Chapters consider the fundamental question of what constitutes a good judge, delving into the emerging field of virtue jurisprudence and exploring its connections to virtue ethics. W konsekwencji w centrum rozważań autorów poszczególnych rozdziałów znajduje się pojęcie cnót moralnych i intelektualnych. Poprzez sposób orzekania i pełnienia swej służby sędziowie na co dzień kształtują „żywe prawo” takie, jakim ono staje się w powszechnym odbiorze obywateli i innych interesariuszy wymiaru sprawiedliwości. Autorzy tej książki nie mają co do tego faktu wątpliwości, zwracając uwagę na szerokie spektrum aspektów wykonywania zawodu sędziego, które umyka kategoriom oceny czysto prawnej lub wyłącznie etyczno-zawodowej. Być dobrym sędzią znaczy więcej niż postępować legalnie oraz nie przekraczać skodyfikowanych i zastanych norm etycznych.

In this monograph, the author attempts to reconstruct Hans Kelsen's theory and philosophy of inte... more In this monograph, the author attempts to reconstruct Hans Kelsen's theory and philosophy of international law. It includes not only the analysis of the claims of his Pure Theory of Law in the context of international legal problems. The reader also has the opportunity to learn the normative and critical postulates and views of the less-known Kelsen - a philosopher of law and politics, whose predictions as to the directions of development of international law proved to be surprisingly accurate. The book undermines the widespread view of the uselessness of the allegedly ossified, hierarchical concept of Kelsen's legal system for solving contemporary problems of structural and normative transformations of international law. Kelsen's theory and philosophy of international law can be successfully applied to describe and explain phenomena, such as its "fragmentation" and the phenomenon of "global law". The book was written for two groups of readers. First of all, it is addressed to the people who are interested in theory and the philosophy of law. Secondly, its addressees are also specialists having detailed knowledge of international law and international relations, who are looking for a more general philosophical reflection.

The purpose of this book is to reconstruct the concept of “international community” and to provid... more The purpose of this book is to reconstruct the concept of “international community” and to provide a general picture sketched from the perspective of a bird’s-eye view of the theory and philosophy of international law. The aim is not so much to define international community but rather to attempt to understand the phenomenon in its wider normative, historical, cultural and socio-political context. Thereby, the book draws the reader’s attention to the significance of an issue generally neglected by the science of law as well as to the relation of the notion with the array of crucial problems of international law. The title reflects the conviction, that the process of constitutionalization of international law is convergent with the advancement of pluralist international society towards a true solidarist community.

This article seeks to develop a case for a virtue-oriented (or aretaic) approach to the criteria ... more This article seeks to develop a case for a virtue-oriented (or aretaic) approach to the criteria for appointing judges. It will argue for the usefulness of judicial virtue by showing its theoretical relevance for describing and explaining the criteria for selecting judicial candidates and claiming its advantage over the currently used syncretic sets of criteria used in European jurisdictions. The analysis will explore the connection between the criteria of judicial selection and the Rule of Law. If the Rule of Law is to be understood at its core as a process of tempering the arbitrariness of power, it requires certain personality traits of character on the part of the judiciary. This article argues that virtue is a context-relevant concept well-entrenched in legal culture that amounts to a personality aspect of the Rule of Law. In support of this point, the article discusses the two possible methods of establishing judicial virtues-using a targeted approach to virtue and an Aristotelian-inspired method of uncovering a catalogue of judicial virtues from the insights into the legal culture. The article concludes with policy-oriented advice on incorporating a virtue-centred approach to judicial selection processes.

Przedmiotem rozważań jest normatywny wymiar sędziowskiego nieposłuszeństwa (judicial disobedience... more Przedmiotem rozważań jest normatywny wymiar sędziowskiego nieposłuszeństwa (judicial disobedience) i oporu (judicial resistance). Zjawiska te obejmują zagadnienie konfrontacji sędziowskich decyzji orzeczniczych z problemami niemoralnego, niesprawiedliwego lub niepraworządnego prawa, niejednokrotnie wynikającymi z systemowego działania pozostałych dwóch władz. W związku z tym, w doktrynie podejmuje się rozważania, czy istnieje prawo bądź obowiązek sędziowskiego oporu. W tym rozdziale podniesiono, że opór sędziowski interpretowany zarówno jako prawo jak i obowiązek budzi zastrzeżenia. Powodem jest nieadekwatność dominujących w teorii prawa modeli normatywnych zorientowanych na reguły (deontycznego i konsekwencjalistycznego), na których opierają się kategorie praw i obowiązków, dla opisania i uzasadnienia oporu sędziowskiego. Zamiast tego zaproponowano argumentację na rzecz modelu opartego o charakter moralny sędziego, który wyjaśnia opór sędziowski jako działanie wynikające z cnót (takich jak odwaga, uczciwość, sprawiedliwość) zamiast z norm. W rozdziale przedstawiono w jaki sposób podejście aretyczne wyjaśnia szczególne cechy oporu sędziowskiego, takie jak supererogatoryjny charakter decyzji o stawieniu oporu czy problem oceny sędziów niestawiających oporu.

This article considers the meaning of trust for judicial communication. The central tenet of this... more This article considers the meaning of trust for judicial communication. The central tenet of this analysis is that trust is best conceptualized as a judicial virtue and that it can be most fully explained with aretaic language. This claim is elaborated through, first, making distinctions between trust and reliance, as well as between trust and trustworthiness. Second, exploring the determinants of trustworthiness leads the author to argue for a virtue account of judicial trustworthiness. Third, the article discusses whether and how trust as a particular attitude or propensity may be perceived as a judicial virtue. The argument concludes by considering the relation between trust in judges and trust in justice institutions, such as courts of law.

