Luhmann's communication theory

In the 1990s, various philosophers of technology shifted their focus from reflections on technology in general (Technology) to reflections on concrete technologies (technologies) and consequently lost sight of overarching issues such as climate change. However, proponents of the shift to concrete technologies rightly argue that concrete technologies need to be taken into account, as, for example, not all concrete technologies have the same climate impact. This argument raises the question of whether both approaches can be integrated to enable research on overarching issues without losing empirical grounding. In order to propose a framework that integrates both approaches, we will first elaborate on the proponents of both approaches. Subsequently, we will use the case of time measurement to explore how the approaches can complement each other. Based on this exploration, we will propose a framework on how to relate philosophical theories on technology in general and concrete technologies in an integrated way.

El objetivo de este trabajo es analizar el modo particular en que la semántica de lo masivo se interseca con las semánticas comunitarias en ciertas reflexiones puntuales de las obras de Max Weber. Más específicamente, en ciertos textos especialmente significativos para mis propósitos: el ensayo de 1913 “Sobre algunas categorías de la sociología comprensiva”, sus reflexiones expuestas en los textos escritos circa 1914 sobre las clases, los estamentos y los partidos, incluidas en la segunda parte de Economía y sociedad, y las reelaboraciones de ambos textos, circa 1920, publicadas en la primera parte de dicha obra. En casi todos estos escritos,  tal intersección confluye también con sendas referencias a la noción de clase.

A number of debates are examined in light of the controversy surrounding the application of autopoiesis to social systems. While operational closure is recognised as a feature of such systems, the term autopoiesis is shown to be applied solely to the characterisation of living systems for various formal and ethico-political reasons. An example drawn from Deluezo-Guattrian scholarship to show how novelty can be introduced to irritate the closure of such systems through the connotative semiotic use of schizophrenia and how certain remarks of Luhman are thought to be meaningful only with regard to such novelty within the limits of denotative structuralism. Habermas, Varela, and Protevi, all weigh in on this debate.

O objetivo da pesquisa é diagnosticar a incompatibilidade entre as teorias clássicas da separação de poderes e a democracia de massas contemporânea, a partir de uma intersecção entre a ciência política de Robert Dahl e a sociologia sistêmica de Niklas Luhmann.

Vorbemerkung (2025):
Vor 20 Jahren erschien diese kleine, aber feine Arbeit über ein zentrales Thema systemischer Perspektiven. Es geht um Prämissen und Konsequenzen der Annahme, Nichtwissen sei ein wesentliches Merkmal systemischer Praxis. Dass damit nicht ein komplettes Unwissen gemeint sein konnte, dürfte sowohl dem Autor als auch den LeserInnen klar gewesen sein. Der Begriff jedenfalls machte in systemischen Diskursen Karriere, ohne dass in der Regel genauer dargelegt wurde, was genau damit gemeint sei. Das Buch, an das hier erinnert sei, greift dagegen den Begriff explizit auf und setzt sich erhellend damit auseinander. Es bleibt allerdings bei einer sozusagen säkularen Perspektive. Die Wurzeln des Begriffs in der altindischen und buddhistischen Philosophie spielen keine Rolle. Trotz dieser Erkundungen auf der Oberfläche hielt ich seinerzeit die Lektüre für anregend und halte es auch jetzt noch für sinnvoll, an dieses Buch zu erinnern.

It is urgent to trace the reflections of Gino Germani, a central figure in Argentine and Latin American sociology, on questions of primary interest for Latin America: What are theories and how do they relate to the empirical and their contexts? How does history enter into theories and what is its public relevance? What characterizes the theories of central countries, and how can they be used in the periphery? And finally, how to connect fantasy and scientificity, and what place do values have in theories? These disquisitions will be delved into with four key Germanic texts: Scientific Sociology ( ), Politics and Society for an Era in Transition (1962), Sociology in Latin America: Problems and Perspectives (1964), and Urbanization, Development and Modernization (1973). Throughout the entire work, the central hypothesis will be that it is not only possible to create theories in Latin America, but that this is a task that is urgent in the current conditions of our contemporary societies.

