Abstract

Decoding the Labour Codes provides a comprehensive analysis of India’s four new labour codes enacted in India between 2019 and 2020: The Code on Wages, 2019, The Industrial Relations Code, 2020, The Code on Social Security, 2020 and The Occupational Safety, Health and Working Conditions Code, 2020. These reforms aim to consolidate 29 existing labour laws into a simplified, streamlined framework. This book critically assesses the implications of these changes on workers, employers, and the broader industrial ecosystem. Consolidation vs. Dilution: While the codes are presented as simplification, the book argues that they dilute core protections, particularly those related to job security, union rights, and enforcement mechanisms. Workers’ Rights at Risk: The new framework raises thresholds for standing orders and retrenchment permissions, potentially excluding a large segment of the workforce from protections. Social Security Expansion with Gaps: Although the Social Security Code aims to cover gig and platform workers, the implementation framework remains unclear and underdeveloped.
