Abstract

Several large placebo-controlled trials have confirmed that angiotensin converting enzyme (ACE) inhibitors significantly reduce mortality aid morbidity in all functional grades of congestive heart failure (CHF), nevertheless only a proportion of patients who may benefit from treatment are priscribed an ACE inhibitor. One of the perceived difficulties is the occurrence of first-dose hypotension in susceptible patients. A double-blind, randomised, single-dose therapy, parallel-group study was conducted with the aim to compare the first-dose responses to low dose ACE inhibitors captopril and perindopril in patients with stable chronic heart failure. Seventy patients (New York Heart Association class I-IV) were included. Blood pressure was recorded every 15 minutes 2 hours before starting treatment. The mean of these readings was taken as the baseline blood pressure. Patients were randomised to receive a single-dose of captopril 6.25 mg or perindopril 2 mg. After taking the drug, blood pressure was monitored every 15 minutes for 2 hours, every 30 minutes during 5 hours then hourly after 2 hours. The maximum mean arterial pressure fall from baseline of perindopril was 0.85 mmHg compared to captopril 4.60 mmHg. The maximum mean systolic fall from baseline of perindopril was 3 31 mmHg compared to captopril 6.76 mmHg while the maximum mean diastolic fall from baseline of perindopril was 1.08 mmHg compared to captopril 2.63 mmHg. The hypotensive effect of the captopril group started soon after dosing and reached its maximum after 1 to 2 hours while perindopril showed slight reduction of systolic after 1 hour and slight reduction of diastolic after 4 hours. Compared to captopril, perindopril seemed to be less likely to cause first-dose hypotension in patients with heart failure. Abstract

Possessing endowment refers to an association that cope the endowment properties from the endower in order to be managed and developed based on its intentions (UU no. 41 year 2004 article 1 section 4). According to Imam Syafi’i, possessing endowment can be comprised by wakif, or mauquf ‘alaih, or hakim. Dissimilarity with the constraints in the government regulations Number 28 Year 1977, possessing endowment should be managed by individuals or institutions in contrast with the constraints that are mentioned by Imam Syafi’i. Evenly, UU no. 41 Year 2004 article 9 has mentioned that possessing endowment may include: a. individuals, b. organizations, c. institutions. The main notions discussed in this study are: first, the concept of Imam Syafi’I, government regulation no. 28 Year 1977, and UU no. 41 Year 2004 about The Endowment of Land Properties; second, the position of possessing endowment according to Imam Syafi’i PP no. 28 Year 1977 about The Endowment of Land Properties, and UU no. 41 Year 2004. In addition, the aims of this study are: First, getting a description about the concepts delivered by Imam Syafi’i, government regulation no. 28 Year 1977, and UU no. 41 Year 2004 about The Endowment of Land Properties; Second, gaining a description about the position of possessing endowment according to Imam Syafi’I, PP no.29 Year 1977, and UU no. 41 Year 2004; Third, gaining a description about the influence of Imam Syafi’i perspectives in government regulation no. 28 Year 1977 and UU no. 41 Year 2004 about The Endowment of Land Properties, especially about the position of possessing endowment. This study is started by literature review of Imam Syafi’i works that relate to endowment appraisal and a review of government regulation no. 28 Year 1977 and UU no. 41 Year 2004 about the practice of endowment in Indonesia. The conclusion of this study gives an affecting description from Imam Syafi’i perspectives towards PP no. 28 Year 1977 and UU no.41 Year 2004 about the practice of endowment in Indonesia. In addition, the majority of Indonesian Muslims is enthusiastically involved in applying the concept of Imam Syafi’i in relation to the notion about possessing endowment in its practices. Abstract

Suatu tindakan kejahatan tidak dibenarkan dalam undang-undang salah satunya tindak pidana dibidang pelayaran. Seorang yang melakukan suatu tindak kejahatan seharusnya dapat dipertanggungjawabkan secara pidana. Namun pertanggungjawaban dalam perkara Nomor: 474/Pid.B/2021/PN Byw. Didapati dalam perkara ini terdakwa yang melakukan kesalahan tidak dapat dipertanggungjawabkan karena hakim tidak melihat kesalahan yang dilakukan terdakwa melanggar ketentuan undang-Undang Pelayaran dan KUHP. Penelitian yang dilaksanakan mempunyai tujuan untuk menjelaskan atau mengartikan bagaimana proses pengambilan keputusan dipengaruhi oleh pertimbangan yudisial dan tanggung jawab syahbandar? Masalah ini menjadi pusat diskusi melalui penggunaan metodologi seperti legislatif, konseptual, dan analisis studi kasus. Metode yuridis normatif diterapkan pada penelitian ini, yang melibatkan pemeriksaan data sekunder yang kemudian dianalisa secara kualitatif. Hasil penelitian menunjukkan bahwasannya pertanggungjawaban dalam kasus Nomor: 474/Pid.B/2021/PN Byw. Tidak sesuai pada ketentuan Undang-Undang Pelayaran dan KUHP yang berlaku. Kesalahan yang di perbuat oleh terdakwa seharusnya dapat dipertanggungjawabkan secara pidana karena telah memenuhi unsur-unsur pasal yang didakwakan. Selain itu, putusan yang dijatuhkan majelis hakim kepada terdakwa kurang tepat karena tidak melihat kesalahan yang dilakukan oleh terdakwa sehingga hakim menyatakan terdakwa terbukti tidak bersalah dan dinyatakaan bebas.

