After discussing some general issues concerning the notion of metaverse and the alleged radical changes it is supposed to bring about in IT and our life, we will focus on the opportunities and risks offered by the combination of neurotechnologies and the immersive virtuality of the metaverse.

According to Aristotle, the epistemological level of oratory is provided by doxa, that is, opinio... more According to Aristotle, the epistemological level of oratory is provided by doxa, that is, opinion. The premises from which the orator should develop his reasoning are reputable opinions (endoxa). The aim of the chapter is to show that the Aristotelian approach to doxa is useful to shed light on the contemporary debate on the role of science and scientific evidence in the courtroom and, more specifically, on the judiciary construction of science. As test bed, I will consider a widely debated case decided by the US Supreme Court, namely Daubert v. Merrel Dow Pharmaceuticals Inc. The claim is that the Court has developed its argumentations and reached its conclusions by remaining on an opinion based (doxastic) level and that this is precisely what is proper to judicial decision-making.

La relazione di complementarietà tra giustizia riparativa e giustizia penale tradizionale disegna... more La relazione di complementarietà tra giustizia riparativa e giustizia penale tradizionale disegnata dal d.lgs. 150/2022 pare supporre una vera e propria svolta culturale. Al contempo, la possibilità di tale convergenza fra due modelli di giustizia penale spesso pensati come antagonisti, solleva la questione di quale sia l’orizzonte teoretico in cui si inscrive questa loro relazione e quali ne siano le condizioni di possibilità. Per fare chiarezza su questi aspetti, che traspaiono nel testo licenziato dal legislatore, il contributo propone un confronto con il plesso delle categorie hegeliane di reato, pena e giudizio, la cui portata va ben al di là della logica retributiva.

Viene proposta una rilettura della trattazione del problema della giustizia nella Repubblica e viene tracciato un parallelismo con la dialettica della soggettivit\ue0 sviluppata nella Fenomenologia. Alzheimer's and freedom of health care Human, all too human "As far as is known, AD is a distinctly human disease; although limited AD pathology (…) has been reported in brains of nonhuman primates (…), there is no evidence for an equivalent, fullhuman species" (Rapoport, 1992: 88). Although these words were written by Rapoport more than twenty years ago, they still seem appropriate to put into light one of the most dramatic (AD). Beyond its neurological profile, AD is a specifically human disease, insofar as it affects what is considered specifically human, that is those functions and capacities, like language, memory, or conscious self-determination by means of which the hu distinguished itself from other species. If there is a specific human way to be aware-and therefore to communicate and to AD is one of its most devastating forms of erosion and decay. Patients progressively lose their memory in all its aspects and components (Gambina, 2008). Therefore, they do not lose only their capacity to retain or to recall who they were and what they were like, but they also lose the capacity of thinking of themselves as the subject, the main character of a narrative which develops in time, and which is articulated into past, present and future. This capacity of putting things and themselves in a temporal order, which is a structural feature of our awareness, has been recognised as a specific trait of intelligence since Aristotle 1 .

The topic of the paper is the relationship between scientific knowledge and legal practice. The c... more The topic of the paper is the relationship between scientific knowledge and legal practice. The claim is that an epistemological transformation takes place in trial, through which scientific categories are reshaped according to the goals of the jurisdiction. Doxa, that is, opinion, provides the ground for this transformation, thanks to its own epistemological and methodological features that are functional to the purpose of trial. This claim is supported, on the theoretical level, by calling into play Aristotle's 'Rhetoric', and on the practical level by rereading the well-known and widely debated Daubert case.

Infatti, vi è un numero sempre più crescente di studi nei quali la possibilità stessa che si dia per l'uomo qualcosa come il diritto viene intesa come il portato del processo evolutivo e del conseguente codificarsi e sedimentarsi nel cervello umano dei principi giuridici fondamentali. Il contributo si confronta criticamente con questa visione naturalizzata del diritto e, più in generale, dell'uomo, utilizzando gli studi sulla coscienza condotti da alcuni eminenti neuroscienziati. Abstract: The possibility of using neurodevices to treat criminal offenders, as a means of volunt... more Abstract: The possibility of using neurodevices to treat criminal offenders, as a means of voluntary diversion to avoid incarceration, has become a widely discussed topic in the last decade. A widely debated issue concerns the right to control or alter the neu- rological patterns of criminal offenders, provided that punishing implies limiting one’s autonomy also without their consent. On the one hand, mandatory neurointervention is not only meant to be a lesser evil than incarceration, but it is even supposed to be advantageous for criminals because it can allow to restore their decisional autonomy by inhibiting their criminal impulses. On the other hand, mandatory neurointevention is rejected because it is considered to inflict significant harm on an offender, which goes far beyond the limits of criminal punishment. Some scholars have argued that the issues at stake call for a resemantisation of notions like mental integrity, freedom of thought, and cognitive liberty. My aim is to show that this resemantisation cannot preserve the specificity of legal categories if it is not set free from the naturalistic background, which underpins the uses of neurocorrection tools, in order to preserve the specificity of legal categories. For this purpose, I will analyse, in particular, some arguments offered by J.C. Bublitz.

The neurotechnological devices that are in use today are no longer only directed to monitoring br... more The neurotechnological devices that are in use today are no longer only directed to monitoring brain activity. They are used both to intervene on brain activity in order to modify it and to decode it in order to transform it into usable and reproducible signals. The new kind of man-machine connection that has been created, based on electro brain activity, is going to have a deep impact on legal categories. This paper focuses on the notion of mental integrity and the changing of its semantic field. The current debate on personal identity and autonomy of Deep Brain Stimulation patients provides the guiding thread. The possible philosophical background of the issues at stake is outlined in the conclusion
Patients with life-threatening illness experience both physical pain and personal suffering, with... more Patients with life-threatening illness experience both physical pain and personal suffering, with physical pain being normally circumscribed within the body of the patients’ and personal suffering reverberating also on the network of their personal relationships. Both of them can cause loneliness, in particular the so-called existential loneliness. This contribution focuses on the conditions that make it possible to experience this kind of loneliness as well as the theoretical issues that it raises, and outlines an ethical perspective for the caring of these patients.

Thus, it is possible to intervene on brain activity in order to modify it and to transform it into usable and reproducible signals. This new kind of man-machine connection is going to have a deep impact on legal categories. This paper focuses on the notion of mental integrity and the consequent changes within its semantic field. What provides the guiding thread is the current debate on personal identity and autonomy of Deep Brain Stimulation patients. The conclusion outlines the possible philosophical background of the issues at stake.
