In a recent article, McBride suggests that our ability to understand, apply, and converse profitably about the law of tort was largely destroyed by a “catastrophe at some point in the twentieth century.”1 His argument is that, for reasons as yet unknown,2 our institutional memory – which once guarded and passed down an intuitive and largely unspoken sense of what tort law is and how it works – began to erode swiftly at some point in the last sixty years and has by now all but disappeared from contemporary judicial decisions. This catastrophe has been so complete that (as will be seen) even when modern judges are presented with evidence of the prior understanding they either miss its significance or mistake it as code for other things (such as evidence of the need for rigorous balancing or the implementation of hidden policy agendas). « En matière environnementale, la procédure transactionnelle s’y prête » .
Cette assertion de Françoise ROGGEN, promouvant une procédure se devant d’avoir la nature pénale pour la protection de l’environnement, s’inscrit dans le cadre des multiples démarches de recherche de solutions et de principes ayant vocation à protéger de manière efficace et effective l’environnement par le droit, compte tenu de la conjoncture actuelle relative à l’état inquiétant de notre planète.
Parlant de ces principes qui voient le jour au fil du temps, le Professeur Michel PRIEUR affirme que ceux-ci « font de la gestion durable de l’environnement un impératif que toute l’humanité reçoit favorablement puisque sa survie en dépend » . C’est d’ailleurs dans cette optique que de nombreuses conventions bilatérales et multilatérales pour la protection de l’environnement ont été conclues par une grande partie des Etats du globe. Ce faisant, la majorité de ces derniers s’inspire desdites conventions pour insérer dans leurs législations nationales des textes permettant de réduire les actes nuisibles à l’environnement à court terme et les faire disparaître sur le long terme. A titre d’illustration, nous pouvons citer les conventions issues du sommet de la terre de l’ONU qui s’est déroulé à Rio de Janeiro en 1992 , et qui a fait naître de nombreux principes qui continuent de s’appliquer aux jours d’aujourd’hui. En effet, devenus au fil du temps sacrosaints, lesdits principes ont été reconduits dans notre code de l’environnement quatre (04) ans plus tard mais aussi dans diverses lois nationales sectorielles. En sus, d’autres principes, tous inhérents des accords multilatéraux sur l’environnement ont été prévus par le code de l’environnement suscité .
En outre, comme conventions majeures, nous pouvons mentionner celles portant sur la création de fonds internationaux d’indemnisation pour les dommages dus à la pollution par les hydrocarbures érigées sous les auspices de l’organisation maritime internationale, ayant à la fois vocation à soit régir la responsabilité des propriétaires de navires pour les dommages dus à la pollution par les hydrocarbures, soit à établir un régime d’indemnisation des victimes.
La possibilité de régir la responsabilité civile des propriétaires de navires, à titre d’illustration, se base sur la convention de 1992 sur la responsabilité civile. Rentrée en vigueur le 30 Mai 1996 et ayant fait objet d’adhésion par la Côte d’Ivoire, celle-ci pose le principe de la responsabilité objective desdits propriétaires et instaure un système d’assurance-responsabilité obligatoire qui, lorsque proposant une indemnisation insuffisante pour les victimes, tombe notamment sous le coup de la convention de 1992 portant création du fond qui aura quant à elle pour mission d’augmenter le montant maximal payable .
Ainsi, avec ce que l’on peut qualifier de foisonnement normatif, on pourrait croire que l’état environnemental ne saurait que s’améliorer, mais il n’en est rien dans les faits. Pour tout dire, la ville d’Abidjan pour ne citer qu’elle, à l’instar des capitales africaines est faite en partie de ce que certains qualifient « d’immondices »  constituées par les déchets ménagers, les déchets des activités commerciales et artisanales ainsi que les déchets industriels.
Partant, se voulant plus incisive sur la question de protection de l’environnement, la Côte d’Ivoire a encore effectué des actions concrètes en instaurant dans son ordonnancement juridique des principes reconnus sur le plan international tels que la responsabilité sociétale des organisations avec la loi n° 2014-390 du 20 juin 2014 d'orientation sur le développement durable et s’est penchée sur le principe du pollueur-payeur prévu au code de l’environnement ivoirien comme une écotaxe sur les actes nuisibles ou susceptibles de nuire à l’environnement , par le biais d’un décret fixant ses modalités d’application .
L’article 1er de la loi sur le développement durable, veut que la responsabilité sociétale des organisations soit « la démarche volontaire dans laquelle toute organisation intègre les préoccupations sociales, environnementales et économiques dans son activité et dans ses interactions avec les acteurs du développement durable » . Mais là encore, des failles ont rapidement été observées à telle enseigne que cette responsabilité, a été qualifiée mécanisme relevant du droit mou car, dépourvue de contrainte juridiques.
