Abstract

This study aimed to determine the attitudes and views of interfaith leaders to theexistence of regulations related to issues of religious harmony in Indonesia. Does theregulation have significant benefits for a variety of efforts to resolve religious conflictsin Indonesia, or precisely the opposite. Locating the research in in Central Java , thisstudy used a qualitative approach. The data is taken from the idea or notion ofinterfaith leaders in Semarang as well as a variety of references related to the centraltheme of research. The data collection extracted by means of interviews and study ofdocuments/ literature. Then, the data were analyzed critical descriptively. The resultsshowed that the religious conflicts that occur due to various factors or root causes ofthe conflict are very diverse. Each of these religious leaders has a different view. Somepeople regarded pluralism as the root causes of conflict, there is also an opinion thatthe cause of the conflict is the existence of discrimination contained in the formulationof laws and regulations are regulated. Despite their differing views on the root causesof the conflict issue, they agreed that in order to maintain religious harmony inIndonesia there needs to be a regulatory laws governing religious life in Indonesia.***Penelitian ini bertujuan untuk mengetahui sikap dan pandangan tokoh lintas agamadengan keberadaan peraturan yang terkait dengan isu-isu kerukunan umatberagama di Indonesia, apakah peraturan tersebut memiliki manfaat yang signifikanbagi upaya penyelesaian konflik agama di Indonesia, atau sebaliknya. Penelitian inidilaksanakan di Jawa Tengah dengan menggunakan pendekatan kualitatif. Datatersebut diambil dari ide (gagasan) tokoh lintas agama di Semarang serta berbagai referensiyang terkait. Pengumpulan data diambil dengan wawancara dan studiliteratur. Data dianalisis secara deskriptif kritis. Hasil penelitian menunjukkan bahwakonflik agama yang terjadi karena berbagai faktor atau akar penyebab konflik sangatberagam. Masing-masing tokoh agama memiliki pandangan berbeda. Beberapaorang menganggap pluralisme sebagai akar penyebab konflik, ada juga pendapatbahwa penyebab konflik adalah adanya diskriminasi dalam perumusan undangundangdan peraturan yang diatur. Meskipun pandangan mereka berbeda pada akarpenyebab masalah konflik, mereka sepakat bahwa untuk menjaga kerukunanberagama di Indonesia perlu ada sebuah hukum yang mengatur peraturan kehidupanberagama di Indonesia.Keywords: keragaman agama, kerukunan beragama, konflik agama,peraturan

Abstract

This article aims to answer some questions: what is the meaning of “equal right” and “religious freedom” written in the text of UUD 45? How if, in the name of religious freedom, other people’s rights are offended? how if, in implementing Islamic law, others people’s rights are offended? Indonesian Constitution (UUD 45) gives freedom to every follower of a given religion to concretize his religious convictions in public life provided that, in doing so, the fundamental right of others are not offended. The UUD 45 also gives freedom to every citizen to make his religious convictions or religious teachings become a state legal policy as long as he or she follows the procedural constitution written in the UUD 45. However, after becoming state legal policy, Islamic law can no longer be claimed “Islamic Law”, because it’s now provided for answering the partial question of life, namely how to administer the state. From a sociological point of view, in order that the process of legislation runs smoothly, Islamic Law should first be transformed into living norms. Hence, it will be easier for the society to abide the law which originated from living norms. Since the function of law in maintaining public peace and order depends, for its effectiveness, on the actual social norms of the community, social acceptance is of great importance. Two ways of resolution will be discussed in this article, these are democratic resolution and transforming Islamic Law into social norms.[]Artikel ini bertujuan untuk menjawab beberapa pertanyaan, apa arti "hak yang sama" dan "kebebasan beragama" yang tertulis dalam teks UUD 45? Bagaimana jika atas nama ke­bebasan beragama bersinggungan dengan hak orang lain? Bagaimana pula jika dalam menerapkan hukum Islam mengganggu ataupun mengabaikan hak orang lain? UUD 1945 memberikan kebebasan kepada setiap penganut agama untuk mengekspresikan ke­yakinan agamanya dalam kehidupan publik dengan cacatan tidak mengganggu dan mengabaikan hak orang lain. UUD 1945 juga memberikan kebebasan kepada setiap warga negara untuk membuat keyakinan agama atau ajaran agamanya menjadi ke­bijakan hukum negara selama tetap mengikuti prosedur yang tertulis dalam UUD 1945. Namun, setelah menjadi kebijakan hukum negara, hukum Islam tidak dapat lagi diklaim sebagai "Hukum Islam", karena hukum tersebut telah dibuat dalam rangka mem­berikan solusi terhadap berbagai macam permasalahan dalam kehidupan, lebih tepatnya hukum ter­sebut telah menjadi pengatur sebuah Negara. Dari sudut pandang sosiologis, agar proses perundang-undangan berjalan lancar, Hukum Islam pertama-tama harus diubah menjadi norma hidup sehingga akan lebih mudah bagi masyarakat untuk mematuhi hukum yang berawal dari norma hidup. Karenanya hukum berfungsi dalam menjaga ketertiban publik, dan ini bergantung pada norma sosial yang berlaku pada masyarakat, sehingga akan mudah diterima oleh masyarakat. Dua tawaran solusi akan dibahas dalam artikel ini, yaitu: resolusi demokratis dan meng­ubah Hukum Islam menjadi norma sosial.

