The National Environmental Standards and Regulations Agency (NESREA) was established by the National Environmental Standards and Regulations Enforcement Agency (Establishment) Act No. 25 of 31st of July 2007 as stated in the Federal Republic of Nigeria Official Gazette No. 92.
It has as the mandate of NESREA the establishment of the national environmental standards and regulations enforcement agency, functions and powers of the Agency and Council, structure of the Agency, staff of the Agency, and powers to enter. These are discussed by this article which seeks to answer the question whether the NESREA Act is a lame statute? In effect the focus of the article is to examine the content of the Act with the conclusion whether the Act is ineffectual or otiose.

Biodiversity, a standout array of life formed on earth. Hence, it requires adequate conservation. Given Nigeria's rich natural resources and diverse ecosystems, biodiversity conservation is a critical issue in Nigeria. This paper examines the relevant extant laws and policies regulating biodiversity conservation in Nigeria through doctrinal methods of legal research, which include statutes, case laws, relevant textbooks and articles, and legal commentaries. It highlights and explains the gaps and challenges that hinder effective implementation and enforcement. It, also, explores the roles of stakeholders, including government agencies, non-governmental organizations, and local communities, in biodiversity conservation efforts. The study revealed that the extant legal framework to conserve biodiversity in Nigeria seems to be weak due to one impediment or another that poses as challenges. In conclusion, this paper recommends strengthening enforcement mechanisms and increasing collaboration among stakeholders and local community participation in conservation efforts to improve biodiversity conservation in Nigeria.

This work evaluated the activity concentration of radionuclides on sedimentary and igneous rocks at Corumbataí river basin, São Paulo State, and, consequently, the exposure rate. This basin possess a large sugar cane crops area, where occurs the application of phosphate fertilizers, and where is located the most important ceramic center of South America (Santa Gertrudes Ceramic Center). The chemical characterization of the samples indicated that Ca > Mg > K > Na, which is related to the mineralogy of each formation. The weighted mean exposure rate (35 nGyh-1) to the studied formations represent just 64% of the world average due to terrestrial gamma radiation, occurring the highest exposure rate at the southeast portion of the area. The data obtained can be utilized in environmental studies involving the basin, including those related to the land use.

Member, the basal unit of Rio Bonito Formation, is the post-glacial deltaic system of the glaciomarine and marine sedimentation of the Rio do Sul Formation (Itararé Group). The wells drilled by CPRM in the eastern margin of Paraná Basin are continuously and constitute an important documentation of the Rio Bonito Formation. The sequential analysis of seven wells in northern Santa Catarina State allows the characterization of the following fácies successions/associations: glaciomarine, deglaciation, fluvial, deltaic, and marine offshore to shoreface. A stratigraphic section through the studied wells reveals the lateral distribution of the fácies associations and the mapping of erosional regressive (corresponding to sequence boundaries) and transgressive surfaces. The investigated area is compartmentalized into three sedimentation domains: the northern one, PP9 to PP 11 wells, where six depositional sequences (four in the Rio do Sul-Triunfo "transition" and two in the Triunfo Member) overlie the marine substrate of the Rio do Sul Formation. Each sequence is formed by fluvial, deltaic and deglaciation associations (lower part of the sequence), and by glaciomarine and marine associations (upper part). Despite little sampling in the Rio do Sul Formation, the central domain reveals distinctive characteristics (PP6 to PP8 wells): thick glaciomarine deposits in the Rio do Sul substrate, thin "transition" zone and the predominance of fluvial associations in the Triunfo Member. The southern domain, PP4 and PP5 wells, has thick marine shelf deposits in the underlying Rio do Sul Formation, which partially corresponds to the Rio do Sul-Triunfo "transition" from the northern domain. Five depositional sequences are identified in the southern domain, and they are correlated with the central and northern domains. In addition, the marine shelf association of the southern domain changes laterally to deltaic deposits toward south (the "basal Triunfo delta" of the Rio do Sul área).

