The restorative field developed rapidly in the past decades, first as practice, afterwards as the... more The restorative field developed rapidly in the past decades, first as practice, afterwards as theory. More and more we are witnessing restorative practices which are crossing the boundaries of the criminal justice system and are implemented in other fields – process identified as systemic permeability. One of these fields is social work, with which restorative practices have common values and principles. In Romania, the restorative field is emerging, the fist experiments being undertaken in 2002. Nowadays, mediation is implemented in different criminal and civil cases, and four types of measures are implemented to increase the victim’s visibility and protection during the criminal justice process. In the Romanian social work arena, incipient restorative practices are developing, but clear procedures are not yet developed. The article aims to clarify several aspects of the restorative field – conceptual framework, origins, values and guiding principles and models of practice – as there seems to be a lack of popularity and knowledge among the Romanian social work professionals. Also, the main restorative practices implemented in Romania are presented and a discussion on the applicability of these practices in the social work field is made.

A short incursion into the beginnings of probation in Romania is made. The period chosen for anal... more A short incursion into the beginnings of probation in Romania is made. The period chosen for analysis is 1874-1936, during which time a new law on the prison system was issued that paved the way for the establishment of the first and only Patronage Society in Romania. The study of different historical documents revealed a cleavage between the intentions written in laws and the actual reality. Though very eager to make a contribution to the lives of inmates, parolees and young offenders or children at risk, the Patronage Society struggled with financial problems and little support from public institutions. Also, the change in the political regime after World War II brought a closure to these small, but somewhat significant, measures of assistance and a delay in the professionalisation of offender rehabilitation. It is only after the fall of the communist regime, that some of the penal institutions were developed (e.g. sursis avec mise à l’épreuve). Today, these early beginnings of probation can constitute roots to which we can look back, understand the shortcomings and renew the tradition.

The article is a theoretical study, part of the research project 'Deculturation as effect of dete... more The article is a theoretical study, part of the research project 'Deculturation as effect of detention. Resocialization in the context of the regressive and progressive regime of prison sentence execution' (Dobrică, 2008a). This study's main hypothesis is that prisonization presupposes two parallel processes: deculturation (defined as the loss of the ability to imagine solutions and to take decisions necessary for social integration) and enculturarion (defined as the taking on and/or deepening of the ability to imagine solutions and to take decisions regarding the adaptation to the prison subculture, which is opposed to social integration). Both deculturation and enculturation influence the success of inmate resocialization. The study sketches, from a Goffmanian approach, the main characteristics of, and social-psychological processes within, total institutions, and discusses the functions of prison. Also, it underlines the mechanisms which produce deculturation and enculturarion in prison and analyses the two predominant models which explain inmate subculture - the deprivation and importation models. The article ends with a short discussion on the adverse positioning between prisonization and inmate resocialization, and formulates a series of hypothesis for the further study of the prisonization impact on the inmate resocialization process.

The study presents an analysis of the community sanctions and measures implemented in Romania, as... more The study presents an analysis of the community sanctions and measures implemented in Romania, as well as of those following to be implemented in the near future, from the perspective of the functions they promote. Most scholars refer to four traditional justifications of the punishment – just deserts, general deterrence, incapacitation and rehabilitation - although in practice no punishment follows a single function of the four mentioned above. In most of the cases the functions coexist in different ratios, the legislator and the practitioners being those who give the orientation of the policy and practice depending on how they put the accent on one of the functions. The hypothesis of the present analysis is that we can determine the orientation of the state criminal policy in the field of community sanctions and measures by establishing the ratio of different functions in the punishments regulated by the law. Also, reference points for the national criminal policy in this field are the international regulations, which many times bring novelty elements to the national practice, but also impose certain standardizations of the criminal policy. Our country’s regulations in the field of community sanctions and measures make no exception, having to line up with this normative framework, the study offering the necessary analysis with the view of identifying an answer in this respect.

Violence in schools is the center interest of many researches and prevention programs developed i... more Violence in schools is the center interest of many researches and prevention programs developed in the past decades, both in Europe and elsewhere. We cannot say with certainty that this interest is the direct consequence of an increase in amplitude or severity of the phenomenon. However, we believe that it could be the result of the development of our own reflexivity towards the effects of such acts. The limits of understanding the determinism of school violence are presently pushed more and more past immediate risk factors, following a holistic perspective for the approach of preventing this phenomenon. As we will show in the article, school violence needs to be defined in a broader sense to include also less visible forms. We will also argue that for prevention programs to be effective, the understanding of school violence has to follow an ecological model, which focuses on our collective responsibility for the prevention of the phenomenon.

Articolul prezintă şi baza legală a muncii în folosul comunităţii în Elveţia, precum şi experienţa organizaţiei elveţiene ZSGE (Fundaţia din Zürich pentru Asistenţa Deţinuţilor şi Liberaţilor Condiţionat) şi Autorităţii de Justiţie din Zürich în implementarea unui atelier de muncă în folosul comunităţii care a reprezentat modelul de bază pentru atelierul din România.
