Madame Soazick Kerneis a publié dans la livraison 2007 de la Revue internationale des droits de l'antiquité un article intitulé « La vérité du droit. Justice oraculaire et gouvernement impérial dans la Gaule romaine » 1 . Cet article appelle une brève mais claire réponse critique : aucune de ses conclusions ne nous semble devoir être retenue au regard de l'état actuel des connaissances scientifiques sur la Gaule romaine et sur les pratiques administratives, militaires et juridiques de l'empire romain. L'article invente en effet une procédure oraculaire en Gaule romaine sur la base d'une lecture toujours orientée, souvent forcée et parfois gravement erronée des sources disponibles. Tenter de retrouver des procédures coutumières dans l'empire romain est une démarche légitime, elle nécessite cependant, pour fournir des résultats convaincants, une prudence et une acribie scientifique 2 que nous ne retrouvons pas dans son article. Il serait possible de reprendre point par point, voire ligne à ligne, le texte en question pour en relever et corriger les nombreuses erreurs de méthode et les erreurs factuelles. Nous nous contenterons de pointer certains des problèmes les plus importants qui tous touchent au coeur de l'argumentation. The Digest of Justinian preserve an enigmatic decision by Emperor Hadrian pertaining to a specific incident of violation of military discipline. The emperor spoke in the case of soldiers who made a failed suicide attempt. Those who had a valid reason that pushed them to take this desperate step, he ordered to be dismissed from service in disgrace. The others faced death. A surprising solution was provided for would-be suicides who decided to take their own lives per vinum aut lasciviam. The ruler ordered these to be spared. The only consequence was their transfer to inferior service. Juxtaposing Hadrian's resolution with contemporary psychological and psychiatric knowledge allows us to hypothesize that the emperor's rescript refers to people who broke the rules of military discipline due to some form of addiction.

A brief reflection is offered on the development of the concept of cause in the medieval period, emphasizing the rise of cause, while also underlining that it is still possible to find traces of abstraction in the medieval period. Particular attention is given to the law of the Kingdom of Aragon, which demonstrates the existence of abstract promises in this historical period.

Description The archive of Petaus is dispersed between the library of the University of Michigan, which purchased 27 papyri through professor C. Schmidt in 1937 (inv. numbers 6869-6895), and the Institute of Papyrology at Cologne (inv. numbers 300-409). In a few cases, several pieces of the same document are kept in both collections. Between AD 184 and 187, Petaus, son of Petaus, was village scribe (komogrammateus) of Ptolemais Hormou and its surrounding villages. Little is known of his personal life. The only facts the papyri reveal is that he had a father also named Petaus and a brother Theon, and that the family came from Karanis 1 .

Abstract: Antizipierte Erbschaftsteilung im klassischen römischen Recht

(D. 10.2.20.3). Entgegen der weit verbreiteten Meinung, Erbverträge sei-
en im römischen Recht unzulässig gewesen, bietet uns das Corpus iuris
eine Reihe von Texten, die diese Ansicht in Frage stellen. In einem wenig
bekannten Fragment der Digesten berichtet Ulpian von Papinians Rechts-
gutachten für einen Vater, der seinen gesamten Besitz zu Lebzeiten unter
seinen Kindern aufgeteilt hatte. Nicht nur – so Papinian – sei sein Vorge-
hen rechtlich durchsetzbar gewesen, sondern es könne auch nicht als bloße Schenkung angesehen werden, da die Kinder sowohl die Anteile am Nachlass erhielten als auch zu gleichen Teilen mit den Schulden des Vaters
belastet wurden, wodurch die reguläre Erbfolge im Todesfall nachgeah-
mt wurde. Insofern erkennen Papinian und Ulpian einen zu Lebzeiten des
Vaters geschlossenen und sofort vollstreckbaren erbrechtlichen Vertrag an
(Vereinbarung mit über den Tod hinausgehender Wirkung).

Abstract: Anticipating division of inheritance in the Classical Roman law
(D. 10.2.20.3). Contrary to the widespread opinion on the inadmissibility
of contracts on succession upon Roman law, the Corpus iuris provides us
a series of texts challenging this view. In a little known fragment of the Di-
gest Ulpian reports on Papinian’s legal advice for a father who has divided
his entire property among his children during lifetime. Not only – claims
Papinian – his move was legally enforceable, but is cannot be seen as a
simple donation, because the children were granted both the portions of the estate and equally were burdened by father’s debts, by thus imitating the regular succession mortis causa. Insofar Papinian and Ulpian recognize a contract on succession concluded during lifetime of the father and immediately enforceable (agreement with transmortal effect).

This article investigates how ecclesiastical canons from the third to seventh centuries articulate the concept of church membership. Drawing on 11 representative canons from major church councils and other patristic sources, the study argues that the canonists consistently equated membership with participation in sacramental and liturgical life, rather than with nominal affiliation or sociological status. Extended absence from the eucharist was often interpreted as voluntary separation from the church, meriting disciplinary measures aimed at restoration. The analysis also explores how the canons distinguish between the catholic church and schismatic or heretical assemblies, and how they regulate the reception of individuals from such groups-sometimes permitting integration without rebaptism under the principle of oikonomia. The article concludes by proposing that these late antique views offer valuable insights for contemporary ecclesiastical discourse. Specifically, they challenge modern assumptions about passive membership, highlighting the need for a lived, sacramentally grounded ecclesial identity, particularly in the context of the Orthodox Church.

