The contribution is aimed at reassessing the relationship between an edictum by Claudius, documen... more The contribution is aimed at reassessing the relationship between an edictum by Claudius, documented in D. 48.10.14.2, D. 48.10.15pr., D.48.10.22pr., C. 9.23.3, and a senatus consultum by Nero, mentioned in Svet. Nero 17, both dealing with the insertion of a provision in one's favor into the testament of someone else. The reliability of the information regarding these interventions is examined by taking into account doubts expressed by some scholars thereof and finally, possible reasons for subsequent legislative measures on the same topic are outlined.

This contribution examines §3 of the athenian decree on weights an measures from the end of the 2... more This contribution examines §3 of the athenian decree on weights an measures from the end of the 2nd century BC (IG II² 1013) where the use of a new volume measure is ordered, and especially its §4, where the market weight of the mna is altered, attempting to clarify its legal aim and economic implications. So far, this reform has been discussed by some historians as a matter of confrontational economic policy. Examining the relation among roman and athenian weight units, it is argued that this law led to an easier convertibility among units, facilitating commerce among territories familiar with either notation, reducing transaction costs as defined by Douglass North. The interpretation of the decree in a protectionist manner of Rome against Athens is contrasted with the proposition that it might be better understood as a pragmatic regulation achieving harmonization by standardization

This contribution aims to investigate the initial rows of the attic decree on weights and measure... more This contribution aims to investigate the initial rows of the attic decree on weights and measures dating from the end of the second century B.C. (IG II 2 1013). The analysis mainly focuses on the integrations proposed in some of the editions of the ψήφισμα and will try to verify their plausibility from the juridical viewpoint of legal history. Particular attention is dedicated to the reconstruction of the lost lines of the decree, to the application of the ἀπαγωγή against those who act fraudulently in connection with weights and measures on the marketplace, and to the various sanctions directed towards free individuals as well as slaves. Remembering Aldo Cenderelli On December 12, 2011 an event to remember the late Professor Aldo Cen... more Remembering Aldo Cenderelli On December 12, 2011 an event to remember the late Professor Aldo Cenderelli (19372009) was held at the University of Milan-Bicocca. The presentation of his so called scritti minori 1 served as an occasion for friends, colleagues and loved ones to remember the Maestros work and life not only scientifically, but also emotionally and above all, joyfully, as he himself would have wished. During the first part of the session, presided by Professor Alberto Maffi, Professor Bruno Bosco, Dean of the faculty, reminded the audience of the vital role Prof. Cenderelli had in the organization of the second course of studies in law and in the successive creation of the center of studies of the University Bicocca. Prof. Bosco mentioned in particular the passion and enthusiasm and, at the same time, the mature guide and wisdom with which Prof. Cenderelli coordinated the regulation and structure of the departments of the University, a passion which accompanied Prof. Cenderellis activities even after the center was founded, when he took over the function of department coordinator for many years to follow. Prof. Bosco also remembered the respectful and nevertheless affectionate relationship the Professor had with his students, of which we as his scholars continue to have various testimonies and spontaneous memories. Then Prof. Carlo Augusto Cannata, who was tied to Prof. Cenderelli by a long and profound friendship, rose to speak, sharing some of the defining moments of Prof. Cenderellis academic career with the audience, beginning with his time of study at the University of Milan. The two Maestros encountered each other for the first time during the lectures on exegesis of the sources of Roman law held by Prof. Giovanni Pugliese. In this course, characterized by its seminarlike structure, the young Cenderelli, who was a regular attendant, acquired the taste for exegesis which would characterize all of his career from then on. Of Prof. Cenderellis career as a student, his colleague would remember the capacity to give exams like a machine, almost always conquering the maximum vote as well as his diploma thesis under the guide of Prof. Gaetano Scherillo, who, in the years to follow, was to become his Maestro. And of course Prof. Cannata honored the passionate interest Prof. Cenderelli held not only for the law, but also for philology, becoming ever more evident in many of his works.

La ricerca ricostruisce il contributo dell' attività normativa imperiale alla definizione e all' ... more La ricerca ricostruisce il contributo dell' attività normativa imperiale alla definizione e all' evoluzione del crimen falsi tra il I secolo d.C. e l' epoca severiana. La prima parte del volume è dedicata alla ricognizione e alla catalogazione di tutte le testimonianze conservate nelle fonti giuridiche espressamente attestanti interventi imperiali in tema di falsum. Nella seconda parte è svolta un' esegesi delle constitutiones principum individuate, con una particolare attenzione agli interventi, relativamente numerosi, in tema di sibi adscribere in testamento alieno, di falsificazione e di uso di instrumenta falsa e di falso nelle relazioni commerciali; un' ultima sezione del lavoro è infine dedicata agli altri casi di falso di cui le fonti forniscono notizia di interventi imperiali.
The research reconstructs the contribution of the imperial normative activity to the definition and evolution of the "crimen falsi" between the first century A.D. and the Severian age. The first part of the volume is dedicated to the reconnaissance and cataloguing of all the evidence preserved in the legal sources expressly attesting to imperial interventions about "falsum". In the second part, an exegesis of the "constitutiones principum" identified is carried out, with particular attention to the relatively numerous interventions on the subject "sibi adscribere in testamento alieno", falsification and the use of fake and "instrumenta falsa" in commercial relations; a final section of the work is dedicated to the other cases of falsum of which the sources provide information on imperial interventions.

El propósito de la obra es generalista y pretende abarcar un campo amplio de conocimientos y punt... more El propósito de la obra es generalista y pretende abarcar un campo amplio de conocimientos y puntos de vista sobre los principios generales del derecho. Por eso, junto a una mayoría de romanistas, intervienen también catedráticos de filosofía del derecho, de derecho tributario, de derecho comparado, de derecho civil, de derecho internacional y ex magistrados del Tribunal General de la Unión Europea. Esta multitud de autorías polícromas, unida a la extensión casi inagotable de la propia problemática de los principios generales del derecho, ha exigido una distribución de materias provista de la tensión estructural presente en obras de esta naturaleza. Así, un buen número de los artículos aquí recogidos tratan de forma monográfica sobre principios jurídicos concretos -reunidos por orden alfabético en la parte tercera del libro-, pero incluso en ese grupo aparentemente más compacto se abordan las investigaciones con criterios y perspectivas tan diversas y distantes entre sí como lo pueden ser, por un lado, el método historiográfico del «higher criticism» sobre las fuentes primarias del derecho romano o, por otro, el examen epistémico -a forma de escalpelo-de la jurisprudencia actual. Con todo, el coordinador ha estado atento a la pretensión de componer un discurso general no tanto sistemático como lógico en la presentación de los asuntos tratados por los autores.

The research reconstructs the contribution of the imperial normative activity to the definition and evolution of the "crimen falsi" between the first century A.D. and the Severian age. The first part of the volume is dedicated to the reconnaissance and cataloguing of all the evidence preserved in the legal sources expressly attesting to imperial interventions about "falsum". In the second part, an exegesis of the "constitutiones principum" identified is carried out, with particular attention to the relatively numerous interventions on the subject "sibi adscribere in testamento alieno", falsification and the use of fake and "instrumenta falsa" in commercial relations; a final section of the work is dedicated to the other cases of falsum of which the sources provide information on imperial interventions.
