Abstract

In matters of inheritance between religious people, Islam has determined in the Law which establishes the authority of the Court. This authority has been approved in a limited way in the Religious Court Law. The problem that often occurs is that the advocate as the attorney of the plaintiff (client) does not follow the provisions submitted and submitted to the District Court on the basis of Unlawful Acts. In general, clients do not know about the endorsement. When this happens, the role of the advocate will be canceled by the role of the religious court and deciding the case of inheritance between Muslims (Islamic personaliatas)

Abstract

The Religious Court has the authority to examine, decide and resolve child adoption cases for people who are Muslim. This authority is regulated in Article 49 letter a number 20 of Law Number 3 of 2006 concerning Amendments to Law Number 7 concerning Religious Courts. In carrying out its authority, the Religious Court is based on the principle of Islamic personality, so ideally a person who is Muslim and wishes to apply for an adopted child should apply to the Religious Court. However, in reality the majority, including Muslims, submitted their petition to the District Court. The problem is, the District Court in deciding cases regarding applications for adopted children is based on customary law or Western law (BW), which in fact is different from Islamic law. The implications of adopting a child through the District Court will give rise to problems in the future, especially in inheritance issues, for example disputes between adopted children and other heirs.

Abstract

The Religious Court is a special judicial institution that handles and decides cases of Muslims based on the principles of Islamic personality. The absolute competence of the Religious Courts is stated in Article 49 of Law Number 7 of 1989, namely that the Religious Courts have the duty and authority to examine, decide and resolve cases at the first level between Muslims in the fields of (a) Marriage, (b) inheritance, wills and gifts made based on Islamic law (c) waqf and shadaqah. Based on Law Number 7 of 1989, the Religious Court has absolute authority in inheritance cases. Inheritance cases can take the form of lawsuits and petitions. However, in reality, religious courts have not been optimal in exercising this authority. This can be seen from the lack of inheritance cases decided by religious courts. These problems are partly due to the still entrenched customary inheritance law in Indonesian Muslim society, making it allergic to resolving inheritance problems in the Religious Courts. Moreover, some advocates also seem reluctant to refer their clients' inheritance cases to the Religious Courts.

Abstract

This study analyzes the foundational principles, curriculum structure, and contemporary contributions of Salafi Islamic educational institutions in Indonesia, focusing on their adherence to the manhaj salaf methodology. Employing a qualitative conceptual analysis through a structured literature review of 34  scholarly sources from 2010 to 2024, it explores the theological underpinnings, pedagogical approaches, and institutional responses to modernity. Salafi education prioritizes the purification of Islamic teachings, emphasizing tawḥīd, memorization of the Qur’an and ḥadīth, and traditional instructional methods such as halaqah and talaqqī. Secular knowledge integration remains minimal and strategic, preserving doctrinal orthodoxy. The institutions contribute significantly to moral and character development by fostering ethical discipline grounded in prophetic teachings. While cautious, selective adaptations to globalization and technological advances are evident, ensuring educational relevance without compromising core values. Limitations include reliance on textual analysis without empirical fieldwork, prompting recommendations for future research on practical implementations and comparative pedagogical models. The study underscores Salafi education’s vital role in maintaining Islamic orthodoxy and moral integrity within Indonesia’s pluralistic context, advocating for ongoing epistemological dialogue to balance doctrinal fidelity and educational openness.