Introduction. The article is dedicated to the analysis of the evolution of international law and
its science through the prism of historiographical research. It aims to identify the main stages of the formation and de
velopment of international legal concepts that reflect changes in international relations from ancient times to the present
day. The article discusses key scientific schools that have shaped international law as a science, as well as important
historical factors that have influenced its development.
Summary of the main research findings. The main part of the research highlights the key stages of the formation
of the historiography of international law, starting from its origins in antiquity, through the Middle Ages and the early
modern period, when, based on the works of predecessors, researchers began to systematize the main principles of in
ternational relations. The author emphasizes the importance of the works of prominent legal scholars such as Isidore of
Seville, Raymond of Penafort, Guillaume de René, Sinibald de Fieschi, Thomas Aquinas, Christine de Pizan, Hugo
Grotius, Cornelius van Bynkershoek, Samuel von Pufendorf, and others. The article highlights the deep interest in in
ternational law's history demonstrated by researchers working at universities located on the territories of Ukraine (both
within the Russian Empire and the Austro-Hungarian Empire) in the 19th and early 20th centuries. The main findings of
the research also focus on the historiography of international law in the context of changes that took place in the second
half of the 20th century and the beginning of the 21st century, with an emphasis on the features of contemporary foreign
and domestic historiography. Special attention is paid to modern approaches that unite different legal systems in a glob
al context and the need to adapt international law to new challenges.
Conclusion. The conclusions emphasize the importance of understanding the evolution of international law
through a historiographical lens for a deeper understanding of contemporary issues in international relations and law.
The analysis conducted reveals how historical events, cultural and political changes influenced the formation of modern
international legal doctrine. It is noted that the development of the historiography of international law is an ongoing
process, continuously adapting to changing conditions. The growth in the number of scholarly works on the history of
international law reflects the overall trend towards specialization and universalization. Scholars focus not only on stud
ies that generally characterize the stages of development of international law, but also on more specific aspects, such as
the analysis of individual international treaties, the history of particular branches or institutions of international law, etc.

The great Dutch jurist Hugo Grotius coined the term "dominium eminens" in his De iure belli ac pacis. 1 In spite of some contemporary criticism of the terminology, Grotius' concept has entered most legal systems. The dictionary of legal terms by John Bouvier, as revised by John Rawle, defined eminent domain as "the superior right of property subsisting in sovereignty" and the "power to take private property for public use." 2 In modern law "public use" has been a tricky concept. In an egregiously decided Supreme Court case, Kelo v. New London in 2005 granted the state the right to confiscate land for the use of a private developer. Forty-five states then passed eminent domain laws to prevent public use ever again being interpreted that way. 3 Grotius thought that eminent domain meant that all the public and private property rights ultimately reside in the country, state, or city and not in individuals. Consequently, today "private property" is a contingent right at best; contingent upon the pleasure of the state. In the ancient world, philosophers thought property rights emerged as human beings began to live in villages, towns, and cities. They generally agreed that in society's most primitive state, people possessed all property in common. 4 The Romans were the first to create a jurisprudence to

Incorporating theories from mobility studies and ancient institutions that facilitated travel, Borges traces how travel functioned as a formative practice among early Christians’ group identities, and signified a new cosmic reality regarding their unity in Christ. Borges investigates six specific travel events in Pauline and Ignatian churches, noting how mobility became a distinctive and revealing aspect of early Christianity.

The paper compares the medieval Roman-canonical notion of litis contestatio with its French heirs in the 1667 Ordonnance civile and the 1806 Code de procédure civile. In the glossators’ procedure, litis contestatio—the bilateral declaration that irrevocably joins the issue—activates iurisdictio and multiple preclusive effects: interruption of limitation period, definition of the claim’s object, bar to new counter‑claims, accrual of interest, and the seed of res judicata. The 1667 ordinance, operating within a pluralistic landscape of customs and courts, preserves this reciprocal logic: contestation en cause arises only when the defendant’s first substantive act confronts the plaintiff’s demand; mere default is insufficient. By contrast, the Napoleonic code abolishes the dual‑phase model. Unified statutory law lets the action commence with the plaintiff’s citation, and proceedings may advance even in absentia; the petition alone delimits the res judicanda. The eclipse of litis contestatio thus signals a constitutional transition from dialogic, party‑shaped adjudication to centralized, positivist sovereignty.

Tom Holland’s Rubicon is a gripping narrative that recounts the Decline of the Roman Republic from the days of Romulus' Mythical Foundation of Rome (753 BC) until Caesar Augustus’ Restoration (27 BC). In the opening pages, Brutus overthrows Lucius Tarquinius (509 BC), the last of the Etruscan Kings, establishing a new form of government with the Senate and the People of Rome (SPQR). The Republic’s institutions promised an even footing between ordinary plebeians and privileged patricians. Despite their socio-economic disparities, they were bound together by the noble ideals of a lawful, dutiful, and loyal Roman Citizen.