IAPÓ FORMATION: CONTINENTAL GLACIATION IN THE ORDOVICIAN/SILURIAN BOUNDARY OF THE PARANÁ BAS1N. The lapó Formation is a thin and widespread unit, generally less than 20 m thick and covering discontinuously an área of hundreds of thousand square kilometers. The main fácies is massivê diamictites, which display pebbles and cobbles in a mud matrix, some of them faceted and striated. The massive diamictites are considered subglacial tillites. The fácies association includes stratified diamictites, conglomerates, massive and stratified sandstones, and fine laminated fácies with dropstones. The glaciation in the Ordovician/Silurian boundary is well constrained and its correlation with other Gondwanan basins suggests maximum glacial in the Iate Ashgillian age. The lapó Formation is overlain by early Llandovery post-glacial transgressive shales of the Vila Maria Formation. It is herein proposed a modcl of glaciomarine stratigraphic architecture in a glaciated continental margin to explain the origin of the lapó Formation.

PALEOCURRENTS, PALEOGEOGRAPHY AND DEPOSITIONAL SEQUENCES IN THE TATUI FORMATION, BRAZIL Coarse-grained sandstones and conglomerates rich in silex clasts are conspicuous facies of the Tatuí Formation in the eastcentral São Paulo State , Brazil. They represent a progradation of coastal alluvial fan systems (Ibicatu) on a marine shelf. Paleocurrents indicate depositional dip towards the south, paleoshoreline with an approximate east-west direction and sediment provenance from the North. The upper part of the Tatuí Formation, interpreted as a highstand system tract, was covered by transgressive shales of the Taquaral Member (Irati Formation). During the transgressive phase, sediments of the Tatuí Formation were partially reworked by marine erosive processes, with development of wave ravinement surfaces and deposition of thin levels of conglomerates rich in silex grains, pebbles and bioclasts (scales, teeth and bones of fish and coprolites). The conglomerates are transgressive lags at the base of the Taquaral transgressive system tract.

Indonesia's oil and gas governance has been specified in certain laws. The first oil and gas law was Emergency Law No. 44 of 1960. This law was changed to Law No. 8 of 1971 which gave a dual function, namely to Pertamina National Oil Company (NOC), as an operator and regulator. Meanwhile, the function of policy making was carried out by the government. These two functions are known as "two feet." Furthermore, with the promulgation of the Oil and Gas Law No. 22 of 2001, there was a separation of regulatory functions by Pertamina and giving them to state institutions known as BP Migas. The agency was later converted into two different institutions, SKK Migas for regulating upstream oil and gas and BPH Migas for downstream regulation. These functions are known as 'three feet'. However, the Oil and Gas Law No. 22 of 2001 received a lot of criticism, because this law was considered too liberal and put Pertamina as a NOC to compete openly with the International Oil Company (IOC) which was considered to have more good advantages in technology, capital, and risk management. The existing Oil and Gas Law has caused prolonged stagnation in the national oil and gas industry, and reduced the performance of this strategic industry in terms of lifting, exploration, exploitation and oil production. This study is intended to provide a description regarding the various design concepts of oil and gas law governance by referring to the oil and gas management and performance models in various countries and IOC. Furthermore, this study empirically offers a comparison of the NOC model in managing oil and gas, and the advantages and disadvantages of institutional selection over the oil and gas administration

This Act concerns the administration of and control on petroleum operations in Tanzania and assigns for this purpose duties to the Minister responsible for petroleum matters and the Energy and Water Utilities Regulatory Authority (EWURA). The Act shall apply to the trade in and handling of petroleum and petroleum products but not to exploration, development and production of petroleum.


Prior to the issue of a licence for operations under this Act, the applicant shall comply with all necessary environmental requirements as provide for under the Environmental Management Act. The EWURA shall develop a classification of petroleum operations for environmental impact assessment purposes. Some provisions of this Act concern the production and blending of biofuel. The Act grants powers to the Minister to regulate the use of food crops and land for the production of biofuel.

Since the discovery of petroleum in Nigeria, the host communities have been at the receiving end of the negative environmental, social and economic impacts of petroleum operations. Poverty, unemployment, violence and social unrest, sabotage, pipeline vandalism, militancy, kidnapping of foreign workers, illegal oil refinery (kpo-fire) and environmental degradation of host communities are some of the major issues that have arisen in the industry. These problems affect many host communities in Rivers State, Bayelsa State, Delta State, Edo State, Cross Rivers State, Akwa Ibom State, Abia State, Imo State and Ondo State all of which constitute the Niger Delta states. Although measures have been made by the government and industry operators through memorandum of understanding, local content scheme, Niger Delta Development initiative and recently host community development trust, there are still some issues that need to be addressed to attain sustainable development and protection in the host communities. Thus, this paper investigated host communities development and protection in the Nigerian petroleum industry. It argued that despite the innovative provisions for host community development under the PIA and other legal frameworks, host communities still face the problem of underdevelopment due to issues such as excessive control of the Host Community Development Trust (HCDT) Fund, non-compliance with host community obligations, forfeiture of host communities entitlement, excessive power of the settlor in constituting the Board of Trustee of the HCDT, communal clashes among host communities and conflict over Frontier Exploration Fund (FEF). The author observed that the problems faced by host communities have remained a long issue due to the prioritisation of profits over the sustainability of the host communities. It therefore concluded while profit maximisation in the petroleum industry is important, it should not be pursued at the expense of the host community development and protection. It recommended the review of the PIA and adequate implementation of the host community provisions under the PIA.

