnational legal
profession. At a more general level, the article proposes an alternative narrative
of globalization, wherein actors operating at the intersection of various systems,
create new arenas of governance on the basis of inter-system cooperation.

A társadalmi környezet, a kontextus azonban jócskán megváltozott. A tudományos szemléletet és mozgalmat jellemző társadalomjavító szándékot erősen megtépázta a Great Society összeomlása, a racionális irányítás elhalványulása, a konzervatív fordulat, a posztmodern filozófus, Baudriard kifejezésével a társadalmi halála (e gondolat részletes kifejtéséhez ld. Rose 1996). A társadalomra vonatkozó tudások és azok racionális felhasználása bizonytalanná vált, radikálisan visszaesett a politikát alakítók, jogalkotók figyelme a társadalmi viszonyok elemzéseire. Ezzel ugyanakkor a tudomány megszabadult a kormányzati etosz nyomásától, a tanácsadás felelősségétől, élvezheti az irrelevancia felszabadító hatását. A jog pedig megszabadult a túlzott instrumentalizmus terhétől, attól, hogy a társadalmi változások eszközeként kezeljék . Alábbhagyott a jogosultságok jelentőségét érintő forradalmi lendület is, a jogok felszabadító, emancipatórikus hatásait feltételező optimizmus. A jog és társadalom bizonytalanul körvonalazható kutatási területe és a jogszociológia ennek ellenére vagy éppen ezért jelentős fejleményeket tudhat magáénak az intézményesedés területén. Kutatási programok, tudományos társaságok, folyóiratok, könyvsorozatok jelzik a szellemi virágzást és színesedést, a rokon tudományterületekkel kiépített kapcsolatokat. Egyetemi tematikák beépülése a tantervbe és a társadalomtudományi szemlélet megerősödése a jogászképzésben előre jelzik a hatás hosszabb távra nyúló jelenlétét. A hatalmas méretűre duzzadt tudományos tevékenység és publikációs kedv tematikus, stílusbeli és metodológiai szélesedést, diverzifikációt okozott. Eltűntek a nemzetállami és tudományterületi határok, a globalizáció mind a témaválasztásokat, mind a tárgyalásmódot átírta (Sarat 2004). Ennek ellenére léteznek a tudományterület közös elemei, amelyek alapján elkülönülő társadalomtudományi diszciplínaként tárgyalható a jogszociológia. Az eredeti szemléletből megőrződött a kritikai alapállás, a hatalommal és annak egyik megjelenésével, a joggal és a jogban megtestesülő ideológiával való szembenállás, a gyengébb, hatalommal nem rendelkező, az elnyomottal szolidáris kiindulópont. Emellett jellemző a jogi pozitivizmussal szemben a jog kontextuális, a társadalmi, kulturális, gazdasági környezetére tekintettel levő elemzés, a szoros elméleti, fogalmi kapcsolódás a társadalomtudományokhoz és a módszertani változatosság, az igény a metodológiai megalapozásra. A jog és társadalom közötti viszony értelmezésében a jog magábanvalóságát, autonómiáját, zártságát a szociológiai szemlélet egyértelműen tagadta, jelentős eltérések vannak azonban e hagyományon belül abban a kérdésben, hogy a jog és társadalom milyen természetű kapcsolatban áll egymással. Jean Carbonnier a hatvanas évek végén néhány alaphipotézisben foglalta össze a jogszociológia szemléletére jellemző elemeket. Ezek szerint a jog állandó mozgásban, változásban, fejlődésben levő rendszer, léteznek ugyan statikus vagy nehezen változó elemei, de a szociológia a társadalmi változásokhoz alkalmazkodó jog világát feltételezi (Carbonnier 1979). Azóta e szemléleti alapelemekre épülve a jog szociológiája sikeresen fogalmazta meg a maga kánonját, intézményesedési folyamata előrehaladt. Jelenleg éppen a nagy elméleti értelmezésektől és a hivatalos jogi intézményektől való elfordulás zajlik. Olyan értelmezések felé fordul a figyelem, amelyek a jog kontextuális elemzéseit tekinti kiindulópontnak, amelyek szerint a jog helyi, kulturális kontextusban, partikularitásában értelmezhető (Saron-Silbey 2004). Ennek az a felismerés az alapja, hogy a jog sokkal előbb kezdődik, mint formális megjelenése, nem a jog és társadalom (law and society), hanem a társadalom mélyrétegeiben kialakuló normatív elemek (law in society) érdekesek. Ezzel lényegében visszakerül a jog tematizálása a társadalomelmélet körébe. A tudományterület első szakaszát tehát a realizmus kérdésfelvetése motiválta (teljesíti-e a jog az elvárásait a valóságban?), ezt váltotta fel az a kérdés, hogy miként épül fel a jogilag értelmezhető cselekvés.