The publication in 2024 of the first Polish translation of the dialogue of the Italian physician and humanist Battista Fiera entitled De iustitia pingenda, edited by Professor Jerzy Zajadło, is one of the most important scientific events related to Polish research on the aesthetics of law. The fictional conversation that the Renaissance artist Andrea Mantegna has with the Greek satyre idol Momus provides an opportunity to develop some themes related to the ways in which Justice has been depicted over the centuries. However, it is surprising that the dialogue between Momus and Mantegna turns out not to be a conversation only about art. The tenor of the debate and its dynamics evolve. From issues related to the legal iconography, the interlocutors move on to dissect fundamental matters. These include life and death, the meaning and meaninglessness of human existence, the causality and lack of causality of man confronted with the eternal laws of nature, etc.

L'ultima aristocrazia pagana di Roma e le ragioni della politica* Da un punto di vista strettamente storiografico sembra guadagnare consistenza la prospettiva che, al di là delle formule inevitabilmente semplificatrici di 'rivoluzione costantiniana' e simili, valorizza l'idea di una conversione tutto sommato pacifica del mondo antico. Il 'conflitto' tra paganesimo e cristianesimo, per riprendere il titolo del convegno organizzato da Arnaldo Momigliano all'Istituto Warburg di Londra ormai mezzo secolo fa e che dà il titolo a un noto volume (la traduzione italiana è stata pubblicata da Einaudi nel 1968) appare sempre più una definizione di comodo che implica dei presupposti ormai superati soprattutto quando ci si confronta con le tradizioni culturali proprie dei ceti elevati 1 . Vorrei solo sottolineare la prudente e autocritica considerazione, segno di una sensibilità che si direbbe infallibile nel cogliere il mutare delle temperie storiografiche, premessa da Arnaldo Momigliano alla traduzione italiana del libro che ho appena ricordato, p. XI: «È probabile che nessuno di noi collaboratori scriverebbe esattamente ora come scrivemmo nel 1959. Profondamente riveduto dovrebbe essere soprattutto il mio saggio iniziale». La revisione critica della nozione di 'conflitto' sembra particolarmente opportuna soprattutto con riferimento alle aristocrazie (uso consapevolmente il plurale) per le quali, malgrado forme isolate di resistenza, l'accettazione della nuova religione appare essere stata tutto sommato relativamente poco traumatica contrariamente all'impressione che può dare il saggio, giustamente famoso, di Herbert Bloch, La rinascita pagana in Occidente alla fine del secolo IV, pubblicato nello stesso volume 2 . È quanto emerge dagli studi recenti e persuasivi di R. Smith sulla realtà monumentale della città tardoantica rispetto alla quale l'esito del monoteismo cristiano appare tutto sommato limitato, esistendo comunque una componente importante nella vita pubblica che non era né pagana né cristiana e che sopravvive ancora in pieno V secolo 3 . A tradução, feita a partir do grego original, esteve a cargo de dois classicistas, Jorge Deserto, da FLUP e Susana da Hora Marques Pereira, da FLUC, e tem por objectivo principal oferecer ao público português e lusófono, académico e leigo, uma versão actualizada e acessível do texto estraboniano, como expressa a Nota Prévia (p.11). Dá, assim, continuidade ao propósito que motivou Estrabão a empreender a composição da Geografia que, como o próprio referiu, servia as necessidades da administração do estado (1.1.16), do homem de estado e do público em geral (1.1.22). O texto é antecedido por uma Introdução Geral (pp. 13-31), escrita a três mãos, com os Tradutores a deixarem o A. apresentar, através de trechos dos dois primeiros livros introdutórios, a Geografia, para comentarem e complementarem as informações por ele dadas. A Introdução debruça-se numa primeira parte (pp.13-31) sobre a vida e obra do A. (pp.13-23) e na segunda aborda a estrutura e as fontes do Livro III (pp.23-31). Segue-se a tradução (pp.35-94), que se encontra dividida em cinco capítulos. O primeiro capítulo (pp.35-41) apresenta a perspectiva geral da Península e a Costa Meridional da Ibéria -do Promontório Sagrado às Colunas de Hércules; segue-se a Turdetânia (segundo capítulo, pp.43-58), a Costa Ocidental e Setentrional da Ibéria, a Lusitânia e os montanheses do Norte peninsular (capítulo terceiro, pp. 59-66). Os dois capítulos finais examinam os territórios entre as Colunas e os Pirenéus (capítulo quarto, pp.67-82) e as Ilhas (capítulo quinto, pp.83-94). Um mapa da Península (pp.95), com as regiões descritas por Estrabão, dois índices de Termos Geográficos (pp.97-119) que actualizam a toponímia antiga e de Fontes Antigas, citadas apenas no Livro III (p.121), e a Bibliografia (pp. 123-127), que apresenta um conjunto de estudos sobre a obra estraboniana e sobre a Península Ibéria, encerram o volume. INTRODUCTION On 15 May 1990, at Christie's in New York, Japanese paper tycoon Ryoei Saito, purchased Van Gogh's Portrait of Dr Gachet for US$82.5 million, and two days later made another bid for and won Renoir's Au Moulin de la Galette, this time at Sotheby's for US$78.1 million. 2 At the time, Saito made headline news as not only was the combined sum of US$160 million an astonishing amount of money even for paintings as celebrated as these two, the sale price for Dr Gachet had set the world record for the highest sum ever paid to date for a work of art. Saito made headlines again a year later when he announced that he wished to have the two paintings cremated with him on his death, so as to save on inheritance tax, sending shockwaves throughout the art world. 3 Such was the public's horrified reaction that Saito backtracked and claimed that he had only been joking. 4 Since Saito's death in 1996 however, while the Renoir has been accounted for, 5 the whereabouts of Dr Gachet remains a mystery. 6 The principal issue which arises in the above scenario and instantly springs to mind is the question of whether the owner of a work of art, particularly one which is so celebrated and revered, should have the right to destroy it. The right to destroy is an ancient right, encapsulated in Roman law as ius abutendi, a right of full dominion over property, including the right to abuse or destroy the

