Abstract

UUD NRI Tahun 1945 pasca amandemen, tidak memberi ruang kepada Lembaga Tinggi (MPR) dalam membuat produk Hukum TAP MPR lagi. Akibat dari kewenangan MPR yang sudah dihapus dan jelas tertera dalam Bab I ayat (2) dan Bab II Pasal 3 ayat (1) sampai dengan (3) UUD Tahun 1945 sebelum amandemen. Namun, hal dilematis ini menjadi problematika dan perdebatan antar ahli hukum tata Negara di republik ini, akibat dari Pasal I aturan Peralihan yang menyebutkan pengujian status hukum TAP MPR sebagai batu uji. Status Hukum TAP MPR memiliki legitimasi pada konstitusi, namun yang menjadi persoalan ialah kewenangan MPR dalam membentuk kembali TAP MPR serta mencabut. MPR tidak lagi menjadi lembaga tertinggi Negara melainkan lembaga tinggi yang disamaratakan dengan lembaga-lembaga lainnya yang disebutkan dalam UUD NRI Tahun 1945, sehingga ini menjadi buah simalakama dalam praktiknya akibat dari di hapusnya Kewenangan tersebut, dalam Pasal 1 ayat (2) UUD Tahun 1945 sebelum amandemen, pun juga Pasal 3 ayat (3) UUD Tahun 1945 sebelum amandemen. Judicial Review yang pernah diajukan ke Mahkamah Konstitusi (MK) tidak membuahkan hasil, akibat MK tidak memiliki ruang yang cukup jelas atas pengujian TAP MPR ini, UUD NRI Tahun 1945 memiliki kewenangan hanya menguji UU yang bertentangan dengan UUD bukan TAP MPR yang bertentangan dengan UUD.

Abstract

ABSTRACT In collecting the parking tax in Medan particularly always contribute to local administration income of Medan, and in field it shall depend on how effectiveness to collect it. This study is aimed to deal with the matters regarding the methods, effectiveness and the barriers found in collecting the parking tax and how its contribution to improve more city income of Medan administration. The result of this research that through the planning stages (data collection), execution (deposit) and supervision, which also embraced self assessment system. Furthermore, local income tax is less effective than the parking sector because the number of parking tax-acquired very rarely reach the target. Bottleneck that occurs in sources of income is the presence of a target area that has been designated parking tax is not comparable to the true potential, the presence of an imbalance between the actual potential possessed by the parking tax revenue and local revenue realization that has been done, so the government is making efforts to regulations areas in which sanctions with the aim of supervision.   Keywords : Parking tax, City Administration income.

Abstract

Abstract Good governance principle should be a guidance for the government of Medan city in executing candidates for civil servant recruitment. In this research, there are several issues formulation to be discussed namely procedures of acceptance candidates for Civil Servants, procedure of acceptance candidates for Civil Servants in government of Medan city based on the principle of transparency and accountability, and acceptance of Civil Servants in creating good governance in government of Medan city. Procedure of acceptance candidates for Civil Servants in government of Medan city is performed by proposal of mayor, and objectively conducted in collaboration with universities conducted by the Civil Service Agency  and witnessed by the police and the inspectorate of Medan City. Procedure of acceptance candidates for Civil Servant in government of Medan city not been fully carried out the principle of transparency and accountability. Recruitment of civil servants in creating good governance is implemented in accordance with mechanism to be in force in the legislation and the government also sought to implement bureaucratic reforms to create clean governance and authoritative or known more as good governance ( good governance ) as inseparable part of the overall agenda of the government. Abstract

ABSTRACT The goods / services within the government are composed of organizations in the implementation of the Budget User / Authorized Budget, Commitment Officer, Procurement Committee, Managing Committee of Goods, which has the authority duties and responsibilities based positions - each, which is stipulated in President Number 54 Year 2010, the Budget Authority has the duty and authority by delegation of authority from the Budget Users, clearer about the delegation of authority to the Budget Users Budget Authority in Rule Number 1 Head LKPP 2012. Irregularities in the procurement of goods / services can government sanctioned, can be administrative sanctions, penalties and damages State sanction criminal penalties. Abstract

ABSTRACT Law is a part of the system of national life. Therefore, the law is a device that needs to be reviewed and developed in order to discipline the back (redisciplineering) or curb long-term national scale / area. Its targets are disciplining the working procedures of the relevant authorities so that appropriate and consistent based on two aspects. This is an approach to the discipline of work or task. Discipline back chaos in the system of government in the State of Indonesia is very necessary because of Discipline within the scope are essentially stateless We have not had any practical experience with a new model after the 1945 amendment so weak presidential system. The Government adhered to the legal / state authorities in Indonesia are not in accordance with the basic state and can be assessed pragmatic, because the characters responsive legal products include: reflecting a sense of justice and meet the expectations of society, government / state officials have not met the applicable law in Indonesia, because the legal issues The most frequent and entrenched in this country is the inconsistency of the law enforcement officers of the law and legal regulations and are written clearly in the legislation. Abstract