Hay en Brasil una porción social estratificada en un núcleo de protección que ya no se encuentra separado del propio sistema social. Son sistemas que no se comunican, cada uno con su propia racionalidad jurídica. Uno, aplicado para la parte de la población brasileña que se aprovecha del discurso jurídico ("derecho oficial") y otro, destinado a los outros ("ley del asfalto"). La cuestión, en Brasil, se presenta de la siguiente manera: ¿Y cuándo la "ley del asfalto" pasa a comunicarse con el Derecho? La propuesta es, basándose en la Teoría de los Sistemas Sociales Autopoiéticos como fue desarrollada por Niklas Luhmann, Gunther Teubner y Jean Clam, permitir una nueva forma de observación de este fenómeno. La necesaria comunicación entre los subsistemas sociales posibilita respuestas diferentes en una sociedad altamente diferenciada, periférica y del tercer mundo como es Brasil.

Es investigadora de temas sobre cultura y comunicación. En este trabajo se tratan algunos aspectos del sistema de medios de comunicación de masas, específicamente de la televisión, cuando actúa sobre el espacio temático de la educación. Con base en conceptos de Niklas Luhmann, se explora las diferencias entre los códigos en los que oscilan estos sistemas; a partir de ello, se examina la complejidad que supone la incidencia de un sistema en otro. Hecha esta reflexión, se realiza una propuesta de reconceptualización de la televisión, a partir de determinadas ideas-fuerza y estrategias.

A tanulmány célja annak feltárása, hogy a vallási rendszer hogyan lép kölcsönhatásba más társadalmi rendszerekkel. Megkülönböztetjük a vallás premodern és modern formáit. A társadalmi rendszerek közötti strukturális kapcsolatokat a politikai és a tömegmédia működésével szemléltetjük. Bemutatjuk a vallási rendszer társadalmi marginalitását, ami a vallás más társadalmi rendszerektől való strukturális függetlenségeként is értelmezhető. Rávilágítunk arra, hogy a politikai rendszer hogyan alakítja a vallási rendszer iránti érzékenységét. Betekintést nyújtunk abba is, hogy a vallás milyen módon befolyásolja a politikát olyan társadalmakban, ahol a funkcionális differenciálódás még nem vált a társadalmi differenciálódás általános formájává. A dolgozat azt vizsgálja, hogy a vallás jelenlegi társadalmi elszigeteltsége a nyugati társadalmakban hogyan befolyásolja a társadalom megfigyelhetőségét, értékelését és kritikáját vallási szempontból. A tanulmányban a vallás szociológiai fogalmát alkalmazzuk, így minden olyan hitrendszer, amely a valóság konstrukciójában figyelembe veszi a transzcendens/immanens megkülönböztetést, a vallás egy formájának tekinthető.

The aim of the study is to explore how the religious system interacts with other social systems. Premodern and modern forms of religion will be distinguished. The structural relationships between social systems are illustrated by the functioning of the political and mass media. We show the social marginality of the religious system, which can also be interpreted as the structural independence of religion from other social systems. We highlight how the political system shapes its sensitivity towards the religious system. We also provide insights into the ways in which religion influences politics in societies where functional differentiation has not yet become a general form of social differentiation. The paper examines how the current social isolation of religion in Western societies affects the observability, evaluation and critique of society from a religious perspective. In this study, the sociological concept of religion is applied, so that any belief system that takes into account transcendent/immanent distinctions in the construction of reality is considered a form of religion.