I viaggi di un equestre, Mârkow Serouíliow Po(plíou) u¥òw, PalateínŸ, E•neikow, dall'Asia alla Sardinia di Raimondo Zucca Un'iscrizione onoraria di Nysa, città della Caria, nella provincia Asia, costituisce un documento indiretto dei viaggi via mare di un equestre, che nel corso della sua carriera lasciò Nysa per discendere al porto di Ephesos, e da qui compì la traversata che lo dovette portare nel Latium, a Lavinium, dove esercitò il prestigioso sacerdozio laurentino, quindi in Sardinia (o meno probabilmente in Mauritania Caesariensis) per assumere il rango di ¡parxow speíraw Sardôn, ossia praefectus di una cohors Sardorum, e infine in una regione non indicata, forse a Roma oppure in provincia, non esclusa l'Asia, per svolgere il ruolo di scriba quaestorius librarius. L'autore può ricostruire in dettaglio la posizione della Corsica nel corso della guerra civile successiva alla morte di Nerone; e fornisce la lista degli esiliati, che comprende in età claudia oltre a Seneca anche Cesonio Massimo eforse Publio Anteio Rufo, noto quest'ultimo da una fistula aquaria di Aleria; più tardi, fu relegato e quindi ucciso per volontà di Domiziano Mettio Pompusiano, accusato di progettare la morte del principe. Insomma, la Corsica, assieme alla Sardegna, fu considerata terra d'esilio nel corso dell'età imperiale: essa mantenne una caratterizzazione che appare lIna costante, fin dalle origini della presenza romana nell'isola, a partire dal mitico episodio arcaico di Galerio Torquato. La terza parte dell'opera è dedicata all'organizzazione provinciale romana, inizialmente unitaria, assieme alla Sardegna, più tardi con amministrazione imperiale del tutto autonoma, sottO' la responsabilità di un governatore equestre. L'ultima sezione dell'opera è dedicata ai centri abitati partendo dall'elenco di Tolomeo, all'urbanistica, alle popolazioni non urbanizzate, alla viabilità, all'economia, ai traffici commerciali, alle forze annate (truppe ausiliare e flotta militare), alla vita religiosa, allo sviluppo del culto imperiale e poi del cristianesimo, fortemente legato a modelli africani, come è dimostrato dali 'elenco stesso dei martiri locali: molte sono le novità, gli approfondimenti, le nuove interpretazioni, anche se i dati sono spesso insufficienti per consentire di ricostruire un quadro di sintesi veramente soddisfacente. Non sarebbe stato possibile pubblicare questo volume senza le ricerche e le indagini archeologiche promosse nei decenni precedenti da alcuni studiosi corsi, primo fra tutti Wl grande maestro, Jean Jehasse, la cui opera desta ammirazione e rispetto. Penso all'attività di valorizzazione e di tutela svolta dai funzionari della Direzione regionale degli affari culturali ed in particolare dal Conservateur régional de l'Archéologie de Corse Joseph Cesari e dai responsabili dei diversi musei archeologici, tra cui Jean-Claude Ottaviani ad Aleria. Penso anche al debito che la comunità scientifica internazionale ha Ilei confronti di Geneviéve Moracchini-Mazel e di Philippe Pergola; ma anche nei confronti di alculli studiosi francesi ed italiani, come René Rebuffat e Cimia Vismara. A tutti loro l'autore si richiama con rispetto, anche quando dissente e si discosta su qualche aspetto particolare. Non mi resta che esprimere l'augurio che l'opera possa trovare larga diffusione non solo tra gli studiosi a livello internazionale, ma tra gli studenti, tra gli appassionati, tra i cittadini, soprattutto in Corsica, dove l'attenzione per la storia, le tradizioni, la cultura, i dati topografici locali è sicuramente acutissima.