The essay analyzes the project of maintaining the body of V. I. Lenin in the Mausoleum in Moscow for the past ninety years, focusing on the unique biological science that developed around this project, and the unexpected political role this body has performed.

The purpose of this essay is to outline a few historical, sociological and political-legal coordinates meant to
offer a sufficiently detailed picture of the unique experience of the Indo-Greeks, from their origin to Menander
I. At the borderlines of Hellenism, in an isolated but not disconnected context, the Greeks from Bactria, and
later from India, managed to create an effective political, cultural and social synthesis, able to consolidate one
of the most long-lasting and peculiar societies after the fragmentation of Alexander’s Empire. The Indo-Greek
world survived even up to the fall of the last Greek kingdoms in India in the 1st century C.E., thereby
revealing a remarkable vitality, mostly visible in the cosmopolitism of the Kushan Empire. This phenomenon
further demonstrated how Greek culture played a vital role in that peculiar cross-way between cultures,
languages and peoples, which also includes the Han dynasty in China. Despite having access to only
fragmented and very limited historical sources (but with the help of evidence given by Numismatics and
Archeology), this essay attempts to offer a cross-section of those centuries at the dawn of the history of the Silk
Road – with specific attention to the legal and political areas– at a moment

El estudio muestra el enfrentamiento de una zona indígena con un plan prioritario del Estado mexicano.  Los intentos de modernización con su respectivo afán de lucro se enfrentan a la autodefensa de los pueblos afectados, de donde obtenemos la contradicción principal del problema investigado.  La tendencia de proletarizar a los indios para aprovecharlos e insertarlos al proyecto de industrialización es la causa que los moviliza para defender su modo de vida, pues la preservación de su hábitat, de la unidad económica y del universo social exigen la continuidad de las relaciones comunitarias y el respeto a las mismas por parte de los distingos sectores sociales como del gobierno y sus planes nacionales.

Quels sont les enjeux théoriques d’une réflexion de sociologie et de science
politique sur la référence croissante aux droits et sur leurs usages dans l’action publique ? Approcher l’action publique par les droits permet de dépasser la question de l’encadrement juridique de l’action étatique, selon la définition classique de l’État de droit, pour se demander comment l’État agit pour rendre effectifs les droits reconnus aux individus. En mobilisant les travaux du courant Law and Society et la sociologie de l’État, ce chapitre étudie les conditions de possibilité de cet État des droits à la lumière des transformations contemporaines de l’action publique.

This article analyzes the dramaturgical perspective of Heinrich von Kleist’s novella and General Art director of Thalia Theater Antú Romero Nunes’ play Michael Kohlhaas in the sense of modern law and justice, the conflict between sovereignty and legitimacy, and the relationship between force and right. Both the novella and play of Michael Kohlhaas question the conflict of legality, legitimacy, and the sense of justice. Since the story of Kohlhaas has been a canonical work for both different artistic productions and sociology of law for two centuries, this article offers a conversation among Kleist's novella, Nunes' play, and the sociological analysis of modern law. From an interdisciplinary point of view, the article examines the construction and interpretation of the story of Michael Kohlhaas.