uestro tiempo es testigo de una lucha que es, a un mismo tiempo, clara en sus defi niciones y turbia en sus procedimientos. Después de un breve momento de excesivo esplendor, el existencialismo cayó en la miseria del descrédito y el olvido. A pesar de su sospechosa frivolidad parisiense, podemos reconocer que fue el último proyecto del humanismo. Pronto, en los años sesenta, otros franceses -Lévi-Strauss, Michael Foucault, Louis Althusser, Jacques Derrida-se encargarían de darle el golpe de gracia, reestableciendo y profundizando una corriente del pensamiento antihumanista que dura hasta nuestros días con sus estratégicas variaciones. Como siempre, el marxismo servirá para múltiples propósitos: si en Sartre potenciaba y daba sentido a un pensamiento humanista de la dinámica de las sociedades: el sujeto, el individuo no existe. Entiendo que el mayor mérito de este pensamiento es la destrucción de los mitos sociales como los de libertad, individuo y progreso. Pero el antihumanismo no es sólo materialista. Según Frederic Jameson 1 y Jacques Lacan 2 , el hombre es un esclavo del lenguaje y, por lo tanto, no es el creador de sus propios pensamientos. También un "anti-estructuralista" como Jacques Derrida es, igual que sus adversarios, un antihumanista: la diferencia fundamental entre Derrida y sus antecesores consiste en responder a la cuestión central de Jorge Luis Borges: ¿es el Universo un caos o un laberinto? Si es un laberinto hay, aunque oculta, una jerarquía. Este orden o desorden está referido a las relaciones simbólicas 3 . Derrida reconoce en Nietzsche a su precursor. Der Begriff der Lebenswelt wurde vor allem von dem Mathematiker und Philosophen Edmund Husserl in seinem Buch Die Krisis der Europäischen Wissenschaften und die transzendentale Phänomenologie in die weitere Diskussion eingeführt. Die Lebenswelt ist der intersubjektiv geteilte Sinn- und Erlebenshorizont, der eine notwendige Voraussetzung für Mathematisierungs- und Digitalisierungsprozesse bildet. Der vorliegende Beitrag zeigt, dass der Begriff der Lebenswelt ein Schlüssel zum Verstehen der Digitalisierung ist, insbesondere in Bezug auf den Einfluss neuerer Technologien wie Künstliche Intelligenz (KI). Drei Weisen der Digitalisierung der Lebenswelt werden erörtert: Veränderungen durch (1) digitale Geräte, (2) digitale Ordnung der Lebenswelt und (3) „intelligente“ Manipulation des menschlichen Sinn- und Erlebenshorizontes.

In this article, we address the question as to how one should read Niklas Luhmann today. Our starting distinction is between “working with the theory” and “working on the theory”. In the first case, scholars are supposed to empirically explore new fields of scientific inquiry based on the complex and articulated conceptual framework developed by the Bielefeld sociologist to understand social systems. In the second case, scholars should contribute to the development of the theory of society by overcoming internal conceptual resistances and at the same time ensuring the coherence of the achieved theoretical system. In conclusion, we suggest that the task of a sociological theory aimed at advancing the understanding of modern society should be to start from the results achieved, based on the principle that scientists should begin to search where others, in their search, have left off.

El propósito de este trabajo es mostrar el modo como se han constituido algunos intentos de estudiar la comunicación interpersonal desde una perspectiva más contextualizada e integrada, teniendo como fondo la crítica de propuestas de sesgo más fragmentario y analítico. Concretamente, se ha elegido como punto de partida la teoría de la información porque representa un momento crucial de la teorización, y una influencia indesmentible en esta materia. Una parte del trabajo se ocupa de la génesis de esta teoría, para luego recorrer parte de las discusiones que ha generado. El objetivo es mostrar como una propuesta de alcance muy acotado y en extremo vulnerable a la crítica, se convirtió en un referente obligado, llegando a tener un sentido paradigmático. La proposición final indica que la persistencia en mantener este marco de referencia, aunque ha sido una provocación y un estímulo, ha puesto severas dificultades a los esfuerzos por comprender la comunicación desde una perspectiva más interactiva. Un antecedente obligado en el estudio de la comunicación ha sido por mucho tiempo la llamada teoría de la información, formulada a finales de los 40 por el ingeniero Claude E. Shannon. En su intención original esta teoría es de un alcance muy acotado, debido a que se refiere sólo a las condiciones técnicas que permiten la transmisión de mensajes, pero eso no impidió que lograra una amplia repercusión y terminara elevada a la calidad de paradigma. En su primera versión apareció en el Bell System Technical Journal de octubre de 1948, perteneciente a la Bell Telephone Laboratories, organización a la que Shannon se encontraba profesionalmente ligado. Poco después el sociólogo Warren Weaver redactó un ensayo destinado a enfatizar las bondades de esta propuesta, que fue publicado junto al texto anterior en julio de 1949. El trabajo de Shannon se titula The Mathematical Theory of Communication, y el de Weaver Recent Contributions to the Mathematical Theory of Communication. En conjunto dieron lugar a un pequeño libro que tomó el título del primero de ellos. De este modo, la unión de dos textos y de dos disciplinas diferentes produjo una obra de referencia duradera en el campo de la comunicación. Lo habitual es que se aluda a estas concepciones como el modelo de Shannon y Weaver o como la teoría de la información.

We delve into Pokol's discussion on the temporalizing complexity as identified by Niklas Luhmann and its application through sophisticated AI models in managing and distributing societal knowledge.