InTRodUzIone «Si narra che la famosa Medea della tragedia seminasse un giorno i denti di un serpente ucciso, dai quali, come messe dal seme, emersero dalla terra guerrieri armati che in breve, combattendo tra loro, si annientarono. certo è una finzione escogitata dai poeti; ma la nostra Roma, ucciso cesare, quanti eserciti armati partorì dalle sue ceneri!» 1 Il suggestivo accostamento d'immagini attraverso cui orosio definisce gli ultimi anni della Repubblica romana illustra, con pregnante efficacia, il ruolo di primo piano assunto dagli eserciti dopo la scomparsa del dittatore, nel 44 a.c., e delinea il quadro in cui si inserisce l'oggetto specifico di questa indagine, ovvero la comunicazione tra i duces e i milites protagonisti della vicenda politica conseguente al cesaricidio. La comunicazione, sia essa affidata al canale verbale, gestuale, scritto o iconico, denota l'intenzione del soggetto mittente, include il punto di vista del destinatario, genera un messaggio che si giova di significati e pratiche condivise dagli interlocutori, nel segno della reciprocità. assumendo tali requisiti ed instaurando la dinamica di un dialogo verticale, la comunicazione politica di ogni epoca e contesto coincide con il multiforme riprodursi di un medesimo modello di interazione, che consegna il ruolo di protagonisti ai vertici di potere e alle basi delle quali essi si rendono partners comunicativi. analogamente, sia le strategie persuasive poste in essere dai leaders sia i linguaggi e i codici adottati dalle loro basi di consenso sono soggetti alla teorizzazione e all'analisi tipologica, così come i tanti e diversificati contenuti del dialogo politico si possono ricondurre, complessivamente, a più ampie categorie concettuali, quali la consensualità, il conflitto, la negoziazione. XV introduzione che indagano in chiave storico-antiquaria le modalità, le sedi e le valenze della comunicazione in Roma, intesa come momento di interazione tra i magistrati e il popolo secondo prassi codificate, hanno recentemente approfondito il significato e la rilevanza delle contiones, circostanze comunicative nelle quali l'oratoria e il potere politico sembrano stringersi in un legame significativo ed efficace 9 . entrambi i percorsi di studio, tuttavia, non considerano specificamente le truppe né come destinatari della comunicazione né come eventuali mittenti di messaggi politici. dunque, poiché si ritiene, per le ragioni poc'anzi esposte, che i milites costituiscano la componente privilegiata delle clientele che i vertici si propongono di acquisire in tale segmento cronologico, è parso opportuno, in primis, far emergere dal tessuto evenemenziale del periodo la comunicazione pubblica e la propaganda politica dei leaders esplicitamente diretta alle basi militari, nonché, in secundis, restituire al processo comunicativo la reciprocità che gli compete, enucleando come le basi militari, recepiti i messaggi dall'alto, si rendano a loro volta interlocutori e, dunque, coprotagonisti della comunicazione. L'indagine si avvale delle opere degli autori antichi che riferiscono gli eventi del periodo considerato; al materiale storiografico preso in esame vanno attribuiti dei limiti intrinseci, che sistematicamente inducono a problematizzare la restituzione dei fatti. In primo luogo, le fonti sono di gran lunga posteriori agli eventi. Infatti, ad eccezione di nicolao di damasco -biografo del princeps -che ci informa sul solo anno 44 a.c. 10 , 'mappa concettuale' delle intenzioni comunicative del personaggio cui il discorso è attribuito, poiché l'autore ha lo scopo di esprimersi «nell'adesione alla sostanza delle cose dette» 19 . È in tal senso che i discorsi diretti riportati da appiano e cassio dione sono analizzati, ovvero ritenendo che il criterio tucidideo, secondo il quale la ricerca dell'utile e del vero ammette l'uso dell'inventio retorica al fine di integrare le lacune della ricostruzione storica, spieghi la natura delle orationes rectae e le renda fruibili, pur riconoscendovi la soggettività degli storici antichi 20 , 17 Per il dibattito critico moderno sulla storiografia antica e sul rapporto tra il vero storico e la retorica, si vedano in particolare Momigliano 1984 (che si contrappone ai precedenti lavori di White 1973, al quale si può far risalire la nascita delle teorie 'narrativiste' , e White 1978) e la più recente discussione dell'argomento in Pani 2001. Per un'efficace ricapitolazione dei significati e dei criteri metodologici della storiografia greca e romana, si veda anche Sordi 1993b, 177-186. Una suggestiva riflessione in merito alla percezione stessa dell'antico e, dunque, all'anello di congiunzione esistente tra i fatti indagati, gli autori antichi che li tramandano e la loro moderna interpretazione, si deve a canfora 1989, VI. 18 In proposito, sulla nascita della storia critica ed euristica con Tucidide e sulla 'scientificità' della storiografia antica, vd.

Le bâtiment est un secteur-clé de l'économie antique, mais qui n'a jusqu'alors que peu intéressé les historiens. Ce travail de recherche s'efforce de lui rendre sa place en étudiant la définition progressive de ce secteur économique et social entre le iv e siècle av. J.-C. et la période augustéenne. L'échelle adoptée est celle du chantier, entendu comme l'ensemble des processus de construction, par conséquent comme une réalité dynamique à laquelle participent des acteurs tout aussi nombreux que divers. Nous montrerons ainsi des évolutions conjointes à la tête du chantier : la maîtrise d'ouvrage délègue de plus en plus la réalisation mais aussi la direction des travaux, publics comme privés, d'une part à des architectes, qui assurent à partir du ii e siècle av. J.-C. l'essentiel de la maîtrise d'oeuvre des gros chantiers, d'autre part à des entrepreneurs, groupe socio-économique où se trouvent à la fois des professionnels de la construction reconnus pour leurs compétences et des investisseurs financiers qui font ainsi fructifier leur capital. La complexité croissante des chantiers et des relations entre acteurs implique par ailleurs la mise en place d'un droit de la construction encore en cours de définition à la fin de notre période. Quant aux ouvriers qui réalisent les travaux, auxquels les sources écrites ne s'intéressent qu'à la marge, ils apparaissent comme un groupe hétérogène à la fois par leurs statuts, âges et sexes et par leurs compétences. Une part importante d'entre eux semble même passer d'un secteur à l'autre en fonction des besoins et des saisons. Le bâtiment est donc un secteur caractérisé par une grande fluidité, évoluant en même temps que la société, mais également intrinsèquement lié à d'autres secteurs de la Rome républicaine et augustéenne.