Abstract

This paper discusses the relationship between democracy and freedom of religion. If democracy is defined as the freedom to behave as long as it is still in the constitutional frame, then the problem is whether to interpret democracy by formalizing religion in the political and legal order of a democratic country? The question rests on the assumption that religion has no rational domain so that the relationship between democracy and religious freedom sometimes becomes problematic when imposed on the constitutional domain. Theories of John Rawls and Franklin I. Gamwell as modern thinkers led to the conclusion that in certain areas religion cannot be forced into the political sphere, but universally religion is part of politics.

Abstract

The idea of Gamwell on“religion as rational” was based on the concept that religious freedom is nothing other than a political discourse that can be figured out only through a democratic resolution. Changing paradigm from “religion as non-rational” to “religion as rational” is a necessary condition for entering a public debate. Yet, the sole public debate or public view is not enough to solve the modern political problematic. The public debate must be guided by a constitutional procedure affirmed by the body politic so that it fulfills the criteria of formal claim about justice. Applying qualitative research and literature review this research tried to reveal: Gamwell’s idea of religious freedom, the features of the Islamic State as described by Abdul Rauf and Gamwell’s concept of religious freedom and the idea of establishing the Islamic State advocated by Abdul Rauf.Gagasan Gamwell tentang "agama itu rasional" didasarkan pada konsep bahwa kebebasan beragama tidak lain adalah wacana politik yang hanya bisa diraih melalui resolusi demokratis. Mengubah paradigma dari "agama sebagai tidak rasional" menjadi "agama sebagai rasional" adalah syarat yang diperlukan sebelum memasuki debat publik. Namun, debat publik atau pandangan publik saja tidak cukup untuk memecahkan masalah politik modern. Perdebatan publik harus dipandu oleh prosedur konstitusional yang ditegaskan oleh badan politik sehingga memenuhi kriteria klaim formal tentang keadilan. Dengan menggunakan penelitian kualitatif dan kajian pustaka penelitian ini mencoba mengungkapkan: gagasan Gamwell tentang kebebasan beragama, ciri-ciri Negara Islam seperti yang dijelaskan oleh Abdul Rauf, dan konsep Gamwell tentang kebebasan beragama, serta gagasan untuk mendirikan Negara Islam yang dianjurkan oleh Abdul Rauf.

Penelitian ini  dilaksanakan di Jawa Tengah dengan menggunakan pendekatan kualitatif. Data tersebut diambil dari ide (gagasan) tokoh lintas agama di Semarang serta berbagai re­ferensi yang terkait. Pengumpulan data diambil dengan wawancara dan studi literatur. Data dianalisis secara deskriptif kritis. Hasil penelitian menunjuk­kan bahwa konflik agama yang terjadi karena berbagai faktor atau akar penyebab konflik sangat beragam. Masing-masing tokoh agama memiliki pandangan ber­beda. Beberapa orang menganggap pluralisme sebagai akar penyebab konflik, ada juga pendapat bahwa penyebab kon­flik adalah adanya diskriminasi dalam pe­rumusan undang-undang dan peraturan yang diatur. Meskipun pandangan mereka berbeda pada akar penyebab masalah konflik, mereka sepakat bahwa untuk menjaga kerukunan beragama di Indonesia perlu ada sebuah hukum yang mengatur peraturan ke­hidupan beragama di Indonesia.

