W książce przedstawiono zagadnienia dotyczące fundamentu prawa rodzinnego, tj. zasady ochrony dob... more W książce przedstawiono zagadnienia dotyczące fundamentu prawa rodzinnego, tj. zasady ochrony dobra dziecka. Zaprezentowano całokształt regulacji materialnoprawnych i procesowych związanych z ochroną dobra dziecka w razie rozwodu rodziców. Analizie poddano sytuację prawną małoletniego dziecka przed rozpoczęciem postępowania rozwodowego, w jego trakcie oraz po wydaniu wyroku rozwodowego przez sąd I instancji. Oceniono między innymi, czy w obecnie obowiązujących przepisach regulujących postępowanie rozwodowe preferowane są interesy rodziców czy też małoletniego dziecka, odniesiono się do konfliktu dobra wspólnego dziecka małżonków z dobrem dziecka wspólnie wychowywanego (pozamałżeńskiego) i wskazano, jak posiadanie małoletniego dziecka wpływa na szybkość postępowania rozwodowego. Zwrócono również uwagę na to, jaki powinien być udział dziecka w postępowaniu okołorozwodowym. W publikacji czytelnik znajdzie także odpowiedzi na pytania: • czy przepisy regulujące sytuację dziecka rozwodzących się rodziców pozwalają odseparować małoletniego od konfliktu jego rodziców; • jaki jest mechanizm kontroli nad urzeczywistnianiem zasady ochrony dobra dziecka; • kto powinien włączyć się w ochronę dziecka, jeśli nie może ono polegać na swoich rodzicach. Autorka przedstawiła konkretne rozwiązania zmierzające do poprawy sytuacji dzieci rozwodzących się rodziców. Ich wykorzystanie wzmocni pozycję dzieci, zapewniając im większą ochronę, zarówno w aspekcie prawnym, jak i psychologicznym oraz ekonomicznym. Publikacja zainteresuje zarówno prawników praktyków stosujących prawo rodzinne, jak i inne osoby uczestniczące w postępowaniu o rozwód, a także naukowo zajmujące się omawianą tematyką oraz odpowiedzialne za tworzenie prawa.

W państwach dotkniętych pandemią Covid-19 wskazuje się obecnie na wzrost liczby rozwodów. W Polsc... more W państwach dotkniętych pandemią Covid-19 wskazuje się obecnie na wzrost liczby rozwodów. W Polsce brak jest jeszcze oficjalnych danych w tym zakresie, jednak wydaje się, że tendencja ta jest przeciwna. Na spadek liczby rozwodów mógł wpłynąć czynnik ekonomiczny – wiadomo bowiem, że w czasie pandemii sytuacja finansowa wielu rodzin uległa pogorszeniu, a rozwód wiąże się nie tylko z wydatkami, ale i ze zmianami w sferze majątkowej obu stron. Nie oznacza to jednak, że w przyszłości tendencja ta nie ulegnie odwróceniu. Aktualnie należy się zastanowić nad tym, jaki wpływ ma pandemia na toczące się już procesy rozwodowe, a w szczególności na sytuację prawną małoletniego dziecka rozwodzących się rodziców w postępowaniu zabezpieczającym.

In its judgment of 23 January 2025, 13805/21, H.W. v France, the European Court of Human Rights (... more In its judgment of 23 January 2025, 13805/21, H.W. v France, the European Court of Human Rights (ECtHR) held that the marital duty and granting the divorce, attributing fault solely to the applicant, had not been based on appropriate and sufficient grounds, and that the domestic courts had not struck a fair balance between the competing interests, which according to the ECtHR was sufficient to establish a violation of Article 8 of the Convention on the Protection of Human Rights and Fundamental Freedoms. It can therefore be accepted that, in the opinion of the ECtHR, granting a divorce on the grounds of the wife’s exclusive fault for refusing to have sexual relations with her husband constitutes a violation of her right to respect for her private life.

The purpose of the study was to: A. to investigate the frequency and reasons for adjudicating the... more The purpose of the study was to: A. to investigate the frequency and reasons for adjudicating the placement of a child in foster care when contacts are not fulfilled despite the issuance of an order for payment of the monetary sum due [Article 598(16) CCP]; B. to determine whether the courts examine the financial status of the person failing to fulfil, improperly fulfilling or violating the obligations arising from the judgment or from the agreement concluded before a court or before a mediator on the subject of contact with the child; to examine in what amounts the courts threaten to order payment/order payment of the sum of money due; to try to relate the amount adjudicated to the financial status of the parents; or to relate this amount to the amount of maintenance due to the child (if information on the amount of maintenance will be available in the file). The survey comprised two parts: A. a survey for judges consisting of 12 questions; B. analysis of 180 files of cases on enforcement of contacts [Article 598(15) CCP and Article 598(16) CCP].

Particular attention is paid to the issues concerning the advisability of the participation of a professional lawyer in the activities undertaken before a notary public. Among other things, an answer is given to the question of whether the appearance of spouses at the notary public for the dissolution of marriage would obligatorily require the participation of a professional lawyer or legal counsel for each spouse. In this regard, reference is also made to the regulations in force in selected countries.

The article is based on the thesis that in certain situations, adjudication of guilt of marital b... more The article is based on the thesis that in certain situations, adjudication of guilt of marital breakdown may violate the ”welfare of the child” of divorcing parents. The article answers the question of whether the provisions of the Family and Guardianship Code relating to divorce should be amended and the adjudication of fault for marital breakdown abandoned, when one of the arguments in favor of this solution is the welfare and protection of the minor. In doing so, two proposals for changes were made. The first, involving the repeal of Article 57 of the Family and Guardianship Code (i.e., abandoning the court’s determination of which spouse is at fault for the breakdown of the marriage) and amending Article 60 of the Family and Guardianship Code, and the second, indicating how the institution of an “ombudsman for the interests of the child” could be used.

The author referred to the arguments cited by the Supreme Court and pointed out the practical consequences of applying the thesis it presented.

Nevertheless, not all the proposals contained in the Senate bill fully achieve the intended purpose. The author evaluates the proposed solutions, pointing out their advantages and disadvantages. To a certain extent, the author proposes a clarification of the code provisions in order to strengthen the implementation of the principle of the protection of the child’s welfare in the judicial process.

More and more often adults, despite adulthood, completed education, and having a job, continue to live with their parents. In Poland, such young adults are colloquially called gniazdownik ('nestlers'). 1 In Italy nestlers are called bamboccioni, in Great Britain boomerang kids, 2 in Spain hijos búmeran, in Germany kidults, in Francetanguy, in Finland aikuinen lapsi, in the United States K.I.P.P.E.R.S. into adulthood is delayed. Thus, they start families later, which results in changes
in the demographic and sociological structure. Therefore, one should consider
whether ‘nesting’ is also a legal issue and whether reducing the scale of this phenomenon requires systemic legislative amendments. The article also indicates research areas that should be analysed in order to assess the current legal situation
of adult children living with their parents or one of them. The issues presented in
the article are part of the theory of ‘protection of the weaker party’. In addition,
these issues emphasise the need to take into account the concept of family as understood in the constitutional perspective when discussing them.