Quant au décret fixant les modalités d’application du principe du pollueur-payeur tel que défini par le code de l’environnement, celui-ci permet de mieux cerner la manifestation de ce principe. Ainsi, l’article 3 dudit décret dispose que : « Le principe du pollueur-payeur a pour effet de mettre à la charge du pollueur, les dépenses relatives à la prévention, à la réduction, à la lutte contre les pollutions, les nuisances et toutes les autres formes de dégradation ainsi que celles relatives à la remise en état de l’environnement. Il permet de fixer les règles d’imputation du coût des mesures en faveur de l’environnement. ». A l’annexe du présent décret d’ajouter que le principe du pollueur-payeur a, notamment pour domaine d’application les dommages à l’environnement « référables aux dispositions pénales et préventives »  contenues dans notre législation nationale. De là, l’on comprend aisément que ce principe, mettant en œuvre directement la responsabilité du pollueur, a une double fonction, « préventive et curative » .
Elle est préventive lorsque ledit principe prend la forme de taxe ou redevance écologique s’appliquant aux activités nuisibles ou susceptibles de nuire à l’environnement, et prenant en compte le coût réel de la ressource qui pourrait être perdue, en vue de son éventuelle remise en état.
S’agissant de la fonction curative, elle se manifeste dans l’apport que le principe du pollueur-payeur a dans le droit pénal au niveau de l’incrimination environnementale mais surtout au niveau des sanctions prenant la forme de peines tendant à la remise en état de l’environnement, où les modalités techniques de ce principe pour l’imputation des coûts nécessaires pour ladite remise en état, constitue un atout majeur pour le droit pénal environnemental ivoirien. Cependant, relevant du domaine règlementaire, l’on pourrait éventuellement se demander si les organes techniques qui, appartiennent au pouvoir exécutif, au lieu du pouvoir judiciaire, ne pourraient pas, à bien des égards privilégier certains partenaires ayant porté atteinte à l’environnement au détriment de celui-ci en vue de préserver leurs intérêts. En d’autres termes, l’on pourrait se poser la question de la transparence de ces organes dans l’utilisation du principe du pollueur-payeur qui pourraient déterminer le prix à payer à la tête du client pour les atteintes causées à l’environnement.
Quoi qu’il en soit, mesurant l’importance de la nécessité de réprimer les actes anti nuisibles pour l’environnement, le législateur ivoirien a prévu dans l’ordonnancement juridique ivoirien des dispositions pénales , qui punissent toute infraction portant atteinte à la salubrité publique, élément de l’ordre public.    Ces dispositions ne sont cependant, quasiment jamais invoquées dans nos juridictions pénales compte tenu de la kyrielle de dispositions prévoyant des alternatives à la saisine des juges.
La transaction pénale, faisant objet de notre étude, s’inscrit dans la famille desdites alternatives. Prise intrinsèquement, la transaction se définit comme un « accord conclu sur la base de concessions réciproques » . Au surplus, elle était beaucoup perçue en droit civil relativement à la mise en œuvre de la responsabilité extracontractuelle avec les articles 2044  et suivants du code napoléonien de 1804 encore en vigueur en Côte d’Ivoire. Toutefois, dans un souci de désengorgement général des instances judiciaires, la tendance actuelle de certaines législations  veut que celles-ci prévoient dans leur ordonnancement juridique une transaction de nature pénale et la Côte d’Ivoire n’en fait pas exception. En effet, les affaires pénales se sont multipliées, elles sont plus complexes, les criminels plus nombreux mais parallèlement, le nombre de magistrat a rétréci comme « peau de chagrin »  pour reprendre les propos de l’actuel procureur de la république de la Côte d’Ivoire près le tribunal de 1ière instance d’Abidjan, M. ADOU Richard. Dès lors, la transaction pénale semble être une idylle parfaite pour la résolution des problèmes liés aux questions de lenteur des juridictions dans les règlements de litiges complexes et de surcharge desdites si tenté que celle-ci est bien rodée. Prévue par diverses lois ivoiriennes, la transaction pénale est clairement définie par la loi n° 2018-975 du 27 Décembre 2018 portant le code de procédure pénale, comme une procédure consistant « … au paiement d’une amende proposée par le procureur de la République dans les limites de la peine d’amende prévue par la loi pour l’infraction constatée et acceptée par le délinquant » .
Ainsi le code de procédure pénale ivoirien prévoit le régime juridique de cette procédure. On y apprend notamment le fait qu’en vertu du pouvoir de l’opportunité de poursuite du procureur de la République, celui-ci peut proposer ou non la transaction au délinquant, mieux encore, il peut éteindre l’action publique par le biais de cette procédure au détriment de la victime qui n’aurait pu recourir à l’action civile que si le juge pénal avait été saisi avant la conclusion de ladite transaction. 
L’environnement, qui fait aussi partie du champs d’action de la transaction pénale, est  perçu dans son acception légale comme : « l’ensemble des éléments physiques, chimiques, biologiques et des facteurs socioéconomiques, moraux et intellectuels susceptibles d’avoir un effet direct ou indirect, immédiat ou à terme sur le développement du milieu, des êtres vivants et des activités humaines » . The System of Environmental Management is set up in the company according to the directives of the standard ISO 14001 for the control of the environmental impacts linked to its activity and also the respect for the regulations and laws in vigours. ISO 14001 is based on the environmental principle of continuous improvement of the performance of the company. So installed, the environmental politics of the company allows directly the respect for three pillars of durable development.The present research with the Cosumar Sidi Bennour company demonstrates that the establishment of EMS according to ISO 14001 allows respect for the environment, the economic earning that allows a social emergence and thus an positive impact on the durable development of the region.