This paper applies quantitative stratigraphy to understand the pattern of coarse clastic sedimentary rocks. Sedimentary cycles in siliciclastic sequences can be detected and analyzed using a gamma-ray log to provide a series of measures associated with bed thickness. The variation in bed thickness gives a perfect identification of parasequences and their internal geometry on upward thickening or thinning, allowing the accurate identification of the sedimentary environment, facies, and system tracts in a sequence stratigraphy context. The pile-up pattern can then be analyzed using time series methods, like time scattergram (XY plots), Fischer plots, auto- and cross-correlation, and spectral analysis. The ratios among the various periods of the sedimentary cycles can be compared and associated with astronomical cycles in the band of Milankovitch, allowing the estimation of deposition time and accumulation rates. Besides, the results give an
excellent insight into the sedimentary processes of filling the sedimentary basin, sea level variation, and sedimentary flux. Using this analysis method, it is possible to identify fourth and fifth-order sequences (in the Exxon sense) that can be correlated locally. This application of quantitative stratigraphy allows for the correlation of third-order sequences. It may provide a way to compare locally identified sea level oscillation with the proposed global sea level variation curves. This methodology was developed by the LABCG - Laboratory of Basin Analysis and Geological Correlation - of the Faculty of Geology of UERJ - the University of the State of Rio Janeiro. As an illustration, examples of application are discussed for the Permian of the Parana Basin and the Barremian section of the Reconcavo Basin

Dikey kısıtlama çeşitlerinin bir türü olan yeniden satış fiyatının belirlenmesi, piyasanın farklı seviyelerinde yer alan teşebbüsler arasında vuku bulmakta olup zincirin üst seviyesinde yer alan bir teşebbüsün alt seviyede yer alan teşebbüse arzuladığı satış fiyatlarını dikte etmesidir. Minimum düzeyde satış fiyatının dikte edilmesi yasak kapsamında sayılmışken, maksimum düzeyde satış fiyatı bildirilmesi meşru görülmüştür. Ayrıca, süregelen davalar neticesinde içtihat göstermiştir ki; üreticinin yeniden satış fiyatını dikte etmesi, taraflar arası anlaşma akdedilmeden evvel, duyuru yapılması veya bildirilen satış fiyatlarının tavsiye niteliğinde olup herhangi bir dikte içermemesi hallerinde yasak kapsamında sayılmamıştır. İçtihatta uzun yıllar boyu per se yasak olarak kabul edilen yeniden satış fiyatının belirlenmesi, Leegin kararı sonrasında, yerini rule of reason analizine bırakarak bu analiz sonucu yeniden satış fiyatının tespiti meşru görülebilecektir. Yeniden satış fiyatının tespiti, ekonomik etkileri yönünden rekabetçi ve rekabeti kısıtlayıcı yönleri olmakla birlikte rekabeti kısıtlayan yönlerinin daha ağır niteliktedir. Ayrıca rekabetçi yönlerinden bir kısmı da ekonomiye etkileri açısından belirsiz ve tespit edilmesi güç konumdadır. Zira, her ne kadar, yeniden satış fiyatının tespitinin bedavacılık sorununa karşı bir çözüm sunduğu ileri sürülse de bedavacılık sorununun ekonomiye nasıl yansıdığına ve pazarı nasıl etkilediğine ilişkin hiçbir kanıt bulunmadığı doktrinde oldukça taraftar bulan bir görüştür. Her ne kadar tüketici refahının ucuzla nitelendirilmemesi gerektiği ileri sürülse de yeniden satış fiyatının tespitinin, piyasadaki fiyatların yükselmesine neden olur ve şişkin fiyatların tüketici refahına iyi gelmeyeceği aşikardır. Ayrıca, üreticinin dağıtıcılarına fiyat dikte etmesinin markalar arası rekabeti arttırmayacağı savunulabilir. Zira, minimum düzeyde satış fiyatı belirlenmesi sonucu söz konusu ürünün piyasadaki fiyatını artar ve bu durumun ürüne rakip diğer ürünlere karşı pazarda daha fazla öne çıkması yani rakip markalar arası rekabeti arttıracağı görüşünün teorik düzeyde kaldığı ileri sürülebilir. En kötü ihtimal ise monopol hakimiyeti altındaki bir pazarda yeniden satış fiyatı tespitidir. Monopol üreticinin bulunduğu sektörde monopol üreticinin yeniden satış fiyatını belirlemesi fiyatları fahiş düzeyde arttıracak olup bu durum tüketici refahını mutlak düzeyde olumsuz etkileyecektir. İşbu nedenlerden ötürü, yeniden satış fiyatının tespitinde Leegin kararına kadar süregeldiği gibi per se yasak olarak addedilmesi ve mutlak olarak rekabeti kısıtlayan bir durum olduğunun kabulü gerekmektedir.