This book presents the results of a long-term investigation into the structure of Greek legal documents preserved on papyrus. It provides a clause-by-clause analysis of 281 formulations used in contracts, mostly from Egypt, spanning the early Hellenistic to the late Byzantine period. Designed as both a typology and a research tool, the study is based on the Synallagma database—a digital corpus first created with the support of the Israel Science Foundation and now hosted at the University of Münster. The approach is philological, quantitative, and comparative: each clause is examined for its syntactic form, legal function, and diachronic trajectory. The goal is to uncover the linguistic mechanisms by which scribes encoded rights, duties, and transfers of ownership. As a contribution to legal history and historical linguistics, the book offers an empirical foundation for the study of formulaic writing in antiquity—well beyond the specific body of sources it analyzes.

Pentru că astăzi răbdarea îmi era pusă la grea încercare. -Ce faci? s-a răstit Vragi, aplecat peste umărul meu, cu respirația duhnind a mied. -Exact ce vezi, am răspuns și am trecut vârful cuțitului peste burta peștelui pentru a-i scoate mațele. Curăț captura. Pufnind iritat, Vragi mi-a smuls cuțitul din mână, cât pe ce să-mi despice palma. A luat încă un pește, i-a tăiat burta și i-a adunat mațele într-o grămadă însângerată, apoi a înfipt cuțitul cu vârful în fundul de lemn, folosind aceeași metodă aplicată de mine. -Vezi? -Știu cum să scot mațele unui pește, am spus printre dinți, dorindu-mi cu îndârjire să-i scot lui mațele. Am curățat mii. -Nu-mi place cum o faci, a spus, strâmbând din buze. Nu faci bine. Oamenii se plâng. Asta era adevărat, dar nu se plângeau din cauza mațelor de pește. Dragul meu soț era un fiu al zeilor, pentru că primise un strop din sângele lui Njord în momentul concepției, care îi dădea o mare putere magică asupra ființelor mării. Dar, în loc s-o mânuiască pentru binele poporului nostru, o folosea ca să-i lase fără captură pe ceilalți pescari, umplându-și totodată propriile năvoade. Apoi își vindea peștii la preț dublu, tocmai oamenilor pe care-i lăsa cu mâinile goale. Toți știau, dar nimeni nu îndrăznea să ia cuvântul împotriva lui. Era Vragi Izbăvitorul, bărbatul care salvase Selvegrul de la foamete cu zece ani în urmă, când avuseserăm o recoltă proastă, adunând pești din Marea Nordului pentru a le umple burțile tuturor și garantând astfel că nimeni n-o să ducă lipsă de mâncare. Toți îl consideraseră un erou. Și poate că așa fusese cândva, dar faima și lăcomia risipiseră generozitatea prin care își câștigase titlul, iar acum oamenii îi blestemau numele, deși, în același timp, îl cinsteau în fiecare an cu un ospăț. Faptul că nimeni nu-i înfipsese un cuțit în spate se datora mai mult protecției iarlului. Dar nu numai. "Să nu uităm, Freya, că s-ar putea să avem din nou nevoie de magia lui", îmi spunea mama când mă plângeam. "Iar tu să nu uiți că-ți aduce avere în casă." Avere. De dragul ei îi acceptase tata propunerea de căsătorie -în ciuda împotrivirii mele vehemente. Dar, în loc să apuce să-și înțeleagă greșeala, tata murise în noaptea nunții și toți șoptiseră despre semne de rău augur și legături nefaste. Dacă într-adevăr fusese un mesaj trimis de zei, atunci n-ar fi trebuit să se obosească: căsnicia asta avea să fie un blestem, știusem încă din clipa în care Vragi îmi vârâse limba spurcată în gură de față cu toți invitații. Dar îmi era greu să strecor șoapte critice la adresa lui la urechile celorlalți, pentru că era generos față de mama și îi asigura toate cele necesare, în timp ce fratele meu își câștiga locul în ceata de războinici a iarlului. Vragi a pufnit din nou, apoi a scuipat pe pământ, lângă mine. -Mama avea dreptate: ar fi trebuit să mă căsătoresc cu o femeie urâtă, valoroasă prin priceperea ei. Nu cu una care se pricepe doar să fie frumoasă. Frumusețea nu știe să-mi curețe peștii. Nu știe să-mi gătească. Nu știe să-mi ofere copii. Frumusețea mea n-avea să-i aducă niciodată copii. Cheltuiam aproape toți banii pe care mi-i dădea pe suc de lămâie și bureți cumpărați de la negustorii veniți din Mările din Sud și, dacă Vragi se întrebase vreodată de ce îi miroase penisul a lămâie după ce facem sex, nu-mi spusese nimic. Fie ca ignoranța lui să aibă viață îndelungată! -Un an, femeie. Un an întreg de căsnicie și de împreunări, însă tot nu mi-ai dat un fiu. M-am aplecat deasupra fundului de lemn, curățând încă un pește ca să ascund lacrimile de furie care amenințau să mi se prelingă pe chip. N-aveam să las niciun copil să sufere în mâinile bărbatului ăstuia. Niciodată! -O să aduc o jertfă. Ceea ce nu era o minciună -la începutul fiecărui ciclu, făceam un sacrificiu în cinstea zeiței după care fusesem numită, implorând-o să-mi păstreze pântecul gol. Până acum, se arătase milostivă. Sau poate că avusesem noroc. Ca și când mi-ar fi auzit gândurile, Vragi m-a apucat de împletitură și m-a tras în picioare. -Nu vreau jertfe, Freya! a mârâit. Vreau să depui mai mult efort Să faci lucrurile cum trebuie. Să-mi dai ce-mi doresc. Când am simțit înțepături pe creștet, numai faptul că-mi împletisem părul strâns împiedicându-i să-mi smulgă câteva smocuri, m-am pierdut cu firea. -Poate că tu nu faci lucrurile așa cum trebuie, dragul meu soț. Eu, una, cu siguranță așa simt. O tăcere încordată s-a lăsat de jur-împrejur. O femeie inteligentă și-ar fi regretat cuvintele, dar eu în mod dar eram o neghioabă de primă mână, pentru că am simțit doar bucuria răutăcioasă a victoriei când am observat că aluzia mea are efectul dorit Sub barba groasă, Vragi s-a întunecat la față, iar la tâmplă i-a pulsat un vas de sânge, ca un vierme vinețiu. Apoi mi-a pus cuțitul la gât și, cu respirația râncedă, mi-a șoptit: -Poate că soluția e să te fac mai puțin frumoasă, Freya. Așa ai fi nevoită să înveți și alte deprinderi. Oțelul era rece și nemilos. Mi-a alungat sentimentul victorios și l-a înlocuit cu frică. Și totuși... nu puteam să cedez. Nu trebuia să mă las intimidată, să țip sau să-l implor, pentru că asta îi făcea lui plăcere: să mă umilească. Așa că i-am întâlnit privirea și am spus: -Fă-o! Fă-o, Vragi, apoi du-te în sat și vezi dacă oamenii o să-ți mai pregătească vreun ospăț, dacă o să te mai numească erou după ce o