Introduction : La problématique des nuisances industrielles s'entremêle avec divers enjeux sociétaux, soulignant l'importance de la représentation des rejets industriels, tels que les résidus solides, les émissions atmosphériques, et les nuisances sonores. Objectif : L'objectif de cette étude est d'analyser les perceptions environnementales des riverains des usines d'égrenage de coton de la SOFITEX à Bobo-Dioulasso et Banfora. Méthodes : Pour atteindre cet objectif, des enquêtes ont été menées auprès de 210 riverains des usines, évaluant leurs opinions sur les rejets solides, les émissions atmosphériques, et les nuisances sonores. Résultats : Les résultats révèlent que 60% des riverains de Bobo 1, 2 estiment que les usines émettent des résidus solides, tandis que ce chiffre est de 38% pour ceux de Banfora 1, 2. Par ailleurs, 47,87% des riverains des usines Bobo 1, 2 perçoivent des émissions de particules de fibres en suspension et de poussière, contre 22,27% pour les riverains de Banfora 1, 2. Les nuisances sonores sont peu ressenties dans les deux localités (19%). Seulement 3% des populations de Banfora et 9% de Bobo-Dioulasso perçoivent les émissions des usines comme une source de préjudices sanitaires. Conclusion : Une analyse du test de Student révèle que la proximité influence significativement les perceptions des riverains par rapport aux rejets solides (α=0,000) et aux préjudices sanitaires (α=0,04). En conclusion, cette étude contribue à analyser les nuisances environnementales perçues par les riverains des usines Bobo 1, 2 et Banfora 1, 2, visant à améliorer la gestion environnementale des usines et à garantir un environnement sain aux populations.