Environmental protection and regulation will ever remain a recurrent need in human affairs given the importance of the environment to man's continuous existence and the impact of his activities on the natural environment as well. This reality has informed various coordinated attempts to balance the relationship between man and his natural environment, being his habitat. Following the enactment of the National Environmental Standards and Regulations Enforcement Agency (Establishment) Act 2007 (NESREA Act, now Cap N164, Laws of Federation of Nigeria 2010), a number of National Environmental Regulations have been made to give effect to the aim and objectives of the Act. However, with this plethora of regulations, the ugly trends of environmental abuses and the attendant challenges remain constant on the Nigerian landscape as if those regulations are not in existence. Adopting a doctrinal method, this paper interrogates the purposes of the extant national environmental regulations to determine the reasons behind their seemingly non-efficacious as opposed to the spirit of the NESREA Act from where they derive their lifeblood. The paper argues that the awareness creation about these regulations and their enforcements are generally poor and or weak on the part of NESREA that is statutorily saddled with the responsibilities. The paper concludes that NESREA, being the appropriate authority, should strengthen its enforcement mechanism and embark on serious environmental awareness creation especially among the rural dwellers who are more close to the natural environment.

Nigerians are poorly aware of their environment and the damages being done to it through their numerous activities either knowingly or unknowingly. Moreover, the constitution is the basic law of the land and it proclaims its supremacy over and above all other laws in the country and any law that is inconsistent with any of its provisions shall be null and void to the extent of its inconsistency. Although the National Environmental Standards and Regulations Enforcement Agency (NESREA) has good 33 National Environmental Regulations that cut across almost all sectors of human activities that can have negative effect on the environment, but their role is not felt in term of environmental management, conservation, protection and sustainability in the country due to inadequate awareness and enforcement. Atentando para a relevância do recurso energético "gás natural", para a abertura do mercado gasífero nacional promovida pela EC n° 09/95 e, ainda, para a ausência de uma lei específica que o discipline, o presente trabalho se propõe a analisar a atividade dutoviária de transporte do gás natural como monopólio natural, indústria de infra-estrutura econômica e bem de ordem essencial. Por possuir a referida atividade uma tendência natural à estruturação monopolista, o trabalho centra-se, também, na análise da regulação brasileira do livre acesso, prática concorrencial internacionalmente conhecida, e, ainda, na análise da viabilidade de sua inserção no atual cenário gasífero nacional. A região em estudo abrange uma área de 1300Km2, localizada