Abstract

AbstractDivorce is still a social problem in Indonesia. Divorce must be done in court. Ironically, most divorce cases are decided verstek because the defendants are not present in court. One of the courts that deal with divorce cases is the Malang Religious Court. This article is doctrinal legal research with a conceptual approach and a case approach. The primary data source is the divorce decision in the Malang religious court. The results of this study indicate that the verstek decision in the religious court should not be a gap for husbands to escape responsibility for their wives and children after divorce. The panel of judges also needs to use ethical values in divorce such as the principles of ma'rf, islâh, ihsân and afw in giving verstek decisions. It is necessary to revitalize the ethical values of divorce in the Verstek decision in the Religious CourtsKeywords: divorce; religious court; verstek.AbstrakPerceraian masih menjadi problem sosial masyarakat di Indonesia. Perceraian harus dilakukan di pengadilan. Ironisnya, sebagian besar perkara perceraian di putus secara verstek karena pihak tergugat tidak hadir di pengadilan. Salah satu pengadilan yang banyak menangani perkara perceraian adalah Pengadilan agama Malang. Artikel ini merupakan penelitian hukum doktrinal dengan pendekatan konseptual dan pendekatan kasus. Sumber data primer adalah putusan perceraian di pengadilan agama Malang. Hasil penelitian ini menunjukkan bahwa putusan verstek di pengadilan agama tidak boleh menjadi celah bagi suami untuk lepas tanggung jawab terhadap istri dan anak-anak pasca perceraian. Majelis hakim juga perlu menggunakan nilai-nilai etis dalam perceraian seperti prinsip ma’rûf, islâh, ihsân dan afw dalam memberikan putusan verstek. Sehingga perlu dilakukan revitalisasi nilai-nilai etika perceraian dalam putusan verstek di Pengadilan AgamaKata Kunci: perceraian; pengadilan agama; verstek

Abstract

Islam exists in order to uphold justice. Likewise with families, where there are often unfair relationships between husband and wife, there are so many obstacles which can threaten the harmony of marriage. So far the issue of nusyūz is often connected to the wife and the Compilation of Islamic Law (KHI) confirms this. How Islamic law regulates nusyūz and how the perspective of qira'ah mubādalah about this nusyūz is are the main questions of this study. This study uses normative legal research method with descriptive technique. Data collection was carried out by literary study and then they were analyzed qualitatively by the deductive method. The results of this study are as follow: Nusyūz according to Islamic law (KHI) is conceptualized as a wife's disobedience to her husband, such as reluctance to have intercourse, surly in front of her husband, leaving the house without the husband's permission and others which make the husband dislike. If nusyūz occurs then it is resolved by: giving advice, separating beds, and hitting. Mubādalah as a method of interpretation of texts which is reciprocal, in terms of family relations between husband and wife, defines nusyūz as disobedience to household commitments so it applies to husband and wife. Nusyūz settlement by beating is considered as an act of violence so it should not be done. Inviting reconciliation to return to commitment is the best way according to QS. An Nisa': 128.

Abstract

This study aims to determine the attitudes and views of interfaith leaders with the existence of regulations related to issues of religious harmony in Indonesia, whether these regulations have significant benefits for efforts to resolve religious conflicts in Indonesia or vice versa. This research was conducted in Central Java using a qualitative approach. The data was taken from the ideas of interfaith leaders in Semarang and various related references. Data collection was taken by interview and literature study. The data were analyzed descriptively critically. The results of the study indicate that religious conflicts that occur due to various factors or the root causes of conflicts are very diverse. Each religious figure has a different view. Some people consider pluralism as the root cause of conflict, there are also opinions that the cause of conflict is discrimination in the formulation of regulated laws and regulations. Although their views differ on the root causes of the conflict, they agree that in order to maintain religious harmony in Indonesia, there needs to be a law that regulates the rules of religious life in Indonesia.

Abstract

Abstract: The development of religious character for converts is very important so that their Islamic faith becomes perfect (kāffah). Perfection is marked by leaving the old religious teachings and practicing Islamic teachings in the fields of faith, worship, morals, muamalah, being able to read and memorize the verses of the Qur'an. This study is intended to answer the question: Why is religious character building needed for converts in Singkawang City? This problem is studied through qualitative field research. Research location as a source of data through free interviews, structured interviews, participant observation, and documentation study. All data were analyzed using a case study approach with descriptive-analytical techniques because: the research problem is holistic, complicated and interpretive. This study shows that: The development of religious character for converts in Singkawang City needs to be done because the status of converts itself requires guidance because converts are people who leave their ingrained beliefs, religions and life behaviors and replace them with religions that are already ingrained. new namely Islam; because of the problems of converts that need to be resolved, because converts after becoming Muslims encounter many problems, not only religious problems, converts also encounter various other problems including negative responses from family, insults, isolation to conflicts and acts of violence from family members, it is still difficult. abandoning some of the traditions and aspects of their old religious teachings, as well as Islamic religious guidance that they have not yet received maximally; to meet the needs of converts; and to demonstrate a brotherly commitment.