Tous ces documents prouvent à suffisance que tout a été fait dans les règles de l’art et en respect des normes environnementales.
Cependant, cette célébrité, ce succès, risquerait, si l’on y prend garde, d’être entachée par certains facteurs et défauts qui ont plombés, voire entachés l’image de son ainée, c’est-à-dire la zone industrielle d’AKPAKPA.

Sortir de la crise du Covid-19 et en tirer les leçons pour éviter de contribuer à de nouvelles crises systémiques Ce Plan de transition a été co-écrit et/ou soutenu par le 'Resilience Management Group', composé d'académiques, économistes et d'entrepreneurs de la transition, qui concilie les connaissances scientifiques et réflexions théoriques avec les expériences concrètes du terrain. De mi-avril à mi-mai 2020, plus de 100 scientifiques et 182 entreprises de la transition écologique de la Coalition KAYA ont travaillé de manière collaborative pour produire un Plan composé d'une partie synthétique (3 pages) et de 15 trains de mesures (15 thématiques). Bien que ce travail se soit fait par domaine, pour utiliser les spécialisations des scientifiques, nous avons promu la cohérence et nous plébiscitons une réponse systémique. Les trains de mesures reflètent le plus fidèlement possible les positions des contributeurs ; ils ne reflètent pas nécessairement un consensus mais montrent la diversité et l'étendue des pistes de solutions pour aller vers la transition. Si les personnes et les entreprises reprises dans la liste en fin de document sont en accord avec l'introduction et le communiqué de presse, cela ne signifie pas nécessairement qu'elles co-signent l'ensemble des mesures et en acceptent chaque détail mais bien qu'elles en soutiennent l'esprit général. L'ambition de ce texte est de susciter le débat, d'y encourager de nouvelles contributions, de signaler aux gouvernements (fédéral et régionaux) que de nombreux académiques sont disponibles pour collaborer avec eux en vue d'affiner les propositions de ce plan, et construire ainsi une Belgique solidaire, prospère, résiliente et durable.

The effects of climate change and the severe anthropization of local river systems have contributed to the alteration of ecological processes, affecting the water quality in these systems and thus generating conditions for the emergence of algal species. In this context, the object of the present study was to evaluate the potential of remote detection techniques to obtain a spectral characterization of D. geminata under controlled laboratory conditions. This would provide the basic information for the design and implementation of a monitoring and early warning system. D. geminata cells obtained from two southern Chilean river systems were cultivated in the laboratory and analysed using hyperspectral techniques to construct their spectral signatures. The results showed the feasibility of distinguishing between the presence and absence of D. geminata when it occurs in association with other diatom present in the environmental. The results could be the first step towards the design and implementation of a monitoring and early warning system to facilitate existing inspection activities.

ABSTRACT
The development of sustainable agricultural production systems is a global concern.
Cameroon through the CDC, its largest parasternal agro industrial corporation yet seems to
evolve without a real consideration of environmental aspects in industrial activities. This is
particularly true of what can be observed at the Tiko CDC industrial complex, which consists
mainly of a pre-processing site for rubber, and the central garage of the corporation.
Based on the assumptions that the production processes of the Tiko CDC industrial
complex do not sufficiently take into account the environmental aspects, the impacts related
to the activities of the site are poorly known, the practices developed in the site are not very
consistent with the texts in question. and the mitigation measures for certain impacts and risks
are ineffective, it has been shown that these assumptions have all been verified. Indeed, the
impacts of the site are previously poorly known, the compliance of the practices developed in
the site is only partial, the lack of an EMS or an ESMP developed for the site does not allow
the application effective mitigation and optimization of identified impacts. In addition,
exploitation in its current form (not meeting environmental standards) presents many risks.
Thus, these impacts and risks are perceptible both in its biophysical and socio-economic
environment.
The sociological climate marked by the insecurity generated by the crises of the
North-West and South-West regions was an obstacle to the realization of this study to the
extent that access to certain sites was not possible and local populations are not available for
socio-economic surveys. Other difficulties were related to access to sources of documentation
and to some of the site's environmental inspectors. However, despite these difficulties, we
managed to highlight the main major impacts of the site. We have been able to characterize
them, to suggest reduction and compensation measures for negatives and measures of
improvement and optimization for positive impacts.
This work led to recommendations of two kinds: general recommendations for the
entire corporation including the CDC should commit environmental audits for all its
production units and associated industrial structures. The specific recommendations for the
site under study included the participatory development and implementation of an ESMP or
EMS for the Tiko CDC industrial complex.

Some Sciaridae species are considered as cosmopolitan pests in greenhouses and mushrooms farms. The potential harm of these insects involves plant tissue damage and transmission of pathogens to the seedlings. Recently, large sciarid masses were found infesting wood log stocking of processing industries and turned to be a severe nuisance factor and a public health issue. The Sciarid specimens from infested areas were identified belonging to the genus Bradysia Winnertz, 1867. These species certainly do not correspond to pests, but to species that are possibly associated to microenvironments generated by the fungi on the wood bark. Fungus-gnats (Sciaridae) como um fator de importuno em pátios de toras de pinus Resumo-Algumas espécies de Sciaridae são consideradas pragas cosmopolitas em estufas, criações de cogumelos e até mesmo em vasos de plantas. A ameaça potencial destes insetos envolve o dano de tecido vegetal e a transmissão de patógenos às mudas. Recentemente, grandes massas de sciarídeos foram encontradas infestando o estoque de toras de indústrias madeireiras e se tornaram um fator de incômodo e preocupação de saúde pública. Os espécimes foram identificados como pertencendo ao gênero Bradysia Winnertz, 1867. Estas espécies certamente não constituem uma praga, mas possivelmente estão associadas a microambientes gerados pelos fungos sob a casca das toras.

