il lettore italiano trova certamente molti spunti di riflessione, nonché ambiti comuni di interesse e di approfondimento con il giurista spagnolo e la sua particolare concezione del diritto. Come nel nostro paese, infatti, anche in Spagna i giuristi che hanno svolto un ruolo di primo piano nella realtà giuridica decidono di misurarsi con temi di teoria del diritto e, in senso lato, di filosofia del diritto 1 . Non possiamo che plaudire a queste iniziative, considerando quanto importanti possano essere, per lo statuto scientifico della nostra materia, i contributi e le riflessioni di chi ha maturato con impegno e passione una vasta esperienza nei settori specialistici del diritto o nella pratica del Foro. Se oggi l"interesse verso una impostazione teorica di tipo formalista appare decisamente in crisi, Nieto si presenta al lettore italiano come il cantore di una nuova stagione per la teoria generale del diritto iberica: tuttavia, come in un ipotetico specchio, molte delle considerazioni che troviamo in quest"opera riflettono diversi mutamenti in atto anche nella realtà giuridica di lingua italiana. L"autore fornisce molti argomenti che spiegano perché, nella penisola iberica, le teorie del diritto di matrice formalista non riscuotono più quel successo che avevano spartito con la tradizione giusnaturalistica della Seconda scolastica, dagli anni del dopoguerra in avanti. Sebbene molti lavori di teoria e filosofia del diritto rimangano ancora oggi legati alla tradizione del diritto naturale, rinnovata nei temi grazie al notevole successo riscosso dai diritti umani, non così i formalisti, i quali vedono giorno dopo giorno sgretolare le loro certezze dogmatiche a cagione dei colpi che provengono da diverse direzioni 2 . Il contesto internazionale e quello comunitario, oltre che l"assetto costituzionale, contribuiscono a trasformare l"impianto ordinamentale delle fonti ed il contenuto assiologico delle norme, sino a porre in crisi il monopolio dello stato sulla produzione normativa; di conseguenza il fenomeno della creazione del diritto si distribuisce oggi in una varietà di eventi che non consente di riferirsi al fenomeno della positività nelle forme consuete del pensiero della tradizione formalista novecentesca. Il tema trattato da Nieto si inserisce, dunque, nel più ampio scenario della costituzionalizzazione dei valori 3 , del cd. diritto vivente e del rapporto tra diritto fissato dal legislatore e diritto praticato, ovvero reso concreto da parte delle corti. Nella realtà spagnola le prime critiche al formalismo sono state avanzate dalla concezione argomentativa del diritto che, riscoprendo la matrice linguistica ed informale della logica, ha cercato di superare l"impostazione deduttivista, prestandosi ad un tipo di ragionamento processuale più elastico ed in accordo con i sempre più rapidi mutamenti sociali e giuridici 4 . Italy is in a special position from which to observe the comparison between the accusatorial and the inquisitorial models, because it has adopted a highly original procedural form. Since 1989, a model drawing its inspiration from the adversarial procedure has been progressively introduced into the Italian inquisitorial judicial system. At first it has been used solely in trials; then, from 1999 it has been extended to all judicial proceedings (as a result of the reform of article 111 of the Constitution). This new introduction cuts deep not only into the judicial culture but also into current Italian culture, because the adversarial principle (in Italy called contraddittorio) was presented as a benefit to be safeguarded and maintained, and no longer as a problem to be avoided. Unfortunately, within the sphere of actual judicial experience the value attributed to the adversarial model mainly consists in a sterile dramatisation of facts. The purpose of this research paper is to explain the intrinsic rationality and the alethic value of the confrontation between the parties. It demonstrates the integral Socratic structure of the adversarial model, which not only represents a logical means of verification, or refutation, of discrepancies in legal arguments, but also defines the truth conditions of legal arguments.

Questo lavoro tratta della consulenza genetica attraverso l'analisi delle sue fonti nazionali ed internazionali. La c.g., è un dialogo che può prendere le sembianze di una relazione terapeutica, ovvero di una pratica filosofica. Il lavoro fornirà gli argomenti per poter considerare la c.g. un dialogo di tipo socratico in grado di dischiudere, attraverso l'esperienza parresiastica, una via di appercezione della propria persona.

Neuroscience develops a particular idea of civilization: a neuro-civilization; whereby improvements of society are brought about by certain strategies. Firstly, through a definition of the role of the neuroscientists in Courts and Public debates. Secondly it creates new paradigms in these cultural debates about the structure of Society and the Law. And finally through reductive neuro-law characterized by the progressive substitution of traditional normative sources with new neuroscientific standards. Thus, the more the neuroscientific establishment justifies itself in its attempt to define standards of normality (for example), the more the possibility opens up of invasive interventions with unpredictable effects upon the patient, which stray perhaps involuntarily from the paradigms of direct intervention. Such questions mask a fundamental importance, since there is a risk that a certain neuroscientific idea of normality imposes itself not for deeper theoretical reasons, but for dangerous current practices.

It may be a risk if a certain idea of normality imposes itself for current practises, not for theoretical reasons.

It's well known that neurosciences are those disciplines characterized by the study of the relations between the structure of the brain (and the nervous system) and the human behaviour. In this paper, I will analyse how the knowledge of the neurological structures tends towards the control of socially undesired behaviours, thus ending up with an authentic 'neuro-civilization'. Furthermore, I will show the role neuroscientists claim for themselves in the Courts of Justice and in cultural debates; moreover, I will analyse the so-called reductive neurolaw, which is the gradual replacement of traditional sources of law with new neuro-scientific standards. Finally, I will present the elaboration of the concept of 'normality' as used in order to eliminate deviance and to directly intervene in the brain, with resulting critical issues for human autonomy and personal freedom. New techniques (on human brain investigation) open opportunities in regard to the capability to understand, and control, the behaviour of persons considered deviant, transforming them into socially accepted ones. As we will see, in order to achieve this result, neuroscientists try to structure a range of scenarios in strategic terms. It may be a risk if a certain idea of neuro-normality imposes itself for current practises, and not for theoretical reasons.

The paper introduces the educational project on the debate named "A suon di parole". It is a project that started in 2010 following a collaboration between the Faculty of Law of the University of Trento and IPRASE (Provincial Institute for Research and Educational experimentation of the Autonomous Province of Trento, Italy), and over the years the Cities of Trento and Rovereto subsequently joined. This collaborative project aims to develop, in a fun and competitive manner, the ability of high school students to argue and counterargue. In a healthy debate intended to develop their logic, reasoning and critical thinking. To do this, debate tournaments have been organized, in which intellectual games were played, along with structured arguments and counterarguments. As a result, it was observed how the dialectical confrontation, lived as a sporting competition, was able to promote in young people the desire and the capacity to compare their own reasoning with those of others in a manner that is not influenced by common teaching methods. Thus, through careful selection of themes for critical debate, an observation was made on how each student, regardless of his/her personal history, has had the opportunity to learn, understand, and, occasionally, change his/her beliefs through the dialectical confrontation with other students. Indeed, the purpose of the game was not to present pre-reasoned formulae to students in order to impose them as a specific way of thinking or speaking, but rather as ways of creating a game field where they are free to intellectually compete with each other. In order to develop the autonomy of students' thinking and, at the same time, increase their integration and social cohesion, teaching took place through the experience of judicial debate in which two parties clash in a simulated court setting and not through lectures. In this way students approached the world of rules (legal, logical and ethical) through a kind of "trial game", thus developing the ability to support their ideas through the oppositional comparison which led us to suggest that the project has achieved its purpose.
