Study on Investor-State Dispute Settlement (‘ISDS’) and Alternatives of Dispute Resolution in International Investment Law

Taken the public concerns about current developments in the area of the European International In... more Taken the public concerns about current developments in the area of the European International Investment Policy, the European Parliament’s INTA Committee launched a study on Investor-State Dispute Settlement and Possible Alternatives of Dispute Resolution in International Investment Law.In a nutshell, the study suggests that ISDS is a useful means of enforcing substantive investment protection standards contained in international investment agreements. The mechanism should therefore continue to form part of European international investment policy. However, the EU has to address four major challenges tied to this dispute settlement tool, i.e. (1) mitigating inconsistency, (2) securing the right balance between private and public interests, (3) establishing integrity of arbitral proceedings and (4) preventing misuse, allowing for error-correction and managing financial risk associated with ISDS. Among others, the study suggests (1) strengthening the role of the state parties to international investment agreements, (2) establishing an appeals facility, (3) giving well-functioning domestic court systems an adequate role in resolving investor-state disputes by introducing a novel elastic local remedies rule and (4) considering the implementation of tenured judges; at least on an appeals level.The study is part of a series of three. One study is devoted to the topic of investment protection agreements as instruments of international economic law. The other one deals with the interrelation of international investment protection agreements and EU law. These two studies are authored by Professor Kuijper of the University of Amsterdam and Professor Pernice of Humboldt-University Berlin, respectively.

The digital revolution is creating new risks, together with multiple opportunities for communicat... more The digital revolution is creating new risks, together with multiple opportunities for communication, commerce and political participation. What Ulrich Beck described as the world risk society and-from another perspective-Jürgen Habermas calls the "postnational constellation" is a challenge to our concepts of society and democracy. Digitisation is pushing this development towards a new dimension that allows us to speak of the "digital constellation". Social relations are denser across borders and continents; what happens there matters here, as if it were happening on our own doorstep. New kinds of risks are arising as a side-effect of the increasing use of information technologies, while the internet also offers-for the first time-an infrastructure that makes formerly unrealistic concepts of cosmopolitan democracy (David Held) a real option. This includes the establishment of a constitutional framework for normative processes aiming at, among other global challenges, effectively managing cyber-risks at national, supra-national and global levels in a coherent way. Multilevel Constitutionalism is proposed as a means of providing a normative theory for conceptualising the constitutional structure of a layered system of governance that ensures a maximum degree of self-determination for the individual and, thus, for the democratic legitimacy of decisions made at each level, from local to global. Thus, the constitution for democratically legitimate action at the global level does not question democracy at other levels, but should be complementary, based upon functioning states, and designed to deal with issues that are beyond their reach, including cyber-security.

Die Aussprache wurde von Jörn Ipsen geleitet. Am Abend dieses Tages fand ein geselliger Abend im berühmten Auerbachs Keller statt, der durch musikalische Darbietungen bereichert wurde. Der Ausflug am Samstag führte in die Gegend des Braunkohleabbaues südlich von Leipzig. Die Teilnehmer erhielten eingehende Informationen über die schwierigen Probleme des gegenwärtigen Tagebaues und der Rekultivierung abgebauter Braunkohlevorkommen. Das Be-hafte Hoffnungen auf die Bewahrung einer Art von autoritärer Rechtsstaatlichkeit 52 mit einer im Kern funktionierenden Justiz und einer in alter Tradition verankerten Rechtsidee, auf ein Festhalten an Gewaltenteilung und Machtkontrolle konnte man seitdem kaum mehr hegen. Zugleich war es jetzt für wirksamen Protest zu spät.