O anseio deste artigo acadêmico é introduzir os conceitos gerais da teoria de sistemas de Niklas Luhmann. Para atingir seus objetivos, esta teoria é hermética e filosófica, com uma ampla gama de definições e busca apresentar um conjunto de conceitos que proporcionem um suporte adequado para a sociedade como um todo. Luhmann abordou a questão da complexidade em vários estudos e desenvolveu uma metodologia baseada em uma noção de sistemas autopoiéticos, funcionalmente fechados e distintos. A observação de segunda ordem é um dos conceitos centrais da teoria de sistemas de Luhmann, assim como a comunicação é elemento importante na formação dos sistemas sociais e na sua distinção de outros sistemas existentes. O método utilizado na presente pesquisa foi uma revisão qualitativa de literatura acadêmica sobre o assunto.

This article addresses the relationship between the structuralism, especially the anthropological version of the latter in Levi-Strauss and Luhmann's theory of social systems. The analysis is done through two guiding hypotheses. It reviews the historical background relating structuralism with systems theory and discusses the fundamental concepts that appear in this relationship. Luhmann's systems thinking are contrasted in some of its central concepts with Lévi-Strauss's structuralist perspective. The paper concludes with a review of the hypotheses presented and some proposals about the perspective of the social systems.

: El presente trabajo se propone relevar y cotejar tres estatutos
sociológicos imputados al concepto de comunicación en el contexto de los
debates sobre la autonomización relativa de la cultura y los primeros
tratamientos disciplinarios orientados por un “giro lingüístico”. Los
estatutos cotejados provienen de tres influyentes enfoques de la teoría
sociológica aparecidos durante la segunda mitad del siglo veinte. Nos
referimos a las investigaciones de Pierre Bourdieu, Jürgen Habermas y
Niklas Luhmann. Hemos optado por ellos debido a que sus aportes han
reelaborado una fundamentación estatutaria y una serie de usos sociológicos
del concepto de comunicación, que han resultado sumamente innovadores
dentro de la disciplina, particularmente en relación a las problemáticas del
lenguaje y de la cultura.

Dank Einsicht, Stärke und Reflektionsfähigkeit ist das Individuum in der modernen Gesellschaft verantwortlich für alle zentralen gesellschaftlichen Bereiche. Andererseits scheint das Individuum im Zeitalter des Postheroischen angekommen zu sein. Die Welt des kraftvoll-strahlend eigenverantwortlichen Individuums, das zu wissen wagt und so die Geschicke in die eigene Hand nimmt, wird überformt von "individuellen" Kollateralschäden wie burnout und lebensstilbedingten Erkrankungen. Hinzu kommt eine Überwältigung durch krisenhafte Entwicklungen, die von naturwissenschaftlichem Fortschritt ebenso ausgehen wie von wirtschaftlicher Eigendynamik. Zeitdiagnosen etwa eines "erschöpften Selbst" (Ehrenberg 2004), eines "unternehmerischen Selbst" (Bröckling 2007) oder einer "Neuerfindung des Sozialen" (Lessenich 2008) bringen diese Entwicklung zum Ausdruck. Der Mensch, der Heros der Aufklärung, scheint zum Tragikos geworden zu sein, der kaum umhin kann, die Geschichte des an den Umständen zugrunde gehenden, heldenhaften Tuns zu schreiben. Notwithstanding Luhmann's systems theory has a variety of concepts (code, structures, programs, operations, structural couplings, self-irritations, etc.) to analyze the Russian Criminal Justice as a self-referential system, it exhibits some limitations as well. A lack of fully-developed speed concept does not allow the autopoietic approach to adequately describe the Russian Criminal Justice System's emphasis on the efficiency, which is measured by a high rate of convictions produced within the system per unit of time. Drawing primarily upon intuitions of systems theory itself, this paper reconstructs the speed as a schema for the observation of changes and the number of operations produced within the system per unit of time. At the most abstract level, the speed concept is a prerequisite for observing the rate and tempo of oscillation between sides of distinction per se. Exploiting these theoretical adjustments, it is shown that the Russian Criminal Justice System seeks to increase the rate of oscillation within guiding distinction "legally guilty (non-lawful)"/"legally non-guilty (lawful)". In so doing, this system condenses most of meanings on the side "legally guilty" (connectivity value), minimizes the horizon of possibilities related to jury trials and due process rights, and decelerates a speed of reverse crossing to the side "legally non-guilty" (reflexive value).