Il nuovo libro di Martha Nussbaum, La tradizione cosmopolita. Un ideale nobile ma imperfetto, edi-to in Italia dalla Bocconi Editore, parte da lontano. Infatti tutto inizia con le letture che la filosofa ha tenuto nel 2000 presso l'Università di Yale, aggiungendo negli anni altri capitoli su Grozio e Smith ed effettuando un lavoro di revisione completa di tutti i capitoli che compongono l'opera. Il volume è dedicato ad una studiosa di grande valore, Miriam Griffin, protagonista di una pionieristica opera di approfondimento relativo alla filosofia romana. La Griffin ha lasciato grande rimpianto nel mondo accademico e nel cuore della Nussbaum. La tradizione cosmopolita esa-mina il nobile ideale cosmopolita, cioè dell'essere cittadino (non sem-plice abitante) del mondo, alla luce dei molti problemi che pone. Lo fa attraverso una serie di saggi, ognuno compiuto in sé, ma logicamente collegato a tutti gli altri, nei quali la Nussbaum non fa una rassegna di tutti o quasi gli esponenti di tale tradizione, molti dei quali poco o nulla conosciuti, ma si focalizza su pochi esempi che seguano una traiettoria ben precisa: Cicerone, Gro-zio e Smith. Per poi, alla luce della sua celeberrima "teoria delle capa-cità" dare alcune risposte che ri-guardano la contemporaneità, alle prese con nuovi problemi. L'ideale cosmopolita prende l'avvio con Diogene il Cinico, il quale chiede ad Alessandro Magno solo di "non fargli ombra", senza bisogno di chiedergli di dargli una vita decorosa, cittadinanza o cure mediche. Cioè, come nella buona tradizione cinico/stoica, il saggio, perfettamente autosufficiente, trova la propria dignità di persona dentro se stesso, senza che essa possa essere scalfita dalle contingenze della vita.

The scope of forensic psychiatry as a field is defined by the application of psychiatry to questions of  justice. Its mission is to study and evaluate the relationships between mental illness and criminalityand violence. In the narrow sense of the term, it refers to the clinical evaluation of the mental stateof defendants or victims in the context of criminal trials or civil lawsuits (e.g. private insurancecompanies). In the wider sense, the term refers to questions of care and evaluation within prisons,special hospitals or ordinary contexts – although the meaning varies according to country.

This paper explains the concept of equality in the Constitution of India that would be useful to further the cause of gender justice, with illustrations of how the same has been expounded in Judgements by the Courts in India. It focuses on the need to highlight the context of time and space and social, economic and political conditions in any strategy for gender equality and justice and argues that the concept of equality in the Constitution is a dynamic concept still waiting to explode and find its presence in many areas of life in India.

This article outlines a new approach to the law of political economy as a form of transformative law, a new approach that combines a focus on the function of law with a concept of law encapsulating the triangular dialectics between the form-giving prestation of law, the material substance the law is oriented against, and the transcendence of legal forms—that is, the rendering of compatibility between forms. Transformative law thereby serves as an alternative to both law and economics and recently emerging culturalist and neo-Marxist approaches. The timing of this publication is not coincidental. The era of neoliberalism—that is, of structural liberalism, which started in the 1970s and experienced its breakthrough in the 1980s and 1990s after the collapse of structural Marxism—is ending. This makes the question of what will succeed the neoliberal episteme pertinent.

This article draws on the postcolonial legal theories and the concept of imaginative geographies, aiming to shed light on the process of producing and realizing Israeli representations of the Negev Desert through the implementation of legal regulations. The focus is on chosen imaginations of the Negev Desert, researched here as a case study of material realisation of imaginative geographies. In the analysis, symbolic narratives, visions of spaces, and new categories, intertwined in legal acts as their foundations, justifications and goals are underlined. The conclusions of presented study show that imaginations and visions can be in fact reproduced in space through legal regulations, and in the analysed case law has three aspects: it is an expression of imagined geographies; it translates those visions into technical terms; and lastly, the implementation of its provisions becomes the main instrument of producing those representations in reality.

In this study, based on the recent constitutional debates, an evaluation is made on the basis of the legal mentality. In this context, first of all, the concept of law was discussed within its scientific meaning. Later, the culture of law and the concept of law in terms of culture were discussed. In the context of this discussion, analysis and basic mentality created by the circumstances of law in Turkey, it offered suggestions about what can be done to ensure the legitimacy of law in Turkey. These debates are important in terms of current constitutional debates. Therefore, when drafting new legal rules, if it is based on the universal law or according to cultural background which is essential in Turkey, this question is a crucial subject to be discussed.