nos arredores da cidade de Charqueadas, a oeste de Porto Alegre, Rio Grande do Sul. Nesta área se localizam as jazidas carboníferas de Charqueadas e de Santa Rita, esta última a nordeste da área. Objetivando a caracterização estratigráfica e paleoambiental destas jazidas, foram utilizados dados de testemunhos de sondagens das unidades Itararé e Rio Bonito (Bacia do Paraná), que serviram de base para a elaboração de mapas, seções de correlação, gráficos e análises de ciclicidade. Estes estudos possibilitaram a delimitação das unidades Itararé e Rio Bonito através de critérios sedimentológicos e paleontológicos como cor de pelitos, estruturas sedimentares e conteúdo palinológico. Η οριακή κατάσταση της ενεργειακής κρίσης που βιώνει η ελληνική –και όχι μόνο– αγορά ηλεκτρικής ενέργειας (στο εξής: η.ε.) και η προσπάθεια μετακύλισης του κόστους της τιμής της χονδρεμπορικής αγοράς του Χρηματιστηρίου Ενέργειας (στο εξής: ΕΧΕ), αποκάλυψε στο πρόσωπο του τελικού πελάτη τις δομικές παθογένειες και την εν γένει ανωριμότητα της ελληνικής απελευθερωμένης αγοράς η.ε. Οι προμηθευτές η.ε. έσπευσαν κατά το β΄ εξάμηνο του προηγούμενου έτους να μετακυλίσουν το κόστος της τιμής της χονδρεμπορικής αγοράς (δηλαδή της τιμής που προμηθεύονται η.ε. στο ΕΧΕ για λογαριασμό των πελατών τους) στους πελάτες, μέσω ρητρών αναπροσαρμογής του τιμήματος. Οι ρήτρες αναπροσαρμογής συνδέουν το τίμημα που καλείται να καταβάλει ο πελάτης για τις χρεώσεις ενέργειας με την Τιμή Εκκαθάρισης (ΤΕΑ – Market Clearing PriceMCP) της Προημερήσιας Αγοράς (Day Ahead Market-DAM), μέσω αλγοριθμικών τύπων, με χρήση μεταβλητών (αγνώστων), όπως η μέση μηνιαία ΤΕΑ και της αξιοποίησης κατώτατων και ανώτατων ορίων τιμών. Στην πραγματικότητα, ουδείς μπορεί εύλογα να αμφισβητήσει το δικαίωμα του προμηθευτή σε διαρκείς συμβάσεις αορίστου διάρκειας να αναπροσαρμόζει την αντιπαροχή του αντισυμβαλλόμενού του, στο πλαίσιο αποκατάστασης της τρωθείσας συμβατικής ισορροπίας. Όμως, το δικαίωμα αυτό πρέπει να ασκείται εντός του πλαισίου νομιμότητας και διαφάνειας που θέτει η οικεία νομοθεσία και δη η καταναλωτική (Ν. 2251/1994).
Εν όψει του γεγονότος ότι τόσο η τομεακή νομοθεσία της αγοράς η.ε. στην χώρα (Ν. 4001/2011), όσο και το μεγαλύτερο τμήμα της νομοθεσίας προστασίας του καταναλωτή είναι ενωσιακής προελεύσεως, θα πρέπει κανείς να εξετάσει και να κατανοήσει τα ενωσιακά κανονιστικά τους πρότυπα και την παραδεδεγμένη ερμηνεία τους από το Δικαστήριο της Ε.Ε. (στο εξής: ΔΕΕ) αναφορικά με την δυνατότητα και την μέθοδο αναπροσαρμογής των συμβάσεων προμήθειας ενέργειας (ηλεκτρικής ενέργειας και φυσικού αερίου). Σε ένα πρώτο μέρος, θα αναλυθεί το κανονιστικό πλαίσιο των ρητρών αναπροσαρμογής μέσω της εξέτασης της τομεακής νομοθεσίας (Οδηγίας 2019/944), αλλά και της νομοθεσίας προστασίας του καταναλωτή (Οδηγία 93/13 για τους καταχρηστικούς ΓΟΣ, Οδηγία 2011/83 για τα δικαιώματα των καταναλωτών, ιδίως στις εξ αποστάσεως συμβάσεις και συμβάσεις εκτός εμπορικού καταστήματος). Σε ένα δεύτερο μέρος, θα παρουσιασθεί η οικεία νομολογία του ΔΕΕ για τις ρήτρες αναπροσαρμογής του τιμήματος σε συμβάσεις δικτύου, δηλαδή ενέργειας και παροχής ηλεκτρονικών επικοινωνιών.