The evaluation of adhesive trap is a time-consuming task, vulnerable to count errors. Our proposition originated from the need to perform periodical evaluations of fungus-gnats (Diptera: Sciaridae). We selected, at random, 100 traps samples from a single site. Manual counting was performed and the traps were subsequently submitted to digitalization and automatic counting. We perform comparisons of both counting methods using R. The proposed automatic based approach is more expeditious in analyzing bigger samples or in including larger areas.

European Union (EU) environmental policy is the sole EU policy to proclaim a cluster of principles, including the polluter pays principle, the precautionary principle and the principles that preventive action should be taken and environmental damage rectified at source as a matter of priority. Although various understandings and definitions of these principles exist in international environmental law, the EU treaties provide no such definition. Lawyers are thus increasingly inquiring into the types of role these principles play, or may play in the legal practice. The Fipa case, examined in this case note, is one such example.

Didymosphenia geminata is a stalk-forming diatom capable of creating thick benthic mats in low-nutrient streams. There are two hypotheses to explain the rapid worldwide increase in occurrence of nuisance D. geminata mats: (a) Cells are spread among rivers and across broad ecoregions through natural and anthropogenic vectors, or (2) pre-existing D. geminata populations are forming mats in response to changing environmental conditions within the habitat. Low phosphorus (P) concentrations are a major trigger for stalk production by D. geminata cells. Although the environmental change hypothesis is gaining support among researchers, long-term data sets demonstrating declining P concentrations prior to reported mat formation have been essentially absent from the literature. Here, we present long-term datasets for two case studies for which long-term P and D. geminata data coincide: the Matapedia River in Eastern Canada and the Kootenai River below Libby Dam in Montana, United States. Both rivers had declining P levels over time. However, there was a 2-and 20-year lag time, respectively, between mat development and reaching the previously proposed average 2 μg/L soluble reactive P threshold for development. Although the Matapedia River provides some support of the environmental change hypothesis, the Kootenai River data set suggests other environmental factors may play a role in mat development. The data presented do not rule out the environmental change hypothesis but do suggest there may be conditions in addition to low P that must be met for mats to form and the environmental change hypothesis can likely be refined to include more parameters to better understand and mitigate the influence of mats.

The study examines the earnings differentials between the public and private sector in the Malaysian economy in terms of the moderations of the gender and ethnic wage differences in the public sector. The study uses the annual earnings from the Salaries and Wages Survey for 2011 and 2016. The key findings are that public employees are paid higher wages compared with private sector employees and the overall gender and ethnic wage differentials have declined in recent years. We also find that both gender and ethnic wage differentials are much smaller in the public sector.

Ecological restoration is of crucial importance to mitigate the impact of human activity on the environment and preserve biodiversity and ecosystem services. Therefore, the concept of restoration is at the core of international and European Union (EU) environmental policy and governance. This article seeks to shed light on this concept in international and European case law. To this end, it reviews the definition, objectives and scope of restoration according to international scientific standards. It further distinguishes restoration from other related terms such as compensation, mitigation, conservation and rehabilitation. The article then analyses judgements rendered by the International Court of Justice, the Court of Justice of the EU and EU Member States' courts pertaining to restoration. It concludes that there are wide discrepancies in the use of the term restoration by the judiciary, in particular with regard to objectives, baselines and reference conditions. This study evaluated environmental noise nuisance in pedagogical institutions located in Jos metropolis. Sixteen senior secondary schools and 282 senior students were selected through stratified and random sampling techniques respectively. Data were collected from 282 students using semi-structured questionnaire. Data were analyzed using frequency counts, percentages and mean, aided by SPSS- 23 software. Results were presented in tables and charts, which revealed that, over 58% of the students are "annoyingly noisy", with only 3% of them claiming their schools are "silent". About one-half claimed noise emanated mainly from road traffic, while demolition and construction contribute the least source of noise. All the sources of noise create setbacks on students' academic outcomes by distracting their: literacy, articulacy, numeracy and graphically abilities (mean = 4.3); concentration ((mean = 4.2), reading tasks & well-being (mean = 4.1); and cognitive tasks (mean = 4.0); among others. The weakening of overall performance of students (mean = 4.3) make them "very much annoyed" (50.4%). The correlation analysis, r value 0.98 showed a strong positive relationship between high noise level and decline in the overall academic outcomes of students. The paper recommended the need for: school owners to insulate classrooms against outdoor noise, raise high fences round schools, plant sound-absorbing trees within school compounds and the Government should relocate all schools to safe environments.