This essay proposes that one of Professor Janusz Gilas’s most notable achievements is the develop... more This essay proposes that one of Professor Janusz Gilas’s most notable achievements is the development of community-oriented thinking in Polish international legal scholarship. His use of the term “international community” is not merely figurative and does not boil down to distinguishing another doctrinal concept. The article further develops the legal debate around the concept of the international community by proposing that it should be grounded in philosophical and political communitarianism. After briefly discussing Gilas’s contribution and its theoretical underpinnings in the form of the sociological theory by Ferdinand Tönnies and the achievements of the English School of international relations, this article undertakes to present communitarianism as a social and political philosophy and its relation to the concept of the international community, its theoretical alternatives, and their base values. Having clarified the possible communitarian interpretation of the international community, the author turns to the question of the possibility of communitarian international law. The article concludes by reinterpreting the thesis that international law is viable and conceivable only as community law, oriented toward the common good.

The article contrasts the image of the maladaptive fragmentation of international law with polyce... more The article contrasts the image of the maladaptive fragmentation of international law with polycentrism as the new legal model of the unitas multiplex of international law. Whether international law is seen as fragmented or polycentric, hinges on the way it is cognised and understood by lawyers, and how its unity and normativity are justified. The vehicles of international law's structural resilience are the intellectual (ontological, epistemological, methodological) tools at the disposal of lawyers and legal scholars. However, the dominating meta-theories in legal scholarship: sovereigntism, universalism and systems theory are short of explanations maintaining the adequate unity of the system. The article explains how a Kelsenian mindset may be used to clarify the structure of the polycentric legal order. By utilising the idea of the purity and normative unity of law, the Neo-Kelsenian narrative reconnects different rationalities of public and private governance in one system of international law qua global law.

This article offers an analysis of the meaning of the term ‘world state’ (Weltstaat) as used by H... more This article offers an analysis of the meaning of the term ‘world state’ (Weltstaat) as used by Hans Kelsen in his work on international legal theory. The author argues that Kelsen understands the term solely as a legal concept. Reconstruction of Kelsen’s understanding of the notion of world state begins with a summary of Kelsen’s reductionist doctrine of the state and its identity with law. Secondly, the analysis moves to Kelsen’s radical deconstruction of sovereignty. Thirdly, Kelsen’s doctrine of evolution of legal orders along the axis of centralization is considered. These considerations lead to the assertion that Kelsen’s Weltstaat shows in fact more affinity with the concept of the international community rather than a fully-fledged state. The article concludes that Kelsen’s world state is only a theoretical possibility, a stage in the evolution of legal orders and a common point of imputation rather than a manifestation of any cosmopolitan agenda.

This essay claims that the discussion on the possible recognition of androids as moral agents and... more This essay claims that the discussion on the possible recognition of androids as moral agents and bestowing them with capacities of legal personality is premature and speculative. Yet, androids based on current narrow artificial intelligence (AI) technologies still seem to be morally significant for humans. This is due to their impact on the choices and moral condition of human users rather than because of their presumed capacity for moral or legal perpetration. As a result, robot ethics and robot law should not concentrate too much on the abstract rules of behaviour for machines, as current technology is generally incapable of their meaningful interpretation in particular circumstances. What is advocated instead is a “virtuous robotics” approach. It emphasizes the moral responsibility of the human agent for the development and usage of AI in line with positive personal life goals and the general flourishing of individuals.

Short essays about well-known historical events and precedential court judgements, used by the authors as the basis for questions about contemporary interpretation and application of law, especially in the context of hard cases, are a modern method to share knowledge of law. The ‘SEA-SEE PERSPECTIVE ON LAW’ e-book remains faithful to the past, but also teaches young lawyers to wisely follow new paths. The e-book contains standard elements of communication, enhanced with a new, interactive medium and virtual world of the Internet. Academics in the Faculty of Law have created a new way to communicate with students: combining the features of traditional university books with advantages of Internet communication.

The article explores Hans Kelsen's theory of just war (bellum justum). It addresses the question ... more The article explores Hans Kelsen's theory of just war (bellum justum). It addresses the question of how and why the leading modern positivist thinker in fact embraced a key natural law theory, the concept of just war. In exploring this question, it collates the Viennese philosopher's views with those of Polish late Middle Ages philosopher and lawyer, Paulus Vladimiri, who developed his own version of the bellum justum doctrine. In the first step, an outline of Paulus Vladimiri's views on just war is presented. Secondly, the article offers an overview of two key theses of Kelsen's theory of international law in order to provide the necessary context for his use of the term bellum justum. Next, the analysis moves to answering the question of whether Kelsen's position might in fact be described as naturalist. In the last part, the article adds to some criticism of Kelsen's use of the term "just war". The conclusion underlines the points of intersection between the two doctrines. Although Kelsen's attempt to harness the just war tradition within the confines of his own pure theory of law seems to have largely failed, it exemplifies a degree of universalism of the just war tradition and its potential for transcending divisions among schools of legal and philosophical thinking.

The article reflects on the possibility of conceptualising the complex problem of the normativity... more The article reflects on the possibility of conceptualising the complex problem of the normativity of international legal rules, including in particular the phenomenon of “relative normativity.” The author utilises the critical potential of Ronald Dworkin's proposal for a new philosophy of international law to reflect on the classical accounts explaining normativity of international law. By building on Dworkin's argument, the author argues for a constitutional account of international law. The far-reaching constitutional proposals may provide a more complex and coherent set of possible rationalisations of international legal rules. International law is in great need of a comprehensive theory that could better explain its normative character as well as its sources, and it is argued that international constitutionalism has the potential to serve this purpose.
