In 1192 the Byzantine emperor Isaac II Angelos granted to Pisa a chrysobull. This lengthy documen... more In 1192 the Byzantine emperor Isaac II Angelos granted to Pisa a chrysobull. This lengthy document is one of the very few original documents we possess in its Greek version and a Latin translation. As with all Byzantine chrysobulls to the Italian cities although these documents have the type of a privilege act (a chrysobull) they are in reality treaties between Byzantium on the one hand and the Italian side on the other hand. In this paper I will present some snapshots of legal and diplomatic issues that arise in this document. What is the information we have about the making of this treaty and the use of oaths in our document? Is there a special kind of oath formula that is used by the Pisan envoys and if so, how is it formulated in the Greek and Latin versions? What is the information we have about the validity of the Latin translation of the document? Finally, what is the information we have about the grants of immovable property in Constantinople to the Pisans? These are some of the questions that I will deal with in my presentation.

This lecture will focus on maritime legal issues that arose in the Mediterranean sea between Byzantium and the Italians in the 10th, 11th and 12th centuries. How did the Byzantine emperor regulate questions related to the shipwreck of an Italian ship within his empire? Did Byzantine subjects, for example, receive a reward if they helped in salvaging the Italian goods? How did the Byzantine emperor resolve maritime conflicts that had occurred because of piracy incidents and other dangers at sea? How were the relevant maritime laws and customs applied in practice? These are some of the questions that will be discussed in this lecture.

Γιατί η διδασκαλία του δικαίου και η εκπαίδευση των νομικών (δικηγόρων, δικαστών, συμβολαιογράφων) στο Βυζάντιο της μεσοβυζαντινής περιόδου και ιδιαιτέρως τον 11ο και τον 12ο αιώνα ήταν άρρηκτα συνδεδεμένες με τα μαθήματα γραμματικής, ρητορικής φιλοσοφίας και τους δασκάλους γενικής παιδείας που δίδασκαν στα σχολεία της Κωνσταντινούπολης; Στο ερώτημα αυτό θα επιχειρήσουμε να απαντήσουμε με μια ανασκόπηση της ιστορίας της εκπαίδευσης στο Βυζάντιο από την πρώιμη έως την μέση περίοδο, εκθέτοντας ποιες βασικές αρχές παρέμειναν αναλοίωτες αλλά και ποιες αλλαγές επήλθαν στο πέρασμα των αιώνων, με ειδικό πάντα ενδιαφέρον τη διερεύνηση της διδασκαλίας του δικαίου και της μόρφωσης των νομικών.

Περίληψη
Μέσα από συγκεκριμένα παραδείγματα νομικών του 11ου και του 12ου αιώνα μπορούμε να αντλήσουμε πληροφορίες για το επίπεδο της παιδειας τους και της νομικής κατάρτισής τους. Πώς αποτυπώνεται η Βυζαντινή παιδεία στα γραπτά των νομικών αυτής της περιόδου και ποιό είναι το επίπεδο της νομικής τους μόρφωσης? Τι παραδείγματα έχουμε από τη δικαστηριακή πρακτική? Πώς συνδέονται γραπτά των νομικών αυτής της περιόδου με την Ιουστινιάνεια νομοθεσία? Αυτά είναι κάποια από τα ερωτήματα στα οποία θα προσπαθήσω να δώσω απάντηση. Στο τελευταίο μέρος της ανακοίνωσής μου με αφορμή ορισμένες πηγές Βυζαντινών νομικών του 11ου και 12ου αιώνα στις οποίες θα αναφερθώ θα μιλήσω για κάποιες γενικότερες επιδράσεις του Βυζαντινού δικαίου στην Ευρωπαϊκή νομική παράδοση, στην αξία μελέτης του Βυζαντινού δικαίου και θα εξηγήσω γιατί ο Ιουστινιανός χαρακτηρίζεται από σύγχρονους ιστορικούς του δικαίου ως ‘ο νομοθέτης της Ευρώπης’.
Aim of this paper is to focus on the Byzantine documents (imperial chrysobulls and letters) dire... more Aim of this paper is to focus on the Byzantine documents (imperial chrysobulls and letters) directed at Venice from the tenth century up to the sack of Constantinople in 1204, as well as some Italian documents related to the Byzantine grants dating from this period, and to investigate issues concerning the relations between Byzantium and Venice. Emphasis will be given to legal questions arising from the Byzantine grants to the city of Venice, including grants of immovable property to the Venetians in the Byzantine capital, the legal status of the Venetians within the Byzantine empire and information about the Venetian community in Constantinople.

The movement of people within the empire brought inevitably the movement of cultural and legal practices. The Byzantine imperial acts addressed to Venice, Pisa and Genoa in the eleventh and twelfth centuries offer much information about the mobility of Italians and their practices within Byzantium. In this paper I will concentrate on these Byzantine documents and present some examples of legal practices that are accepted by both sides, i.e. the Byzantine and the Italian one.
Abstract: At the time of Justinian the law professors were called antecessors. Around 900, many G... more Abstract: At the time of Justinian the law professors were called antecessors. Around 900, many Greek texts were collected into one massive legal compilation of sixty books, the Basilica (Imperial Laws), and from the tenth to the twelfth century scholia were added to the Basilica text. In the middle of the eleventh century the nomophylax (the guardian of laws) was John Xiphilinos who was appointed to serve at this position at the new established law school in Constantinople in the middle of the eleventh century. How are the antecessors, the Basilica and the nomophylax related to each other? This paper attempts to answer this question and deals inevitably with questions related to law teaching at the time of Justinian, transmission of antecessorian material in the Basilica and legal education in eleventh-century Byzantium.

Venetianen ontvingen niet alleen belangrijke commerciële en financiële privileges, maar ook op het juridisch gebied kregen ze speciale privileges. De Venetianen weten wat ze willen en hoe ze dat kunnen bereiken. Dat blijkt duidelijk uit de Byzantijnse keizerlijke documenten uit de 10e, 11e en 12e eeuw. Venetië vraagt veel van Byzantium maar-zoals wij gaan zien-kijkt Venetië tegelijkertijd ook op tegen Byzantium.