A bacia de Taubaté, uma depressão alongada na direção SW/NE e encravada entre as Serras do Mar e da Mantiqueira, é a que contém o mais espesso registro sedimentar aluvial-lacustre do Oligoceno, quando comparado com as bacias menores que compõem o denominado Sistema de Riftes da Serra do Mar. O seu subsolo já foi intensamente perfurado superficialmente por poços de prospecção hídrica e pontualmente por poucas perfurações mais profundas para avaliação do potencial de folhelhos betuminosos, pela Petrobras na década de 1960. Entre os métodos de investigação indiretos, geofísicos, que indicam a profundidade da bacia destacam-se a gravimetria realizada no passado e a sísmica realizada pela Petrobras na década de 1980. Portanto, em subsuperfície da bacia de Taubaté estão registrados importantes eventos geológicos no Oligoceno que podem também ser constatados, através dos poucos afloramentos. Durante muito tempo a estimativa de profundidade foi baseada nos dados gravimétricos e algumas modelagens geofísicas, bem como a estratigrafia construída com base em dados de afloramentos e poucas perfurações de poços de difícil calibração com a sísmica, o que permitiu assim a interpretação de um arcabouço litoestratigráfico pouco dinâmico para uma bacia rifte. Porém, a partir de uma análise integrada entre os dados sísmica 2D (Petrobras) e dados recentemente adquiridos através de projeto de pesquisas UFRJ/FINEP/Petrobras tais como, aeromagnetometria de alta resolução de toda a bacia, dados obtidos de perfilagem de dois poços profundos, com embasamento a 750-850m de profundidade, de descrição de mais de 1.500m de testemunhos contínuos desses poços, análises petrográficas e palinológicas, comparados com a geologia de superfície, foi possível reinterpretar os eventos geológicos e melhor caracterizar a arquitetura deposicional das principais seqüências estratigráficas que preenchem a bacia de Taubaté (seqüências sismícas com as suas sismofácies); caracterizar seus sistemas deposicionais e suas variações laterais de fácies. Com o entendimento deste arcabouço arquitetural reproduziu-se a história evolutiva mais atualizada e dinâmica para esta bacia terciária e suas relações e correlações geológicas com os principais eventos geológicos regionais, que ocorreram no sudeste brasileiro durante o Terciário.

O delta do rio São Francisco é uma planície arenosa de idade quaternária construída em um baixo estrutural da bacia de Sergipe-Alagoas, conhecido como Baixo do São Francisco. O limite interno do delta do São  rancisco é marcado por escarpas retilíneas, que o separam da Formação Barreiras adjacente e possuem traçado coincidente com importantes falhas do arcabouço estrutural da bacia de Sergipe-Alagoas. Resource nationalism" is a cyclical phenomenon whereby governments assert varying degrees of control over natural resources located within their territories, in an attempt to maximise revenue generation from their national resources. Resource nationalism often depends on the price of hydrocarbons and the ability of national governments to extract them. International oil companies are attractive partners for the development of concessions as they have advanced extractive technology, superior project management skills, flexible logistical chains and access to capital from global financial markets. However, these advantages will erode as National Oil Companies (NOCs) improve their expertise over the mid-to long-term and new forms of resource nationalism may restrict their room for manoeuvre.The recent trends in most of oil producing countries' policies are focusing on highly increasing the fiscal levies imposed to resources exploited under the concession agreements and also on imposing minimum labor taxes. At the end of 2014, The Romanian Government will have to reappraise the fiscal systems for the companies operating in the national oil and gas upstream sector, because the 10-year "freezing" of royalties on oil and gas, at a very low level compared with other producing countries will come to an end. This article tries to present the trends in the international petroleum fiscal regimes worldwide, to make a comparative analysis between Romania and other countries from this point of view and finally to make some recommendations as regards the main guidelines that the negociators could follow in order to obtain better conditions for the new fiscal regime and implicitly a better turning into account of our natural resources to the benefit of the consumers.

This article discusses the decision of the Supreme Court of Nigeria on the constitutional provision dealing with the sharing of revenues derived from natural resources located within the states of the Federation, the 'derivation principle.' Although the case relates to the interpretation of a constitutional provision, the arguments of the parties suggest that the real battle was-and still is-about the ownership and control of Nigeria's offshore oil. The article details the legal history and precedents as well as constitutional provisions relevant to the case. Disagreements arose over legal questions such as the seaward boundaries of littoral states (from which oil revenues are derived), and whether a distinction can be made between offshore and onshore oil revenues in applying a 13% constitutionally prescribed derivation principle. The article shows that, in its judgment, Nigeria's Supreme Court relied heavily on rules of international law, while failing to apply existing Nigerian laws and constitutional provision, and argues that the decision might have been different had the court investigated and invoked the legislative history of the provision in question, as required in Nigerian law. Furthermore, it is argued that the court was wrong to disregard the provision of the law which had abolished any distinction between onshore and offshore natural resources in the application of the derivation principle. The article concludes that the legal tug of war is set to continue for some years.