This paper focuses on some of the current socio-legal developments in trade and investment field and the related trend towards greater standardisation of national societal regulations based on international voluntary standards. The standards addressed here are international process , or management-based standards. Given the space limits, it will mainly concentrate on the International Organisation for Standardisation (ISO) standards. Companies generally voluntarily adopt those in order to carry a "social" license to operate, as today it's the way to underline their good governance credentials. In transboundary trade transactions, obtaining such social licenses can be crucial for importing and exporting firms alike, as well as for countries within which those firms operate. International technical standards of ISO are usually developed by professional associations, i.e. accredited standard-setting bodies that provide scientific and quality assurances, acting as professional facilitators of a consensual process. However, since the late 20th century, the ISO and similar global standard-setting entities also - and indeed increasingly - provide process assurances. Both growing demand for and supply of those new mechanisms appear to reflect ever-greater "race to efficiency" , hence an increasing need for a readily available and easily used data, concepts, and knowledge to inform and legitimise transnational decision-making bypassing any national or international public structure. For example, regulating various process assurances was traditionally rather a public regulation business: different national and European Union regulations may well illustrate that. With the ever-intensifying economic globalisation, however, our society has seen an unprecedented rise of all kinds of new non-state initiatives seeming to fill the gaps left by states in the new global organisation of society. The puzzle of this story is that, unlike simple indicators, the standards addressed here are likely to act as global normative benchmarks, a universal social reference, most of the time containing obligations and backed by sanctions, though non-legal, or else "informal".

The article presents the social conditions of the autonomy of law. The autonomy is treated here as a structural feature that consists of the possibility of legal subjects to making independent decisions (that is relatively free from outside forces − political, economic, religious, etc.). The authors explain this phenomenon using the analytical tools of Pierre Bourdieu’s sociological theory of law. Thanks to this, the law is seen as a specific social field of forces, placed in the complex network of various other fields (economic, political) which influence each other. The case study of abortion is used as an illustration of the hidden influences of religious and political forces on the legal decisions in Poland.

Dando continuidade a este ano comemorativo dos 10 anos da Direito e Práxis, também apresentamos um dossiê organizado por Silvia Rodriguéz Maese (Centro de Estudos Sociais, Universidade de Coimbra) e Cesar Augusto Baldi (Universidade de Brasília), com o tema: "Repensar a legislação e as políticas públicas desde o antirracismo em contextos europeus e latino-americanos". La mobilité dans l’Union européenne de ressortissants de pays tiers – et les réponses à celle-ci, étudiée à l’exemple de la France et du Portugal. Ce projet essaie de croiser, à travers l’observation de l’évolution du droit des migrants deux hypothèses théoriques de Z. Bauman et N. Luhmann. Le premier se fonde sur l’impossibilité pour les sociétés modernes, à trouver dans la modernité un équilibre satisfaisant entre liberté et sécurité et par voie de conséquence l’incapacité de garantir les conditions d’une authentique émancipation. Le second, au contraire, l’acceptation de la contingence est une nouvelle forme de rationalité plus large et donc une condition d’émancipation dans les sociétés modernes.

This chapter outlines the potential of a sociology of international criminal justice. Following a seven-step approach, the next section identifies trends in international criminal justice that makes a greater engagement with sociology critical. It then provides an inventory of the conceptual make-up of the sociology of law, before, fourthly, it briefly addresses its methodologies and research strategies. Fifthly, the emergent field of sociology of international criminal justice is outlined. After that, the chapter provides an overview of the themes to which a sociology of international criminal justice might contribute, by introducing the contributions of this volume in their various approaches to power in international criminal justice. Finally, a brief conclusion is offered.

This chapter provides some results of my PhD research, which was conducted at the Faculty of Law of University of São Paulo (Brazil), with periods of research at the Faculty of Sociology of Bielefeld University (Germany). The institutional context in which it was developed already indicates the interdisciplinary nature of this work, which promotes dialogues especially between law and sociology. In addition, the study mobilizes authors and reflections related to areas such as political science, economics, geography, urbanism, and linguistics (Fonseca 2019). Among the main themes accessed by the thesis, one is the organized social movements' actions in the context of resumption of state activism in Brazil, especially after the international financial crisis of 2008. In the area of housing policy, this historic moment was marked by the creation and development of the Program "My House, My Life" (Programa Minha Casa Minha Vida or PMCMV), which had the active participation of social actors from the Federal Government, the Federal Savings Bank (Caixa Econômica Federal or CEF), the largest construction companies and real estate developers in the country, and even the social movements for housing.