Abstract

This study focuses on the specialized rehabilitation of military personnel who have been convicted of narcotics crimes. Its aim was to comprehend the meaning, urgency, and concept of rehabilitating individuals within the military who have been found guilty of such crimes. To achieve this aim, the methodology used is normative legal study with statutory, contextual, case-based, and comparative approaches. Furthermore, the legal sources utilized consisted of both primary and secondary legislation. The results obtained from this study showed that rehabilitation for incarcerated military personnel involved in narcotic crimes corresponds to an endeavor aimed at providing exceptional rehabilitation specifically tailored to their circumstances. It is also important to note that the urgency of rehabilitation is closely related to the vested interest of the military in continuing the rehabilitation process, aligning with the initial recommendation. The state should, hence, give careful consideration to the implementation of specialized medical and social rehabilitation programs for military personnel who have been convicted of narcotic crimes. It is of utmost importance to establish a comprehensive framework within military agencies to facilitate the execution of medical and social rehabilitation measures for military members involved in narcotics offenses, including the necessary funding. In conclusion, the imposition of specialized rehabilitation measures, in conjunction with imprisonment, is essential for military personnel that are convicted of these crimes before their reintegration into society. This approach makes the state responsible for addressing the repercussions of their actions and providing tailored rehabilitation support to prevent any lingering resentment, minimize the risk of their recruitment by adversaries of the state, and enable their potential contributions if required in the future.

Abstract

Di negara kepulauan, transportasi laut seharusnya menjadi primadona, karena terdapat pulau-pulau yang hanya dapat di hubungkan melalui transportasi laut. Akan tetapi dalam prakteknya di Indonesia transportasi laut belum dikelola secara maksimal. Berbagai ketentuan Internasional telah di ratifikasi bahkan ketentuan nasional juga sudah lengkap, namun implementasi ketentuan tersebut masih sebatas kepentingan bisnis dan mengabaikan aspek keamanan dan keselamatan pelayaran. Dalam setiap peristiwa kecelakaan selalu dipublikasikan bahwa faktor penyebab kecelekaan adalah Human Error, dalam hal ini Nakhoda Kapal, namun human error tersebut secara umum selalu diawali dari kesalahan manusia sebelum pelayaran. Sejumlah peristiwa kecelakaan selama pelayaran, kerap menyebutkan bahwa jumlah penumpang tidak sesuai dengan manisfest atau bahkan kapal disebut over load. Sebelum berlayar petugas syahbandar seharusnya melakukan pengecekan bukan sekedar menerima laporan, sebelum memberikan liris berlayar maka syahbandar memiliki peran yang sangat vital dalam mewujudkan keselamatan selama pelayaran, sehingga harus secara sungguh-sungguh menjalankan tugasnya. Kejadian sejenis kerap terjadi karena lemahnya penegakan hukum. Sanksi hukum yang sudah sangat tegas namun tidak dilaksanakan secara konsekuen, dengan kata lain hukuman yang dijatuhkan tidak menimbulkan efek jera sehingga peristiwa kecelakaan di laut kerap terjadi.

Abstract

BPJS Health is the Health Social Security Organizing Agency which is responsible for administering health insurance programs for the Indonesian people. However, in the era of increasingly digitalization, user data leakage is a serious problem that must be handled seriously. User data leaks have become an increasingly disturbing issue in this digital era. One of the entities responsible for maintaining the confidentiality of user data is the Social Security Administering Agency for Health. This article aims to analyze BPJS Health's responsibility for leaking user data from a criminal law perspective. This research uses normative research methods with a statutory approach and related cases in its analysis. The research results show that leakage of user data by the Health Social Security Administering Agency can violate several criminal provisions as stated in Law no. 27 of 2022 concerning personal data protection and based on Law no. 11 of 2008 concerning Information and Electronic Transactions, especially in the context of violations of confidentiality and protection of personal data. It can be concluded that BPJS Health has criminal legal responsibility for user data leaks. To minimize the risk of data leaks, the Social Security Administering Agency for Health needs to improve system security and compliance with personal data protection regulations. Apart from that, the government needs to strengthen supervision and law enforcement in dealing with cases of data leaks involving public entities such as BPJS Health.