Over the last 30 years, work at Cardiff University by my colleagues and I have identified and shaped the study of law and religion in England and Wales and have explored its interdisciplinary interaction with theology, history and sociology. This article draws upon, summaries and develops my previous work on the interaction between law and religion and the sociology of religion to focus in on particular on what could be achieved by employing a sociological perspective to the internal laws of religions. It falls into two sections. The first will explore the merits of a sociological approach to religious law generally while the second will focus on how the internal laws of religion can be better understood through application of social systems theory.

Although the problem of category has traditionally been addressed by various scholars since Aristotle, Luhmann's epistemology has kept this matter in a suspended state, occasionally prioritizing some concepts (presumably categories) over others. However, for the sake of a consistent analysis of the semantics and societal self-descriptions, it is better to have categorical constructs as focal points of systemic analysis manifested. Drawing upon resources of Luhmann's systems theory and Durkheim's sociology, this paper aims at elaborating the concept of category as an essential element of autopoietic analytical optics. It is shown that categories possess the following attributes: the highest degree of generalization and condensation, necessity, universality despite semantic variability, historicity and evolutionary characteristics. Amid a range of distinctions, system/environment, dis-/similar, un-/equal and distinction itself are considered to be categorical. This article argues that communication is the central point of all social life, and presents the summarized program of a sociological theory of communication. A series of authored and edited monographs that utilize quantitative and computational methods to model, analyze, and interpret large-scale social phenomena. Titles within the series contain methods and practices that test and develop theories of complex social processes through bottom-up modeling of social interactions. Of particular interest is the study of the co-evolution of modern communication technology and social behavior and norms, in connection with emerging issues such as trust, risk, security, and privacy in novel socio-technical environments. Computational Social Sciences is explicitly transdisciplinary: quantitative methods from fields such as dynamical systems, artificial intelligence, network theory, agent-based modeling, and statistical mechanics are invoked and combined with state-of-the-art mining and analysis of large data sets to help us understand social agents, their interactions on and offline, and the effect of these interactions at the macro level. Topics include, but are not limited to social networks and media, dynamics of opinions, cultures and conflicts, socio-technical co-evolution, and social psychology. Computational Social Sciences will also publish monographs and selected edited contributions from specialized conferences and workshops specifically aimed at communicating new findings to a large transdisciplinary audience. A fundamental goal of the series is to provide a single forum within which commonalities and differences in the workings of this field may be discerned, hence leading to deeper insight and understanding.

Niklas Luhmann did not conceptualize digital social networks as he passed away in the late 1990s, before the rise of virtual communities. However, his systemic analysis provides a framework for understanding relationship structures that enable selections to be made in real-time, which can be applied to both the realm of physical reality and the so-called "digital life." This paper aims to explore digital communication in social networks from the perspective of the Luhmann system, highlighting the interconnectedness and complexity that characterizes these systems.

Authoritarianism never ceased to exist in the interior of democratic States,
it just took a different form from the classic military tank on the streets, entering the justice system and the everyday functioning of the rule of law, little by little suspending rights and defrauding legal and electoral processes, serving the interests of others. This phenomenon is analyzed in Brazil by the names of measures of exception, liquid authoritarianism or even states of exception (Serrano 2016, Pires 2021).
When the behavior of institutes belonging to the legal system, according to Luhmann, is no longer guided primarily by the legal semantics of the textual models of the Constitution, of the law, to be guided primarily by other social models of conduct. This means that the analysis of what is licit because there is something illicit is replaced by the analysis of what is licit because it is rich, or even what is licit because it is profitable.
In the logical perspective of the imposition of a neoliberal policy that
imposes itself in the current Brazilian political scenario, political power is
necessarily subjugated to economic power, whose system led by financial capital calls for authoritarianism and state punitivism as an instrument to guarantee the great operations of the market and to contain the violence generated by the increase in social inequality that inexorably results from this excluding economic model.
Using the hypothetical-deductive method, this study intends to find out
whether it is possible to look at this relationship between economic, political and legal systems through the lens of Luhmann’s systems theory, especially regarding systemic corruption.

