Right to Life and Death

Right to Death Nonviolent Doctrine is a transparently audited open science proposal based on the researches I for a nonviolent restorative justice rule of law (RoL) least worse possible minimum set of guidelines for the jurisprudence of mental health psyche-social support (MHPSS) harm reduction for individuals and groups demanding for their legal rights to assisted death, also called euthanasia, and suicide. It was developed from my personal experience saving countless lives without any method available, so having to research them infield, and was compiled from my readings when writing the Immortal Magazine's article 'Right to Death and Eternity Thanatology' due to a request from the humanitarian agents of the Doctors Without Borders (MSF) Gaza Mission.

L'articolo analizza i disegni di legge in materia di fine vita all'esame del Senato. Lo studio pare dell'importanza del diritto alla vita nella giurisprudenza costituzionale. Affronta poi il tema dell'autodeterminazione, del diritto alla salute e della protezione della dignità. Infine si concentra sul problema dell'efficacia del giudicato costituzionale.

The article analyses the end-of-life bills that are currently examined by the Senate. It first highlights the importance of the right to life in the Italian Constitutional Court’s case-law. It then tackles the issues of self-determination, freedom of health and of the importance of the constitutional protection of human dignity. Finally, the study focuses on the problem of the binding effects of the Constitutional Court’s case-law on the issue.

Η μονογραφία αυτή πραγματεύεται το δικαίωμα στη ζωή και το δικαίωμα αυτοπροσδιορισμού σε δύο κρίσιμες εκδηλώσεις έντασης μεταξύ τους: στις αμβλώσεις και στην ευθανασία/υποβοηθούμενη αυτοκτονία. Μολονότι το υλικό αντικείμενο του δικαιώματος  είναι  η ζωή ως βιολογικό φαινόμενο,  αυτή  προστατεύεται συνταγματικά όπως γίνεται αντιληπτή  και αξιολογείται στην  κοινωνική συνείδηση. Άρα, τα όρια του δικαιώματος στη ζωή και στο θάνατο καθορίζονται από τη σύγκρουση ιδεών και συμφερόντων στο κοινωνικό επίπεδο, πριν προσδιοριστούν στο νομικό. Αυτό συμβαίνει, άλλωστε, με όλες τις συνταγματικές διατάξεις. Ακριβώς επειδή τυποποιούν θεσμικά τις συγκρούσεις ενός διχασμένου και ιεραρχημένου κοινωνικού  σώματος,  αντανακλώντας τις, διαπερνώνται  και τέμνονται από  τις  αντιθέσεις  αυτές. 
Θυμίζω τις σχετικές κρίσεις δύο δασκάλων μου, αρχικά του Αρ. Μάνεση:  "οι ταξικοί  και  εν  γένει κοινωνικοπολιτικοί ανταγωνισμοί  συνεχίζονται    στο  πλαίσιο  του    Συντάγματος,  που  αποβαίνει έτσι ένα σημαντικό πεδίο  διεξαγωγής  τους" και  στη συνέχεια του Δ. Τσάτσου  (το Σύνταγμα) «λειτουργεί ως θεμελιώδης κανόνας διαδικασίας, μέσα στην οποία συντελείται και συστηματοποιείται δυναμικά  η  κοινωνική σύγκρουση".

This report serves to analyse the development of assisted suicide and voluntary euthanasia in the Republic of South Africa post-apartheid with reference to countries such as Belgium and the Netherlands, where the practice of euthanasia and assisted suicide has been decriminalised and regulated by the law. With the aid of various legal rules and principles which include but are not limited to; International law, relevant Constitutional and legislative provisions, stare decisis, proposed commission reports and academic writings, this report examines the necessary steps taken to regulate the practice of voluntary euthanasia in South Africa, viz, it determines whether there is a need for Parliament to enact a law or body of legal rules that would regulate the practice of voluntary euthanasia and assisted in an open and democratic society that is based on human dignity, equality and freedom.

Thesis Advisor: Ayşe Öncü Turkey gave its citizens the right to individual petition to the European Court of Human Rights (ECtHR) in 1987. In the same year, via legislative decree, State of Emergency Rule which excluded the acts of the administration or responsibility of public servants in the field of emergency issues from judicial review was declared in seven provinces located in the Kurdish region. At the juncture of these two critical shifts that envisaged significant changes in the legal status of millions of people, the human rights violations committed predominantly against Kurds during the state of emergency period were carried to the ECtHR in the absence of an effective and accessible domestic judicial mechanism. In the years that followed, the ECtHR was bombarded with thousands of individual applications from southeast Turkey, whereby the narratives of violence taking place in the 1990s were for the first time heard in a public forum. Yet, despite the thousands of the judgments of the Court finding Turkey guilty of breaching the Convention requirements, the effect of these judgments remained limited at the domestic level as a result of the development of the official narrative of security and counter-terrorism alongside the human rights narratives and reforms. What I propose to do in this thesis is to delve into the dynamics of this dual development of seemingly contradictory narratives-whereby rights given by one hand were taken away by the other-by looking at the cases on alleged incidents of state killings or deaths in detention, submitted to the ECtHR against Turkey prior to May 2009. By looking at the ways of attribution of responsibility to the state and the transformation of the scopes of the cases by the Court in these proceedings, I try to understand the limitations of human rights law in denouncing state violence through locating the silences, exceptions and exclusions in the Court's reasoning.

This Malayalam article analyses the ruling of the Indian Supreme Court permitting passive euthanasia - the withdrawal of artificial life support systems when there is no hope of life in its absence. The implications of this ruling are analyzed examining various possible scenarios and a note of caution is sounded regarding the possible misuse of the provisions of this judgement. The article concludes by stressing the right to a healthy life, and also the importance of palliative care.

Досліджуються проблеми здійснення та захисту особистих немайнових прав фізичної особи. Окрема увага приділяється аналізу системи особистих немайнових прав фізичних осіб та дослідженню окремих їх різновидів.

A petición del gobierno bávaro y de 249 diputados del grupo parlamentario democristiano, el 28 de mayo del año en curso se pronunció la Sala segunda del Tribunal Constitucional alemán sobre la constitucionalidadd de la ley de 27 de julio de 1992 de ayuda a las mujeres embarazadas y a las familias 1 . Con esta ley, se pretendía cumplir con lo previsto en el artículo 31,4 del contrato de reunificación de 31 de agosto de 1990, de que antes del 31 de diciembre de 1992 se promulgara una ley de aborto que sustituyera a las dos vigentes: la de la antigua República Democrática, que despenalizaba parcialmente el aborto atendiendo a un sistema de plazos ("Fristenlösung"), y la de la República Federal, que seguía un sistema de indicaciones ("Indikationslösung").