У статті з методологічних позицій соціології П’єра Бурдьє досліджено специфіку взаємозв’язків права і політики у конституційному судочинстві України. Поле конституційної юстиції представлене як специфічний юридичний ринок, який функціонує за логікою попиту і виробництва конституційної легітимності актів публічної влади. Продемонстровано парадоксальність становища Конституційного Суду України, який виступає органом, чия діяльність має ґрунтуватися на засаді
незалежності, і водночас є заручником і учасником боротьби еліт за перерозподіл влади і капіталів. Обґрунтовано, що політизація конституційної юстиції виявляється в мотивах ухвалення рішень Конституційним Судом, які часто стають результатом використання ресурсів зовнішнього впливу на конституційне правосуддя. Шляхом
аналізу біографічних даних суддів Конституційного Суду виявлено соціальні чинники відтворення відносин залежності і моральнісного конформізму в їхній діяльності. За матеріалами практики Конституційного Суду показано, що символічна влада органу конституційної юрисдикції над смислом Конституції є не тільки необмеженою, а й
додатково розширюваною актами цього органу. Позначено причини триваючої кризи соціальної легітимності Конституційного Суду в Україні. Обґрунтовано необхідність удосконалення інституційних механізмів відбору майбутніх охоронців Конституції.
The article provides the research of interrelation between the law and the policy in the constitutional justice of Ukraine from the methodological standpoint of Bourdieu’s sociology. The field of constitutional justice is presented as a particular legal market functioning according to the logic of demand and production of constitutional legitimacy of the acts of public authority. The author demonstrates the paradox of the Constitutional Court of Ukraine’s status, which, on the one hand, acts as an independent body and, on the other
hand, as a hostage involved in the struggle for political power and redistribution of economic recourses within the ruling elite. The author demonstrates that politization of constitutional judicature shows itself in motives of approving the Court’s judgements. These motives are
often determined under the pressure of external influences on the Constitutional Court. Based on the analysis of constitutional judges’ biographies the author determines social reasons of judges’ moral conformism and the pattern of dependency relations between the Court and political and economic actors systematically reproduced in the Court’s jurisprudence. The analysis of the Сonstitutional Court’s jurisprudence leads the author to the conclusion that the symbolic authority enjoyed by the constitutional justice body over the sense of Constitution is
not only unlimited, but also being permanently extended in decisions of the Constitutional Court. The article shapes and elaborates on reasons for the long-lasting crisis of social legitimacy of the Constitutional Court in Ukraine. Given this crisis the author argues for the necessity of improving the institutional mechanism for selection of constitutional justices.

Futuros normativos Ley, imaginación política y transformación social.

La serie de seminarios busca explorar en una perspectiva interdisciplinaria las formas en que las sociedades contemporáneas discuten, describen y producen "futuros normativos". Si bien la noción de futuros normativos puede evocar imágenes de enfoques legalistas y formalistas del derecho, la moral y la normatividad, en esta serie invitamos a investigadoras e investigadores a reflexionar acerca del vínculo entre ley e imaginación política. El contexto actual de profundas transformaciones, crisis y conflictos es particularmente propicio para ello, por cuanto nos confronta a una serie de dilemas políticos y normativos acerca de la fragilidad y el futuro de nuestras formas de vida.

This paper examines the importance of information and data in the management of education programming in crisis contexts. Education is a right, and it is necessary to focus on the accuracy of humanitarian responses. It is also important to accumulate accurate information and to develop information banks where we can collect the necessary information about the education sector before a crisis takes place

Ce dossier de LeGes édite neuf communications présentées lors d'une journée d'études consacrée à la révision totale de la Constitution fédérale de 1874. Tenue le 25 janvier 2013 à l'Université de Neuchâtel, cette journée a constitué une opportunité tout à fait exceptionnelle d'engager un dialogue avec des acteurs de premier plan du processus de révision constitutionnelle. Elle s'inscrivait dans un projet plus large, financé par le Fonds national suisse de la recherche scientifique (FNS), intitulé « Droit et politique dans la révision totale de la Constitution fédérale de la Suisse», dont l'objectif très général était de penser le rapport entre droit et politique tel qu'il s'est réalisé dans le cadre de la révision totale. L'ensemble des contributions est précédé de deux textes rédigés par des membres de l'équipe ayant conduit la recherche FNS et organisé la journée d'études. Le premier, « Droit et politique dans la révision totale de la Constitution fédérale » revient sur les ambitions du projet FNS et présente les attendus spécifiques de la journée d'études. Le second, « L'écriture constitutionnelle : dispositions juridiques et réalisation politique », vise à replacer les neuf contributions dans le cadre plus large des séquences de la révision totale de la Constitution fédérale. Enfin, les neuf contributions sont suivies d'une conclusion générale, « La révision constitutionnelle entre contraintes politiques et expertises juridiques », qui se propose d'intégrer les réflexions des acteurs de la révision constitutionnelle dans une analyse des relations entre les dimensions juridiques et politiques du processus de révision totale.

