El derecho disciplinario forma parte de la estructura pública inherente a toda organización estatal, independientemente de cual sea su naturaleza, con el fin de vigilar y controlar la conducta de los servidores públicos conforme a los principios rectores contenidos en su respectiva normatividad legal vigente, para permitir el cumplimiento de los fines e intereses del Estado. En ese sentido, dada la naturaleza autónoma e independiente de este derecho, vale la pena destacar los pilares que lo fundamentan, como son el ius puniendi del Estado, el principio de ilicitud sustancial y la relación de sujeción especial que existe entre ciertos agentes con el Estado. Así mismo, al considerar que los fallos disciplinarios proferidos por órganos de control, como la Procuraduría General de la Nación, se adoptan en el marco del quebrantamiento o la perturbación de un deber funcional en el ejercicio de la actividad estatal por parte de servidores públicos o particulares que cumplen funciones públicas, es menester analizar el control pleno e integral de legalidad que efectúa la jurisdicción de lo contencioso administrativo a los mismos, dada la esencia que configura a estas decisiones como actos administrativos, para determinar si es necesario brindarles un tratamiento especial en el ordenamiento jurídico colombiano.

Con este comentario se viene a señalar el significativo cambio de rumbo en la jurisprudencia del Tribunal Supremo en relación con las relaciones de puestos de trabajo, a las que incluso se les ha arrebatado el carácter figurado de norma para que pudieran ser objeto de recurso de casación. La sentencia pretende zanjar una cuestión largamente tratada tanto por la jurisprudencia como por la propia doctrina, sobre lo que es en sí una relación de puestos de trabajo: si realmente son normas jurídicas o simplemente actos administrativos dentro de esa doble función que realizan como instrumento de ordenación de recursos humanos y como último eslabón de la cadena organizativa de una Administración determinada. El voto particular formulado vuelve a incidir en que la cuestión no parece estar definitivamente cerrada, desde el punto de vista de la caracterización de dichos instrumentos, añadiendo lo que precisamente se trataba de combatir: la inseguridad jurídica en los funcionarios.

This comment has been to point out the significant shift in the jurisprudence of the Supreme Court concerning relations jobs, which even has robbed the figurative nature of rule so that they could be subject to appeal. The judgment seeks to settle a question treated at length by both case law and the doctrine itself, what is in a relationship of jobs: if they really are or just legal rules within administrative acts performing this dual role as an instrument of management of human resources and as the last link in the organizational chain of a particular administration. The dissent raised again stressed that the issue does not seem to be definitely closed from the point of view of the characterization of these instruments adding precisely what it was combat: the legal uncertainty officials.

La Sentencia que ocupará las siguientes páginas, es objeto de un punto de inflexión a través del cual, el Tribunal Supremo cambia años de doctrina jurisprudencial. La figura por excelencia era el Reglamento en las Relaciones de Puesto de Trabajo. A través de este análisis podremos observar, como los criterios han cambiado, y ya no es el régimen normativo a seguir según el Tribunal Supremo. Para terminar realizaremos un análisis a modo de conclusiones extraídas a raíz de su régimen comparativo con la figura jurídica anterior.

The Sentence analyzed a turning point through which the Supreme Court changed years of jurisprudence. The figure par excellence was the Regulation on Workplace Relations. Through this analysis we can see, the criteria have changed, and is no longer the regulatory regime to follow according to the Supreme Court. Finally make an analysis by way of conclusions drawn following its comparative legal regime with the previous figure.

У статті проаналізовано підходи, щодо класифікації індивідуальних адміністративних актів, що пропонуються в вітчизняній та зарубіжній літературі з адміністративного права. Сформульовано власний варіант класифікації індивідуальних адміністративних актів, який дозволяє більш повно визначити їхню правову природу, систему та співвідношення між собою.

The article provides a comprehensive research of individual administrative acts, which most fully expresses all the main aspects of the legal significance of these acts. The role and the legal significance of individual administrative acts in the activities of public administration and their effects on private persons were analyzed. Various aspects of the legal significance of individual administrative acts are defined on the basis of analysis of the legal literature about the theory of law, administrative law, as well as the legislation, judicial and administrative practice of Ukraine.

The article deals with analysis of bringing individual administrative acts into action also were considered concepts of their action, which includes not only the beginning of the action, but the suspension and termination of the action. The author made differentiation of such terms as «action» and «validity» of individual administrative acts. On the basis of this research were proposed the author’s definitions of the mentioned categories.
Considering the futility of national administrative procedural law the issue of action of individual administrative acts is one of the most difficult in national administrative law science.
On the basis of Ukrainian legislation were defined the most widespread moments of bringing individual administrative acts into action. 
In the article special attention were paid to burdening individual administrative acts. To guarantee the rights of private individuals in relation with public authorities it is extremely important to determine the moment of appearing obligations and prohibitions in person. According to the principle of legal certainty, which is one of element of rule of law, it is unacceptable when burdening act bringing into action from the moment of adoption and a person finds out about its existence only during execution of this act.
Notification addressees of burdening individual administrative acts must be defined in legislation of Ukraine not only as a responsibility of all administrative bodies, but also as a necessary prerequisite of bringing acts into action, otherwise there will be a real threat of violation of rights and freedoms of individuals in relations with administrative bodies.