Resumo Propósitoexplicar a ausência de vigência social da Emenda Constitucional nº 9/95 e da Le nº 9.478/97, no que diz respeito à promoção da competição no segmento de refino de petróleo no Brasil. Resultados-Análise da evolução dos principais indicadores do mercado sugere que a alteração dos marcos legal e regulatório não foi suficiente para criar um ambiente favorável à livre competição nesse segmento da indústria. Mais do que isso, aumentou o desalinhamento entre preços internos e preços internacionais, o que pode ser interpretado como um caso de conformidade negativa. Implicações práticas-Estudo aponta para a necessidade de superar problemas institucionais, que constituem fatores de insegurança jurídica e elevam os riscos para os investidores privados. Originalidade/relevância do texto-Utiliza a abordagem institucional para explicar a ausência de vigência social do marco regulatório que pretendia assegurar a livre competição no segmento de refino de petróleo no Brasil. This paper compares three methods for natural gas dehydration that are widely applied in industry: (1) absorption by triethylene glycol, (2) adsorption on solid desiccants and (3) condensation. A comparison is made according to their energy demand and suitability for use. The energy calculations are performed on a model where 10 5 Nm 3 /h water saturated natural gas is processed at 30 • C. The pressure of the gas varies from 7 to 20 MPa. The required outlet concentration of water in natural gas is equivalent to the dew point temperature of −10 • C at gas pressure of 4 MPa.

El objetivo de este artículo es presentar un análisis estadístico de la calidad de la regulación de la industria eléctrica colombiana, basados en una clasificación económica de las resoluciones emitidas por la Comisión de Regulación de Energía y gas Creg. O gás natural (GN) se transporta em gasodutos pela diferença de pressões. A pressão vai se perdendo à medida que o gás natural flui, devido à fricção com as paredes do dutos e à perda de calor. Assim, a pressão deve ser restaurada para continuar com a movimentação. As estações de compressão (EsC), que são instalações do gasoduto formadas por baterias de compressores (centrífugos), têm o papel de devolver a pressão ao GN, consumindo parte do gás transportado, originando desta forma custos de transporte. Sabe-se que da ordem de 50% dos custos operacionais dum gasoduto correspondem ao consumo do GN nas EsC. Portanto, é de interesse determinar o funcionamento das estações, de forma a minimizar o custo do combustível no gasoduto. Sendo assim, o objetivo do presente trabalho é adaptar um algoritmo já existente, que encontra a vazões e pressões de uma rede de gasodutos, onde os dutos não se consideram capacitados. Em particular, considera-se neste trabalho uma extensão do problema, para gasodutos com limite de capacidade. Para o desenvolvimento do trabalho, utilizamos o ambiente Matlab para programação dos algoritmos. O método de resolução do problema em questão é o Método de Newton-Raphson, que consiste em construir um modelo linear da função e buscar um zero do modelo linear, esperando que este seja o zero da função original; caso não seja, faz-se a linearização sucessivamente até que a raiz seja encontrada. Até o momento, foi desenvolvido um código em Matlab-usando como referência redes da literatura-que encontra vazões mássicas de GN e pressões para uma rede sem estações de compressão. Os resultados da utilização do algoritmo já desenvolvido têm sido bastante satisfatórios, já que o mesmo tem bom comportamento e mostra os resultados esperados.

The Oil and Gas Special Task Force (SKK Oil) is a government agency responsible for controlling and supervising upstream oil and gas businesses. This study aims to examine the legal position of SKK Oil as the executor of national upstream oil and gas business activities and its role in promoting national energy security. The research utilizes an empirical juridical legal research method with qualitative research specifications, providing a focused and in-depth analysis of the subject matter. Secondary data obtained from primary, secondary, and tertiary legal sources are used in this study. The findings reveal that the National Oil and Gas Management Policy has not fully aligned with the goal of achieving national energy security.

Oil and Gas Exploration has increasingly become the major source of revenue of the Federal Republic of Nigeria, since 1956, when oil was first discovered in commercial quantities. However, this same ‘source of blessing’ is also very rich in pollution. Oil pollution is one of the greatest environmental problems Nigeria is currently battling with, especially in the Niger Delta zone. The government has been virtually helpless, or comatose, with an array of legislations which are best described as ‘aesthetic surplusage’ on the country’s law books.