să afle că i-ai tăiat fața soției tale ca să-ți bați joc de frumusețea ei! A strâmbat din buze. -Au nevoie de mine. -Asta nu înseamnă că trebuie să te și cinstească. Și narcisiștii de teapa lui aveau nevoie de cinstire. Am simțit că i se învârt câteva rotițe în minte; fără îndoială că se întreba cât m-ar putea răni fără consecințe. Dar am refuzat să-mi feresc privirea, în ciuda transpirației reci care-mi umezise palmele. Tăișul mi-a apăsat obrazul și mai tare, usturându-mă, și am inspirat scurt ca să-mi stăpânesc panica tot mai intensă. M-a auzit. A rânjit, mulțumit de mica mea dovadă de slăbiciune. Mi-a dat drumul părului și a coborât cuțitul. -Înapoi la muncă, femeie! După ce termini, du-i doi pești mamei tale. Poate-ți reamintește ea care-ți sunt îndatoririle. E vina ei și a tatălui tău -a scuipat -că nu le cunoști. -Nu vorbi urât despre tatăl meu! Am înșfăcat cuțitul, dar Vragi doar a strâmbat din nas. -Iată și dovada! a spus. A uitat că ești fată și te-a învățat ca pe frate-tău. Acum, în loc de soție, m-am ales cu o femeie în toată firea, care se joacă de-a războiul ca un copil mic și-și vântură bățul de parcă fiecare copac i-ar fi dușman. O dogoare mi-a răsărit în piept, încingându-mi obrajii. Pentru că nu se înșela. -Poate că am și eu o parte de vină, a spus. Ți-am lăsat prea mult timp liber, care strică omul, după cum știu și zeii. Îmi lăsa timp liber doar pentru somn, dar n-am spus nimic. Vragi mi-a întors spatele și s-a dus drept la marginea fiordului, unde apa strălucea în lumina soarelui. Ridicând mâna, a șoptit și a invocat numele lui Njord. Pentru un moment îndelungat, nu s-a întâmplat nimic și mam rugat în șoaptă ca zeul mării să fi înțeles în sfârșit ce nemernic e copilul lui și să-i fi luat magia. O rugăciune inutilă, pentru că, după o clipă, unde au străbătut suprafața apei. și peștii au început să sară. Inițial, doar câțiva, dar apoi au sărit cu zecile pe plajă, până când pietrele abia s-au mai văzut sub grămada mișcătoare de aripioare și solzi. -Ăștia ar trebui să te țină ocupată, a spus Vragi rânjind. Transmite-i toată dragostea mea mamei tale! Când s-a întors și a plecat, cuțitul însângerat mi-a tremurat sub imboldul unei furii abia stăpânite. M-am uitat la peștii care se zvârcoleau pe țărm, încercând disperați să se întoarcă în apă. Așa o risipă, din moment ce erau mai mulți decât am fi putut să vindem înainte să putrezească! și nu era prima dată când Vragi proceda astfel. Cândva, îl văzusem cum aduce pe plajă o balenă, dar, în loc să-i ia imediat viața, o lăsase să se târască înapoi în apă, ca apoi să-și folosească magia pentru a o ademeni iar și iar, sub ochii întregului sat, torturând-o cu o expresie fascinată, fără niciun alt motiv decât acela că putea s-o facă. Întâmplarea luase sfârșit abia când fratele meu ieșise din mulțime și înfipsese un topor în creierul balenei, curmându-i chinurile și îngăduindu-ne s-o tranșăm, dar nimeni n-a sărbătorit ocazia cu ceea ce ar fi trebuit să fie un ospăț nemaipomenit. Refuzam să mai îndur asemenea regrete. Ridicându-mi marginea fustei, am fugit spre locul în care se zvârcoleau peștii, am apucat unul și l-am aruncat în apă. Am făcut la fel cu încă unul și încă unul, iar câțiva erau atât de grei, încât a trebuit să mă opintesc din răsputeri ca să-i mut. Am înaintat treptat de-a lungul apei și am înapoiat în mare captura lui Vragi, simțind cum mi se strânge stomacul de fiecare dată când găseam câte un pește nemișcat, cu fiecare moarte considerată drept un eșec propriu. The study is devoted to Roman prohibitions of castration. The first
of these prohibitions was introduced during the 1st century AD as a result of an intensification in the practice of castrating slaves. The Roman Empire was the only ancient state in which rulers endeavoured to counteract this heinous procedure. By issuing bans on castration, the Romans attempted to hinder the development of this phenomenon.
    The book consists of an introduction, five chapters and a summary.
In the introduction, the current state of knowledge regarding said issue
and the basic terminology concerning the persons who were castrated
are presented. Notions of castratus, eunuchus, spado, thlasias and thli
bias are analysed, with the differences between these terms being shown.
    The two initial chapters constitute an introduction with regard to
the main subject area on which the book focuses. In the first chapter, the author presents castration as a religious practice, applied mostly by the priests of Kybele as a punishment or a medical treatment. In the second chapter, a fourth area of castration use in ancient Rome – i.e. castration of slaves – is analysed. The position and extent of this phenomenon resulted in an inevitable counteraction against it in Roman law. The chapter treats various issues concerning the matter, such as the origin of slaves  being subject to castration, the methods and aims of the procedure, its physical aftermath and personality traits ascribable to castrates as well as trade concerning castrates and the issue of liability for the castration of a slave belonging to another person.
    In the third chapter, pre-Justinian bans on castration in Roman law
are analysed. The author presents regulations originating from Domitian, senatus consulta introduced under Nerva, Hadrian’s laws, a rescript introduced by Antoninus Pius and constitutions issued by Constantine the Great and Leon I.
    The fourth chapter focuses on a brief analysis of Christians’ approach
to castration as well as the prohibition of castration in church law. The
Catholic Church’s stance in regard to castration, expressed in canons of
I Nicene Council from AD 325 and slightly later in Apostolic Canons,
affected Justinian I’s legislation aimed against castration.
    The closing chapter of the study is fully devoted to Novel 142 of
Justinian, by which the emperor introduced new, up-to-that-date unknown regulations meant to contain the practice of castration to the area of the Eastern Roman Empire. The first measures undertaken by the emperor regarding limitations concerning the castration of slaves in the Roman state date back to the 30s of 6th century AD. In the Digest as well as in the second edition of the Code of Justinian, earlier Roman provisions concerning castration were included.