15-no-30-junio-2021/economia-globalizada Resumo: O presente trabalho tem como escopo analisar as transformações sofridas pelo Estado ao longo do Século XX, com recorte histórico com marco inicial no ano de 1914, com o objetivo de expor o Estado como uma estrutura universal que haverá de permanecer em transformação e destacar suas etapas de declínio e desenvolvimento, procurando englobar os mais variados fatores que compuseram a atual configuração do que se entende por Estado no mundo globalizado. A metodologia utilizada é a analítico-dedutiva com técnica de pesquisa teórico-bibliográfica, descrevendo aportes teóricos sobre a primeira guerra mundial e seus reflexos nos estados-nação, sobre a revolução russa e o totalitarismo, sobre a segunda guerra mundial e a guerra fria, sobre a chamada era de ouro e suas consequentes mudanças sociais e culturais, destacando a configuração dos estados-nação no final do século XX com a crise do socialismo real e democratização do estado europeu os cenários no fim do século, apontando, à guisa de conclusão, a orientação pela reorganização do Estado frente ao policentrismo na economia globalizada.

This book presents a map of perspectives that reflect the necessary renovation of systems theory regarding the operations of the legal system and its environment at a new decade, not only facing modern society’s old problems, but also its deep transformations, such as the intensification of digital communication in this world society (we finalize this work during the Coronavirus pandemic, maybe an unprecedented event in driving the digitization of communications at a global scale and in the various functional, organizational and interactive systems).

Este artigo analisa as relações entre padrões internacionais de proteção aos direitos humanos e os direitos territoriais de povos indígenas, quilombolas e outras comunidades tradicionais no Brasil. Realizou-se uma pesquisa documental e bibliográfica, e analisou-se o material com base na abordagem construtivista, a qual, nos estudos sobre direitos humanos, evidencia os papéis desempenhados por múltiplos atores nacionais e transnacionais nos processos de reconhecimento e efetivação de direitos. Argumenta-se que as reconfigurações internas observadas nos direitos territoriais foram influenciadas pela dinâmica de produção e reavaliação de padrões normativos internacionais, por meio da circulação de ideias entre organismos internacionais, agentes de Estado, ativistas, intelectuais e movimentos dedicados às causas indígena, étnico-racial e socioambiental. Como efeito da socialização de normas e perspectivas teóricas, ocorre o rompimento formal do sistema jurídico nacional com o paradigma integracionista e a criação e ressemantização de categorias teóricas e político-normativas, ampliando o rol de grupos titulares de direitos territoriais específicos.

Cette ultime contribution au dossier propose une analyse transversale des contributions et témoignages des acteurs de la révision totale ayant participé à la journée d'études. Elle examine, dans un premier temps, les modalités pratiques par lesquelles le dossier de la révision a été pris en charge et met en évidence le double pilotage, juridique et politique, dont le processus a été l'objet depuis sa relance dans le courant de l'année 1993. L'analyse revient ensuite plus spécifiquement sur les deux notions centrales de la révision, la Nachführung et le Baukastensystem, sur les perceptions ambivalentes qu'elles ont suscitées (et suscitent encore aujourd'hui), ainsi que sur les fonctions qui leur ont été assignées dans la conduite stratégique de la révision. En conclusion, nous reprenons les attendus généraux de ce dossier, pour présenter de manière synthétique la façon dont le rapport entre "droit" et "politique" s'est empiriquement manifesté dans le cadre du processus. La contribution se conclut sous la forme d’une interrogation à propos de l’impact de la révision totale de la
Constitution fédérale.