ABSTRACT   Radio is a means of communication that does not use cable as its medium, but uses electromagnetic waves to transmit voice. The use of radio frequency spectrum in the manner intended, and should not interfere with each other as the nature of the radio frequency spectrum can propagate in any direction without knowing the limits of the country, therefore, its use should require a permit from the Government. Concluded, first, setting the organization of broadcasting about granting permission to use the radio frequency spectrum in Indonesia are required for every person who, either legal entities of government, private and foreign in Indonesia, radio broadcasting must obtain permission from the Government through the MCIT.  Secondly, the principles of good governance Government associated with broadcasting license application filed by PT. RPLN are not implemented optimally and wisely, especially the Minister of Communication and Head of the Institute of Radio Frequency Spectrum Monitor Class II Medan. Third, the basic consideration of the judge's decision to cancel the Minister of Communication on radio broadcasting license application filed by PT. RPLN legally well-founded based on a consideration of the principles or the principles of good governance and has in the law normative.

Abstract

ABSTRACT Regional Representative Council (DPD) as a new state agency after the 1945 amendment was originally expected to be able to realize the presence of two rooms representation system (bicameral). As an embodiment of the people, the DPD related to the legislative function as stated in the Constitution, 1945. In carrying out its legislative function, the DPD's involvement is limited to the discussion of Level I. In fact, the 1945 allows DPD follow up on the process that takes place in Level II. The Constitutional Court (MK) has strengthened the legislative function of the DPD some previously reduced by Act No.27 of 2009 on MPR, DPR, DPD and DPRD, and Act No. 12 of 2011 on the Establishment of Laws and Regulations. DPD in the legislative function should be viewed as a whole, starting from the submission process to approve a Bill (the Bill). Implications of the decision of the Constitutional Court on strengthening the legislative function of the Regional Representative Council, that DPD is constitutionally have gained in three aspects: first, the authority of DPD in the proposed bill relating to the area; Second, the authority of the Council, who discussed the bill relating to the area; Third, DPD involvement in the preparation of the National Legislation Program. Strengthening the legislative function should be done by rearranging comprehensively legislative function in the system of government, with the fifth amendment of the 1945 Constitution is to establish a system of checks and balances in the representation of the people in the way that the doctrine of popular sovereignty. Abstract

ABSTRACT   Legal provisions regulate the management of the State assets in Articles 23, 23A, 23B, 23C, and 23D of the 1945 Constitution which includes APBN (State Budget), Tax, and other Revenues. Law No. 17/2003 and Law No. 1/2004 which regulate State finance that includes all right and obligation of the State can be valued by money, including all kinds of money and goods, including all goods bought or obtained by APBN/D or come from other legal sources. The legal status of ABMA/T owned by individuals (third party) and the certificate has been obtained from BPN do not guarantee that it is absolute although land registration is intended to guarantee legal certainty. In this case, the principles of negative, recent, and formal and material truth are used. The obstacles found by the team are as follows: assets are not found, the third party has obtained certificate from BPN, difference in area, shift in function, the team is not professional, lack of proactive, asset is in remote place, claim from the third party, and the problem with compensation. Abstract

ABSTRACT There is the difference in interpreting separated State’s assets. Many legal practitioners point out that separated State’s assets are corporations’ assets, but some of them point out that the assets of BUMN (State’s Owned Enterprises) are State’s assets because they come from State’s finance so that the Supreme Audit Agency has the authority to audit the assets of BUMN although. Concerning the assets of BUMN as an independent a corporation, and the status of the State as the capital owner, its position is only as a shareholder. According to the theory of legal entity, Public Accountant has the authority to audit the assets of BUMN as a corporation. The Institutional Court’s Ruling No. 48/PUU-XI/2013 does not pay attention to the position of BUMN whether it a public law or a private law.  When a company has signed its memorandum of association before a Notary, private law is automatically in effect. The Constitutional Court in its Ruling No. 62/PUU-XI/2013 does not consider legal experts’ opinion which states that when BUMN uses money in the company, it does not use the provision on APBN (the National Budget) system which is regulated by the government but is only based on business judgment rule. Abstract

ABSTRACT In the case of acceleration dwelling time, the Ombidsman of the Republik of Indonesia( ORI )  escort up to the President and followed up for the improvement of public service in the port.