The concept of ḥazakah appears in diverse contexts and carries different meanings within Tannaitic property law. On the one hand, ḥazakah denotes a one-time act of acquisition through which an individual secures ownership of property. On the other hand, the term functions as proof of ownership, whereby continuous possession extinguishes the prior owner’s right of claim unless he can present additional evidence for his title. The halakhic tradition later distinguished between these two senses, yet a close reading of the Tannaitic sources reveals that the meanings often shift and overlap, raising the question of their legal and historical relationship.
This article proposes a new approach to the study of ḥazakah within the broader development of Tannaitic halakhah, adopting a comparative perspective with the legal systems that the rabbis encountered. A close examination of the appearances of ḥazakah in Mishnah Bava Batra 3 and its parallel in the Tosefta, as well as in the corpus of acquisition formulas at the beginning of Mishnah Kiddushin, makes it possible to trace the gradual transition from the Hellenistic context of early Tannaitic law to the principles of Roman law reflected in later strata. According to these Roman principles, prolonged possession of property alone—without any prior act of acquisition—was sufficient to establish ownership.
The most compelling explanation for the convergence of these meanings of ḥazakah in the Tannaitic corpus lies in the shifting legal environment in which these texts were produced. Their textual complexity mirrors the penetration of Roman legal discourse into Jewish legal thought. This case thus offers a representative example of the growing recourse of provincial populations to Roman legal principles, and the Tannaitic literature enables us to follow the successive stages of this process.

Intentionality and proportionality enter the jurisprudence dealing with rights of defense at the end of the third century of the common era. A rescript of the emperors Diocletian and Maximian to a certain Theodorus in 290 A.D. resolved a legal issue that had arisen from a court case. The question sent to the imperial court must have been: what kind of a defense a person can use if a robber attempts to take his property away. The imperial court's response coined a new term, "moderamen inculpatae tutelae" that had never been used before, at least not in the sources that are still preserved: 1 A person lawfully in possession has the right (recte) to use a controlled amount of blameless force (moderamen inculpatae tutelae) to repel any violence exerted for the purpose of depriving him of possession, if he holds it under a title that is not defective. Three centuries later the rescript was included in the Emperor Justinian's codification of Roman law. We have some if not complete certainty that the term was used for the first time because Roman law jurisprudence prior to 290 does not contain the term, rule, or concept.
