تركز هذه الدراسة على اتفاقية حظر الذخائر العنقودية لعام 2008، التي تثير تساؤلات حول طبيعتها: هل هي وثيقة لنزع السلاح تهدف إلى الحد من انتشار الأسلحة المدمرة، أم أنها مذكرة إنسانية تسعى إلى حماية المدنيين من مخاطر الذخائر غير المنفجرة؟ يناقش المبحث الأول نطاق الحظر، بما في ذلك التعريف الدقيق للذخائر العنقودية المشمولة بالحظر، ودور الاتفاقية في تعزيز المبادئ الإنسانية من خلال منع الاستخدام العشوائي للأسلحة التي تسبب أضرارًا واسعة النطاق وطويلة الأمد، مما يبرز الالتزام بتقليل المعاناة الإنسانية في النزاعات المسلحة.

أما المبحث الثاني فيتناول آليات الامتثال التي تضمن تنفيذ الاتفاقية بشكل فعّال، من خلال التزامات الدول الأطراف بتدمير مخزونها من الذخائر العنقودية، وتقديم الدعم للضحايا، وتنفيذ تدابير وطنية لضمان الالتزام. تسلط الدراسة الضوء على أهمية الاتفاقية في تحقيق التوازن بين نزع السلاح والأهداف الإنسانية، مما يجعلها نموذجًا دوليًا فريدًا يجمع بين الجهود الرامية للحد من التسلح وتعزيز حماية المدنيين، ويثير قضايا قانونية وأخلاقية هامة حول طبيعة المعاهدات في القانون الدولي.

It is a great pleasure for me to have been prepare this legal study on Iraq legal background to describe the Legislative and the Judicial Authorities structure in accordance with current Constitution of Iraq.
The study will take along many answers to questions that may be brought up at this time by students of Law, researchers and observers in legal field.
In other words, this  legal study is useful for both, students and researchers of the Law, to determine whether the current constitution can harmonize with dramatic changes in Legal, political and economic as well as social issues after 2003,as well as to explain the legislative and judicial structure and there  competences in accordance with  Iraqi laws.
Finally, the legal terms mentioned in this legal study, may be helpful in understanding the equivalence in other legal systems, as it will help at least , the International lawyer or consultant in cases before the foreign courts ,or in case one of the parties was a foreigner

Following the military defeat of ISIS in Iraq in December 2017, it became apparent that the logical next step would be to hold ISIS members accountable for crimes committed during the occupation of several key Iraqi cities between 2014 and 2017. Consequently, the United Nations Security Council (UNSC) decided to investigate ISIS crimes internationally by establishing the United Nations Investigative Team to Promote Accountability for Crimes Committed by ISIS (UNITAD). However, any proposed prosecutions were to be handled by Iraqi courts.
The practical implementation of this hybrid international mechanism for prosecuting ISIS members has given rise to significant legal challenges, mainly arising from Iraq's national laws. These challenges involve the subjective jurisdiction of UNITAD to collect evidence regarding ISIS terrorist acts, which may potentially qualify as evidence of war crimes, genocide, and crimes against humanity. Moreover, issues emerge concerning whether UNITAD’s criminal investigation procedures align with Iraq’s domestic criminal procedure laws.

Several questions remain unanswered in light of the heinous crimes against women committed by ISIS in Iraq. This article will examine Iraq's current criminal framework to see if prosecutions for these violations were appropriate in light of international criminal law principles and the security council measures taken after ISIS took control of Mosul and other areas in Iraq in 2014. As an illustration of the kinds of topics we will cover in this paper: Is the Iraqi criminal justice system capable of investigating and holding ISIS accountable? Why did the Iraqi government make a request to the Security Council for help in 2017 if the reaction is positive? In light of what Iraqi women have been subjected to for three years now? In this article, we will examine the current Iraqi criminal framework and whether it is appropriate to prosecute the perpetrators of these violations in parallel with the principles of international criminal law as well as the Security Council actions taken after ISIS took control of Mosul in 2014 and other areas of Iraq This research will discuss critical issues, for example: Is the Iraqi criminal framework qualified to fulfill the mission of investigation and accountability for ISIS crimes? Is there a legislative void or contradiction in the Iraqi criminal framework? How does the Iraqi Council of Representatives address these issues in legislative policy, whether by amending current legislation or enacting a new law to prosecute crimes such as genocide or crimes against humanity?

The right to education for children living in armed conflict will be the key-topic of the Second International Academic Week organized by the Universities Network for Children in Armed Conflict, scheduled from 22 to 29 November 2021. The First Academic Week, launched in November 2020, focused on the topic of girl children in armed conflict. Children are the most vulnerable persons affected by the tremendous consequences of armed conflict. They are particularly subject to widespread and systematic violations of their human rights with physical, mental, emotional, and material repercussions. Armed conflicts also cause a series of severe indirect consequences for children. They experience a double trauma in situation of conflict. On one hand, children suffer gross violations as abduction, forced removal from families, illegal detention, recruitment. On the other hand, they are deprived of their daily life which include going to school and of their natural right to study and build their future. Furthermore, schools become often specific a military target including in small villages when only one school is present.

یرکز البحث على مفهومی العنایة الواجبة والإخطار فی ضوء قواعد المسؤولیة الدولیة، إذ لا یزال الجدل القانونی مستمراً فی تحدید الإطار القانونی لکلا المفهومین، وفی هذا السیاق کان البحث مهتما بالإشارة إلى حدود العنایة الواجبة وأحد أهم أشکالها الوقائیة، وهو الإخطار قبل حدوث الضرر، وما إذا کان معیاریًا صارمًا أو ظرفیًا مرتبطًا قبل وقوع الضرر واثناؤه وما بعد وقوعه،و مع تفشی الأوبئة والجوائح ، کجائحة کورونا ، لا تزال الدراسات القانونیة تبحث فی التحقق من الامتثال فیما یتعلق ببذل العنایة الواجبة والإخطار من جهة، ومسؤولیة بلد المصدر عن انتشار هذه الجائحة وفقا لقواعد المسؤولیة الدولیة الاولیة والثانویة من جهة أخرى.

Many cases rely on indirect evidence before international courts, but the topic of indirect evidence has not been examined and analysed. Most legal studies have been subjected to this subject within the scope of national law. Crimes may be committed in the absence of direct evidence to establish the truth of the case, and this is particularly true of the nature of international trials; It is therefore difficult, if not impossible, to establish the truth of the alleged incident by relying solely on direct evidence; This highlights the role and necessity of indirect evidence, as well as its particular importance in the process of establishing international crimes in general, and cybercrime in particular; in the role played by indirect evidence in establishing such crimes-cybercrime-before international courts. .