De mi-avril à mi-mai 2020, plus de 100 scientifiques et 182 entreprises de la transition écologique de la Coalition KAYA ont travaillé de manière collaborative pour produire un Plan composé d'une partie synthétique (3 pages) et de 15 trains de mesures (15 thématiques). Bien que ce travail se soit fait par domaine, pour utiliser les spécialisations des scientifiques, nous avons promu la cohérence et nous plébiscitons une réponse systémique. Les trains de mesures reflètent le plus fidèlement possible les positions des contributeurs ; ils ne reflètent pas nécessairement un consensus mais montrent la diversité et l'étendue des pistes de solutions pour aller vers la transition. Si les personnes et les entreprises reprises dans la liste en fin de document sont en accord avec l'introduction et le communiqué de presse, cela ne signifie pas nécessairement qu'elles co-signent l'ensemble des mesures et en acceptent chaque détail mais bien qu'elles en soutiennent l'esprit général. L'ambition de ce texte est de susciter le débat, d'y encourager de nouvelles contributions, de signaler aux gouvernements (fédéral et régionaux) que de nombreux académiques sont disponibles pour collaborer avec eux en vue d'affiner les propositions de ce plan, et construire ainsi une Belgique solidaire, prospère, résiliente et durable.

The System of Environmental Management is set up in the company according to the directives of the standard ISO 14001 for the control of the environmental impacts linked to its activity and also the respect for the regulations and laws in vigours. ISO 14001 is based on the environmental principle of continuous improvement of the performance of the company. So installed, the environmental politics of the company allows directly the respect for three pillars of durable development.The present research with the Cosumar Sidi Bennour company demonstrates that the establishment of EMS according to ISO 14001 allows respect for the environment, the economic earning that allows a social emergence and thus an positive impact on the durable development of the region.

Recent discoveries of an archaeological site near a complex of an aggregate quarry and a concrete plant on the island of Andros, Greece, have caused considerable controversy. More specifically, the continued operation of the aggregate quarry and concrete making plant was questioned, after the discovery of an important Neolithic settlement in the vicinity of the plants. The relocation of the quarry and the concrete plant is not an easy task, due to the touristic character of the island, as well as the great number of other antiquities found all over the island. On the other hand, the closure of the plant would have had significant implications on the island's economy. In the light of this situation, the symbiosis of these two different activities has been examined. According to the results of the study, the two activities can coexist under certain conditions, which are discussed in the article.

In modern living, the participation of female in the labor market is becoming essential for development economy. The higher educational attainment among females makes it easier for them to find jobs and to be involved in the labor market. Nevertheless, the participation of women in the labor market is less prevalent than for men, especially for married women, where family responsibilities and household chores become obstacles for them. This paper attempts to identify the determinants of married women's participation in the labor market based on 3,520 data collected in 2011 through a field survey. The results from this study show that educational attainment, women's age and number of children are major determinants of the supply of married women labor. In contrast, husbands' wage and own wage are insignificantly determined the supply of married women labor in this study.

À partir de l’étude approfondie d’un site d’orpaillage au Burkina Faso, nous montrons que contrairement aux préjugés habituellement véhiculés qui font des sites d’orpaillage des espaces de non-droit, l’organisation du site repose sur une gouvernance de proximité très structurée, même si elle est principalement régie par des règles informelles. The essay deals with safeguarding the right to a healthy environment in the Italian and English systems, especially for the individuals affected by emissions that corrupt the air quality interfering with their private and family life. The study focuses on the injunction, as a non-compensatory remedy, actionable before the English courts by claimants seeking the decontamination of the polluted areas. The insight into the foreign environmental law will provide a new perspective on the Italian one that (as the European Court of Human Rights stated in the Cordella case) does not secure everyone an effective remedy to the violation of their environmental human right.