This essay will basically examine oil pollution, the historical background to oil exploration and consider the various legal frameworks put in place to curb environmental pollution by way of oil pollution.  The essay also delves into the evil of oil spillage facing the Nigerian environment, its causes, and its consequences. We would analyse whether the laws are adequate in controlling environmental pollution.

A sound research approach was utilized in this essay. In carrying out this research recourse was had to relevant publications including legislations, treaty obligations ratified by Nigeria, textbooks, journals, magazines, decisions of courts, internet materials and articles in newspapers relating to the topic of the research. Materials were also sourced from papers presented at seminars and conferences.

This essay is all about charting a new course in the way of control and regulation of oil pollution in Nigeria, in order to ensure environmental sustainability. It identifies the constraints to the effective implementation of Nigeria’s environmental laws and policies. After identifying the various problems contributing to our environmental woes, this essay proffers recommendations that should be conscientiously and vigorously implemented to reverse the trend.

This study is on the impact of pipeline transportation and vandalization on economic development in Ikwerre Local Government Area of Rivers State. Pipeline transportation is the preferred means of transportation of petroleum products in Nigeria. Significantly, this mode of transporting petroleum products has also become a major source of concern in that it appears to negatively affect the economic development of communities in the Niger Delta region. The study therefore, explores the impact of pipeline vandalization on economic development of Ikwerre Local Government Area. The methodology is qualitative. Data for the study is sourced from text books, newspapers, magazines, journals, periodicals, and documented materials. Sendo assim, o objetivo do presente trabalho é adaptar um algoritmo já existente, que encontra a vazões e pressões de uma rede de gasodutos, onde os dutos não se consideram capacitados. Em particular, considera-se neste trabalho uma extensão do problema, para gasodutos com limite de capacidade. Para o desenvolvimento do trabalho, utilizamos o ambiente Matlab para programação dos algoritmos. O método de resolução do problema em questão é o Método de Newton-Raphson, que consiste em construir um modelo linear da função e buscar um zero do modelo linear, esperando que este seja o zero da função original; caso não seja, faz-se a linearização sucessivamente até que a raiz seja encontrada. Até o momento, foi desenvolvido um código em Matlab-usando como referência redes da literatura-que encontra vazões mássicas de GN e pressões para uma rede sem estações de compressão. Os resultados da utilização do algoritmo já desenvolvido têm sido bastante satisfatórios, já que o mesmo tem bom comportamento e mostra os resultados esperados.

Indonesia's oil and gas governance has been specified in certain laws. The first oil and gas law was Emergency Law No. 44 of 1960. This law was changed to Law No. 8 of 1971 which gave a dual function, namely to Pertamina National Oil Company (NOC), as an operator and regulator. Meanwhile, the function of policy making was carried out by the government. These two functions are known as "two feet." Furthermore, with the promulgation of the Oil and Gas Law No. 22 of 2001, there was a separation of regulatory functions by Pertamina and giving them to state institutions known as BP Migas. The agency was later converted into two different institutions, SKK Migas for regulating upstream oil and gas and BPH Migas for downstream regulation. These functions are known as 'three feet'. However, the Oil and Gas Law No. 22 of 2001 received a lot of criticism, because this law was considered too liberal and put Pertamina as a NOC to compete openly with the International Oil Company (IOC) which was considered to have more good advantages in technology, capital, and risk management. The existing Oil and Gas Law has caused prolonged stagnation in the national oil and gas industry, and reduced the performance of this strategic industry in terms of lifting, exploration, exploitation and oil production. This study is intended to provide a description regarding the various design concepts of oil and gas law governance by referring to the oil and gas management and performance models in various countries and IOC. Furthermore, this study empirically offers a comparison of the NOC model in managing oil and gas, and the advantages and disadvantages of institutional selection over the oil and gas administration

Illegal wildlife trade and wildlife trafficking are global environmental risks which is underscored not just by its convergence with other serious crimes but by the cross-border and trans-boundary nature of the crime, and its implications in many global health problems. The COVID-19 crisis, currently estimated to have been contracted from bats by humans through an intermediate host such as a pangolin, has propelled the global health implications of wildlife trade onto the global stage, thereby questioning global and national environmental governance structures to combat illegal wildlife trade and trafficking.