INTRODUCCIÓN Niklas Luhmann no llegó a conceptualizar las redes sociales digitales , ya que murió a fines de los años noventa, antes del encumbramiento de las comunidades virtuales. Namen prispevka je začrtati povezave med skladateljevim in poslušalčevim razumevanjem pomenskega potenciala glasbe. Natančneje: ali obe gledišči povezuje enak mehanizem? Odgovor na to vprašanje je podano po prerezu 1) raziskovalnih perspektiv, ki se ukvarjajo z ravnmi, ki razkrivajo pomenskost glasbe, 2) muzikoloških opredelitev glasbenega pomena in 3) analize treh primerov slovenske sodobne glasbe. Prispevek je predvsem poziv k upoštevanju naravoslovnih in družboslovnih gledišč kot dveh plateh raziskovalnega procesa istega pojava.

Communication is the foundation for social interaction and therefore society itself is based on communication. This means that every huge change that humanity has experienced derives from a technological discovery related to communication. As a way of studying the impact of technology in society and its power to influence human and natural environments, we propose to analyze how communication technologies have helped transform society as a whole. "Communications are the basic elements of social systems": Starting from this Luhmanian proposal and the theoretical approach of Social System's Theory, this paper offers an analysis based on the impact that communication technology has had on social development over time. Language and writing, as the first communication techniques, have been followed by a series of technologies, such as printing, telephone, radio, television, internet and cell phones, which are nowadays smarter than ever [37]. These new technologies have increased the amount of communications, making world society more complex than ever and accelerating social changes. This last observation introduces the possibility of proposing the arrival of a new era.

A través de la peculiar estructura que configura esta obra la autora, Isabel G. Gamero Cabrera, ofrece un acercamiento a la filosofía desarrollada y defendida por Jürgen Habermas. Valiéndose de un tono ameno y cercano, va presentando la teoría habermasiana acompañada de las problemáticas derivadas del aparato conceptual que el filosofo ha ido configurando, todo ello aludiendo a la actualidad de los temas abordados al tratar de aplicarlos en la compleja sociedad vigente. En este sentido, la autora viene a conformar una amplia imagen del pensamiento del filósofo desde un punto de vista crítico, atendiendo a las complejidades y carencias que ha logrado identificar, enfocando, al mismo tiempo, su mirada en las profundas crisis recientemente acontecidas.

Since Jean Baudrillard, many consumer researchers consider consumption to be universally relevant. In late modern societies, they tend to argue, consumption is everything and everything can be understood as consumption-similar to the "economic imperialism" debate some decades before. In this chapter, we problematize this perspective on the basis of Niklas Luhmann's general theory of society. We first introduce Luhmann's understanding of "audience roles" in the modern, primarily functionally differentiated world society and show then where he situated the consumer role within this society. Then we adopt this theoretical lens to explain why the universality thesis probably underestimates the successive risks if the consumer role would have already colonialized society so broadly and imposed its perpetual quest for experiences and pleasures upon all functional systems outside of the economy. We conclude by raising critical questions about the consequences that such a colonialization and a resulting functional de-differentiation could have for modern society.

A partir de las herramientas genealógicas que aporta la obra de Zaffaroni en torno a la emergencia del derecho penal, se expondrán algunos matices culturales que supone la cotidianidad del poder penal, para así, desde el análisis criminológico de la obra de Christie sobre las imágenes del hombre en el derecho penal, explicar las tensiones y efectos que suscita en la teoría penal contemporánea. En ese sentido, esta investigación documental, la cual supone un enfoque cualitativo, implica brindar herramientas para la comprensión y explicación de los efectos sociales de la sistemática del delito; es decir, un análisis que se articula dentro de los marcos de la sociología de la penalidad, revisando los usos constitutivos del saber jurídico-penal. La sociologia tradizionale si è occupata poco di temi legati alle Costituzioni. L'evoluzione della società moderna rende evidente il fatto che non tutti i valori diventino leggi effettive. Da qui ulteriori forme di manifestazione della complessità: se la salute è un valore e come tale andrebbe garantito a tutti – al punto che appare nella maggior parte delle costituzioni nazionali moderne – occorrono programmi e strutture che consentano di trasporre il valore in diritto: una volta stabilito che la salute è un diritto inalienabile, devono venire strutturate le condizioni che garantiscano questo diritto. Il problema è come stabilire criteri operativi per i due sistemi coinvolti – la medicina e il diritto.