The Þrst records for Brazil of two sciarid species, Bradysia difformis Frey, 1948 [ϭ paupera (Tuomikoski, 1960)] and Bradysia ocellaris (Comstock, 1882) [ϭ tritici (Coquillett, 1895)] (Diptera, Sciaridae) are presented. These are the Þrst records of these species for the Neotropical region. Males and females of both species are fully described and illustrated. Information is given about synonymy and the location of the type material. Bradysia agrestis Sasakawa, 1978 is a new synonym of Bradysia difformis. Information about the zoogeographic distribution and habitats, of Bradysia difformis and Bradysia ocellaris is provided.

Didymosphenia geminata is a stalk-forming diatom capable of creating thick benthic mats in low-nutrient streams. There are two hypotheses to explain the rapid worldwide increase in occurrence of nuisance D. geminata mats: (a) Cells are spread among rivers and across broad ecoregions through natural and anthropogenic vectors, or (2) pre-existing D. geminata populations are forming mats in response to changing environmental conditions within the habitat. Low phosphorus (P) concentrations are a major trigger for stalk production by D. geminata cells. Although the environmental change hypothesis is gaining support among researchers, long-term data sets demonstrating declining P concentrations prior to reported mat formation have been essentially absent from the literature. Here, we present long-term datasets for two case studies for which long-term P and D. geminata data coincide: the Matapedia River in Eastern Canada and the Kootenai River below Libby Dam in Montana, United States. Both rivers had declining P levels over time. However, there was a 2-and 20-year lag time, respectively, between mat development and reaching the previously proposed average 2 μg/L soluble reactive P threshold for development. Although the Matapedia River provides some support of the environmental change hypothesis, the Kootenai River data set suggests other environmental factors may play a role in mat development. The data presented do not rule out the environmental change hypothesis but do suggest there may be conditions in addition to low P that must be met for mats to form and the environmental change hypothesis can likely be refined to include more parameters to better understand and mitigate the influence of mats.

Many industries discharged foul, sometimes toxic, solid, liquid, and gaseous wastes and loud, repetitive, mechanical noises and vibrations into the surrounding air, water, and land. These emissions blackened air and water and disturbed ecosystems wherever rivers were dammed for power, wood or coal burned to power production processes, and slaughterhouses, mills, workshops, manufactories, mines, and smelters established. They also sparked the first significant wave of industrial pollution litigation in American history. Complaining of "noisome," and "noxious" stenches, smokes, dusts, and "smuts," poisonous and corrosive fumes, "corruption" of streams by "foul admixtures," "tremendous noise and pounding," and similar problems, people living near offensive businesses turned to the courts for compensation for the damages industrial pollution inflicted on their homes, farms, businesses, and families. They also sued for injunctions to stop the businesses from continuing to pollute. This article examines the case law generated by this litigation in order to explore how people made sense of the environmental problems caused by the explosive growth of the textile, lumber, iron, meatpacking, railroad, and machine tool industries before the Civil War.' The approach of the courts in allocating remedies in nuisance actions has remained little changed over the last one hundred years. This is somewhat surprising given changed perceptions of private property rights in our society over this period. I believe the time has come to reevaluate the conventional methods used by the courts in making such decisions. My paper will feature an assessment of the effectiveness of nuisance remedies, the validity of the criteria used for assigning these remedies and, in particular, an examination of the courts' use of the statutory discretion to grant damages in lieu of an injunction conferred by Lord Cairns' ~c t ' . While Lord Cairns' Act has never been applied to nuisance in a New Zealand court, the use of this Act has produced interesting results, along with some comment, in other jurisdictions. I hope that my examination of the approach of overseas courts to awarding damages in lieu of an injunctipn may indicate the course our own courts should be advised to take if faced with such a case.

Species of the family Sciaridae (Diptera: Sciaroidea) are found worldwide and more than 1,700 species have been described so far (7). From Europe 649 species have been identified to date (5) of which 35 are recorded in Belgium (6). These flies have largely been neglected because of their small size (1–7 mm), their hidden lifestyle and the difficulties involved with their identification. Sciarid larvae live in decaying organic matter in the soil, under bark of decaying trees and on fungal fruiting bodies (1). The larvae of some species, however, can also be found in leaves and stems of plants (3). Some species of Sciaridae are common pests in greenhouses (2).