Ich glaube an sich, dass das Bundesverfassungsgericht zu ESM und Fiskalpakt nichts Neues entschei... more Ich glaube an sich, dass das Bundesverfassungsgericht zu ESM und Fiskalpakt nichts Neues entscheiden wird. Das Wichtigste ist meines Erachtens der neue Punkt, der in letzter Minute nach Karlsruhe gebracht worden war, und das ist die Frage des OMT, also dieses Programms für den Anleihenankauf, wofür dann auch in der mündlichen Verhandlung erstaunlich viel Zeit reserviert wird. Was erwarten Sie sich von diesem Punkt? Ist das rechtliches Neuland? Gibt es Indizien, in welche Richtung die Richter vielleicht überlegen könnten? Das Interessante dabei ist, dass es keine Entscheidung der EZB über das OMT gibt. Das heißt, dass eigentlich das Verfahren in dieser Hinsicht gegenstandslos ist. Das ist verwunderlich, dass das Bundesverfassungsgericht sich trotzdem damit befasst. Es geht nämlich nur um einen politischen Spruch des Präsidenten der Zentralbank, der eine Absicht verkündet hat. Und diese Verkündung der Absicht hat in unglaublicher Weise die Finanzmärkte beruhigt. Das war politische Absicht, und war mit Erfolg so geschehen. Jetzt wird das Verfassungsgericht dazu Stellung nehmen und sich fragen müssen, ob eine solche Absichtserklärung eines Präsidenten der Europäischen Zentralbank eine Kompetenzüberschreitung durch die Europäische Zentralbank ist, wobei wir auch natürlich sehen müssen, dass die Grenzen der Kompetenzen der Zentralbank festgelegt sind durch EU-Recht, und über EU-Recht der EuGH entscheidet und nicht das Bundesverfassungsgericht. Bleiben wir doch einen Moment bei dem Punkt der Absichtserklärung-im Gegensatz zu einem Rechtsakt oder rechtlich gebundenem Handeln. Ist das ein Novum oder gibt es das an anderer Stelle auch, dass man an so etwas verfassungsrechtliche Maßstäbe anlegt? Nun, normalerweise überprüfen Gerichte rechtlich erhebliche Handlungen. Hier würde es jetzt dazu kommen, dass ein Gericht sich damit zu befassen hat, eine politische Erklärung zu untersuchen. Das ist Neuland. Und ich würde zu größter Vorsicht insofern schon warnen. Was könnte man sich an anderen Fällen vorstellen, die ins Visier rücken würden, wenn dieses Neuland betreten wird? Ich glaube eigentlich nicht, dass das ein Präzedenzfall sein wird für viele andere Fälle, weil jedes Gericht weiß, wo auch die Grenzen der eigenen Zuständigkeit sind. Ich könnte mir aber vorstellen, dass das Bundesverfassungsgericht den Gesichtspunkt erwägt, dass diese Erklärung ungefähr oder im weiteren Sinne den Charakter annimmt wie den eines Rechtsaktes, weil die Folgen vielleicht ähnlich eingestuft werden. Wenn man das tut, wird man natürlich fragen, wonach sich bemisst, ob die EZB hier zuständig war. Und ich denke, bei einer solchen Frage wird man das zunächst mal dem Europäischen Gerichtshof vorzulegen haben. Und ich bin sicher, dass wenn das Verfassungsgericht so weit geht in der Prüfung, dass es dann auch die Vorlage an den EuGH machen wird, zum ersten Mal überhaupt.

A significant number of these claims are brought by EU investors despite the fact that the European Commission has opined that international arbitral tribunals established under these intra‐EU BITs are not competent to decide these disputes with EU law relevance. In the wake of the Commission's relative inaction in respect of these intra‐EU BITs, Member States have been tasked with responding to this increasing number of claims. To date, however, they have had limited success. This brief policy paper outlines likely causes of this unsatisfactory situation in particular for new Member States. It identifies the structure of the legal arguments in these arbitrations and the lack of a comprehensive overall policy approach as likely main causes. Does the German Lisbon-judgment with its emphasis on national sovereignty and identity really bind the hands of the government as substantially as to stop any real effort in promoting European integration? At least if read in an appropriate Europe-friendly way it does not necessarily bring the process to an end (Pernice). And if so, there seems to be room for future constitutional developments including not only drafting a laymen's restatement of the Constitution of the EU but also the vision of EU and global constitutionalism in a pluralist multilevel system (Tanchev). It is my honour to express my deepest gratitude to José María Beneyto not only for co-editing this volume but, foremost, for having organised this unforgettable conference at the Institute for European Studies, CEU San Pablo University in Madrid.
